The arbitration parties may disagree with the arbitrator's award about whether they are eligible for the dispute case. While lots of disputes cases relating to subrogation are arising, it is not easy to find subrogation arbitration system to handle them clearly. The main issue is an availability of subrogation arbitration in case of the dispute which the insurer requests the arbitration against the carrier according to the arbitration clause of Bill of Lading. The direct parties of arbitration clause of the B/L are the carrier and the holder of the B/L. Could the insurer get the position of the arbitration party in stead of the holder of the B/L after compensation if there was an accident of insurance on the way of carriage? Even though there are a few arbitral awards of subrogation, the reason of the eligibility of subrogation arbitration is not enough. This paper scrutinized precedent research papers, arbitration awards, judicial precedents, and the Automobile Subrogation Arbitration System. Vague dispute resolution system which burden corporations with so many costs must be not good for business. In the view of economic efficiency, blank of contract, reciprocality, and Coase Theorem, it is recommended that subrogation arbitration system for the international trade would be better focus on the hypothesis of "Firm Offer Character of Arbitration Clause."
The purpose of this study is to explore and understand the meaning of 'Good Death' that the Korean aged people are generally thinking based on their values and the sentiments. For this purpose, we carried out individual and in-depth interviews with 40 aged persons living in Seoul taking their genders and social-economic status into consideration from March to May 2003. We applied qualitative research method to this study. Eight graduate students were responsible for the interviews. They majored in gerontology or had experiences of field work with old persons. It took an average of one and a half hour and maximum of two hours for each of the interviews. All of the processes of each interview were tape-recorded under the agreement with each interviewee. The main and sub themes from the data can be classified to seven categories according to the Phenomenological Approach designed by Colaizzi(1978). The main theme of good death that most of the interviewees considered was 'Blessed Death', very similar to 'Death Fortune' in the five good fortunes found in Korean tradition and the Confucianism. Also, the main concept is classified to seven sub-themes: (1) Not seeing their children's death; (2) Dying in front of their children; (3) Not to be a burden of their children during their lives; (4) Dying after doing all of their duties as parents; (5) Dying with no pain; (6) Completing the natural span of their lives; and (7) Prepared death. Thus, 'Blessed Death' that Korean aged people consider seems to be very closely related with the lives, health, happiness and success of their children. Based on the findings, we concluded that both social policy makers and social service providers are required to keep in mind the meanings of 'Good death' that most of the Korean aged people consider in order to help them enjoy successful aging during their remaining lives.
Tax assistance system in Korea is a one that is designed by the central government to achieve specific policy objectives through the tax relief for economic activities or specific industries, leading to the development of the industries, Thus, the purpose of this study is to see if the government's direct tax assistance system for small and medium manufacturing firms is effective and then to contribute to establishing necessary policies for an effective tax assistance system based on the identification of a direct assistance system that is substantially useful to those firms. T- test was performed to see if there was a difference in tax burden between small and medium manufacturing firms and small and medium non-manufacturing firms and also to see whether the direct assistance system was effective. The results obtained from the statistical analyses are as follows: (1) The tax reduction rule applied to small and medium firms was turned out to be effective based on the fact that the effective tax rates of the small and medium firms to which the rule was applied were, on the average, significantly lower than those of the Listing large corporation which did not receive the tax benefit and also on the fact that the tax savings rates of the small and medium firms which could apply the rule were, on the average, significantly higher than those of the Listing large corporation to which the rule was not applied. (2) The tax credit rule applied to small and medium manufacturing firms was also turned out effective based on the same fact as described in the case of the application of the tax reduction rule.

In the situation of rapid industrialization based on the lopsided development of economy since 1960, Korean rural society has faced a crisis of disruption. As a result, the civilian government has tried a few actions to change the circumstance. However, it is said that the coral polices were not satisfactory. Those who were concerned with the rural problems of these days argue that it is necessary to adopt new policies and further to change the policymakers` philosophies concerning the matter. The arguments are certainly based on the beliefs that the sound policies come from the sound philosophies. This study aims to analyze the existing rural polices and their policymakers` philosophies and to design of a new paradigm. For the purpose, this study was set there specific objectives: First, to overview the moor points of Quantitative Utilitarianism of Jeremy Bentham and the Social Justice Theory of John Rawls, the contrasting frameworks of the moral philosophies; Second, to trace the major or trade of the rural policies since 1960s in Korea; Third, to analyze the policymakers` philosophies reflected on the rural policies; Fourth, to design a new paradigm of the rural policies. This study mainly adopted descriptive method based on the various source of government and non-government statistics, white papers and other researches. The major findings of this study may be summarized as follows: 1. The historical epochs of the rural policies in Korea was divided into the periods: (1) An organizational and institutional establishment for self-reliance of main crops and the New Village Movement $(1969{\sim}70)$; (2) An initiation of `open-door` policies to the foreign farm products $(1970{\sim}80)$; (3) Completion of the UR meetings and the recommendations of the Rural and Fishery Development Commission (1980-present). 2. It was found that the philosophical foundations of coral policies were directly reflected from the utilitarianism of the national development. Under the philosophy it was the modem sector of economy that was to spearhead the national development, and the rural sector was situated to the peripheral position and hardly in the spot-light. Therefore, it may be said that the present situation of the rural society was largely rooted in the model of economic development. 3. As a new direction of the coral policies, many studies were focussing on the NTC (non-trade concerns) functions of agriculture for the present and future society. The researchers argue that the cost of protecting and supporting agriculture and rural society may be higher than that of the burden which the nation should be bear in the case of failure of agriculture. Although it tray be true, however, it should be noted that the argument is another type of utilitarianism which prevailed in the past. As a philosophy of rural policies, utilitarianism is straight forward and persuasive, however, it has also limitations in terms of relativism in broad sense or social justice in specific manna. 4. This study suggests to set the philosophical foundations of rural policies on the basis of Rawl`s Theory of Justice mentioned earlier. It emphasizes the inviolability of social justice which was neglected for the national benefits timing the period of development dictatorship in 1960s and 1970s. The principles of social justice for coral people were identified as twofold; (1) The principle of the t equal liberty; (2) (a) Difference principle, (b) The principle of fair equality of opportunity.

This study was made on the concerns and implementation of the ICT(Inormation and Communication Technology)-utilized lesson by home economics teacher. The objective of this study is to investigate the stages of concern and the level of use of the ICT-utilized lesson by home economics teachers in Kyunggi Province through the concerns based adoption model(CBAM) and to provide assistance for ICT-utilizing lesson to be efficiently adopted to home economics. This study made selected 200 schools by random sampling among 233 middle schools which have two or more home economic teachers and 21 or more classes in Kyunggi Province which has a total of 395 middle schools and mail-surveyed on 400 home economics teachers by means of questionnaire. The stages of concern. the levels of use and the types of implementation were used as instruments in this survey. The results of this study on the stages of concern. the levels of use and the type of implementation of the ICT-utilized lesson by home economics teachers in Kyunggi Province were as following: First. the highest point of the concern of home economics teachers of ICT-utilized lesson was the stage of awareness. the second highest point was the stage of management. the 3rd stage. and the stage of information. the lst stage. Second. the highest level of implementation of ICT-utilized lesson by home economics teachers was the level of mechanical use. the 3rd stage(30.4%), which followed by the level of orientation. the 1st stage(22.5%). and the level of nonuse(16.7%). the level of rountine use. the 4th stage(13.7%) the level of integration. the 5th stage(11.8%). the level of preparation 2(3.9%). and the level of renewal. the 6th stage(1.0%) Third, information search was the most in the type of ICT-use and in the course of lesson CD-ROM was used the most.. During ICT-utilized lesson. most of teachers used computer one to two hours a week mainly in the lessons of clothing life and eating life. Home economics teachers took the most training of how to use word-processor(68.6%) during computer education. and 60 teachers(66.0%) gave positive response about the effect of computer education on teacher's learning. Finally. the biggest problem with ICT-use in the teacher's learning was the long preparation time for lesson. and problem with ICT-utilized lesson was the burden of time and effort spent to buy needed materials and to recompose the existing materials for the lesson. Therefore. so as to adopt ICT-utilized lesson efficiently into school it is needed that active promotion for the lesson should be made to teachers. training teachers to raise their ability to use computer and various kinds of software should be expanded. and school authorities' financial and administrative assistance should be given for the smooth proceeding of the lesson.
In spite of rapid sociocultural changes and an increase in the number of nuclear families in recent years, quite many families in Korea still have taken the extended family form where daughter-in-law provides care for the elderly parents. Even though the nature of the inter-generational relationship in Korea is reciprocal in many regards, most of the studies looked at the burden or costs of coresidence with the elderly parents while relatively little attention has been given to the positive side of the coresidence. This study is an attempt to fill this gap in the area. The purpose of this study is to examine not only the costs but also benefits of the coresidence with the elderly parents. We also explore whether there is a rural-urban differences in costs and benefits of coresidence and related factors. For the purpose, data were gathered from 876 daughters-in-law of three generational family both in rural and urban area, using structured questionnaire. The statistical methods used for data analysis were descriptive statistics, cross tables, and regression analysis with SPSS/PC+ program. The major findings of this study were as follows: Marital and economic status of the elderly parents, age, job status and filial responsibility attitude of caregiver, sibling support, and coresidence duration were the significant variables predicting the level of perceived benefits. Marital status of elderly parents, income, job status, educational level, and filial responsibility altitude of caregiver, residence region affected the level of perceived costs. Rural-urban differences are found in many aspects of coresidence experiences and related factors. Rural caregivers receive higher level of the sibling support, have more traditional final responsibility altitude and perceived less costs and more benefit than urban caregivers. There also are differences in the factors influencing the level of perceived costs and benefits between rural and urban area. Level of sibling support and final responsibility attitude have significant impact on both the perceived costs and benefits. But there are differences in terms of that perceived costs and benefits of urban caregivers are affected by job status of caregivers while those of rural caregivers are affected by educational level of caregivers and marital status of elderly. The results confirm that Korean caregivers experience both positive and negative aspects of coresidence and shows that the nature of the inter-generational relationships differ between rural and urban Korea.
This paper examines the redistributive potential of capital taxations within the two-class overlapping generations model, where only capitalists are intergenerationally linked through heritable capital stocks. In particular, the dynamic welfare incidence of two different capital taxations is examined; first a capital income tax levied uniformly on interest earnings, and second, an estate tax levied on the intergenerational transfers of capital stock within the capitalists' families. Redistributive effects are measured by examining how the permanent and unanticipated changes in proportional capital income tax and estate tax rates affect workers' welfare when the proceeds in each period are distributed, in a lump-sum fashion, among young workers. It is shown that, except for in the short run, both the capital taxes are ineffective and may actually lower the workers' steady state welfare through the shifting of tax burden toward workers from capitalists. Differential incidence analysis shows that redistributive potential is diminished further when the lump-sum transfers are financed by the estate tax rather than by the capital income tax. Although the model examined in this paper is based on simple and strong assumptions, this study suggests that redistributive policy using the capital taxations may only have distortionary effects in the long run, without improving workers' welfare, by incurring dead-weight loss unless additional fiscal measures are implemented to increase the investment incentives.
In Korea, nearly 100 billion won is spent annually under the name of energy voucher on 600,000 households for the last five years, and this is a unique case and hard to monitor worldwide. Therefore, no studies have been conducted to assess impacts of the energy voucher on energy consumption and cost burden alleviation for beneficiaries. This paper aims to demonstrate the effectiveness of energy vouchers in terms of energy expense. The propensity score matching was conducted on samples of low-income households based on the Korea Welfare Panel. Then, simple Difference-In-Differences and Fixed-Effect Difference-In-Differences models were applied to estimate the effect of energy vouchers. In results, the beneficiaries of energy vouchers would spend an additional 4,371~4,870 won per month on energy consumption. The ratio is equivalent to 51.9~57.7 percent of the aid, which is also the highest when compared with 23~56 percent of U.S. Food Stamp. In terms of energy welfare, voucher payment could become one of the best management practices. However, identifying the blind spots as non-reciprocal households and expanding the differential support mechanism that reflects the energy consumption environment should be solved in the future.
There has been fast progress in economy in Korea derived by a consecutive five-year plan program for economic development started in the early 1960's. In the field of transportation, rapid changes in the technological environment of transportation and communication have brought a revolution of the transport system, of which inter-modal transportation through containerisation is typical. Because of the rapidly growing traffic volumes of cargo, especially container traffic, and lack of investment into transport infrastructure in the past, both road and railway are beyond their capacity. As a result, the public-road network has suffered a serious congestion problem. For instance, in relation to the corridor between Seoul and Pusan, today, it takes about 14 hours for the journey of container trailer through Kyongbu Expressway, for which it used to take only 7 hours in 1986. For the railway, though the congestion problem is not very serious compared with the road sector, a shortage of capacity on certain main lines has emerged as a problem as railway traffic has increased. Furthermore, the further expansion of the system in near future is difficult due to burden of higher construction the cost. Unlike these two modes, coastal shipping, which has been paid relatively less attention for commodity transport in Korea, shows no constraint in this respect. In addition, it is the most cost efficient mode of transport. This work therefore aims to make a proposal for the alternative inland transportation mode, which is to promote the coastal transport of container. Three obstructing factors for the promotion of the coastal transport are investigated and some solutions for those are suggested as follows : First, it appears to be essential to provide exclusive ports for the coastal shipping, that comply with simplification, specialization and rationalization. The optimum size of berths on the exclusive ports in Pusan port is estimated as 16-20. We found that it needs periodical study and publicity on the advantages from the adoption of the coastal mode. Inducing competition in the coastal shipping market is also necessary. For the supply of the fleet in the coastal shipping, chartering of the surplus ships in the oversea shipping is found to be more desirable than new shipbuilding. Second, to solve the fragmentation of the companies which wish to participate in the coastal transport, government has to implement the subsidy policy. The encouragement of participation of the shipping lines engaging in Korea-Japan run and Korea-East South Asia run, into coastal shipping also needs to be considered cautiously. Third, simplification of the document for entry in ports is needed for rational coastal shipping management. We can use B/L (Bill of Lading) for coastal shipping as a prerequisite to get the indemnity by P & I Club. The reduction of the government controls on entering and leaving the ports also needs.
The rapid progress of aging society gives rise to a variety of problems of the aged. In particular, the health issue among the elderly poses a socio-economic burden on our society. In a bid to promote the health of the elderly, development and application of various contents linked with the ICT technology to our daily life and ways to facilitate their use among the elderly should be sought. Korea has provided a variety of contents designed to promote or maintain health of people of various ages through the wide spread and use of smart phones since 2010 but there has been a severe lack in contents for the elderly in terms of their quantity and quality. Against this backdrop, this study aims to utilize dance characterized by physical movements and bodily expressions as part of developing ICT-based contents for health promotion of the elderly. This study has adopted a number of research methodologies, including analysis of preceding researches into elderly welfare based on the research topics and periods of from domestic academic journals and academic theses (master's, doctoral), ICT-based preceding researches into elderly affairs, preceding researches into dance programs for the elderly, based on which I intend to present a proposal on the development and use of dance contents.
