Various countries established Geographical Indication (GI) system to protect the right and traditionality of their native products. The regulations vary by country but can be divided accordingly: Protection by trademark systems such as in USA, Special Protection for Geographical Indication as in EU, Protection by both schemes as in China and Korea. Within the systems, countries provide diverse schemes such as PDO and PGI in EU depending on the scope of the product. However, GI system in Korea provides one definition which only protects products that express definite tie to its territory of origin, preliminary with the origin of the ingredient. It is necessary for the government and industry to seek ways to revitalize the local economy in the global market and increase the number of GI products by aligning GI systems with foreign countries and support mutual bilateral agreement.

Purpose - This paper examines South Korea's potential status as a carbon leakage country, and the level of risk posed by the Korean emissions trading scheme (ETS) for Korean industries. The economic effects of border carbon adjustments (BCAs) to protect energy-intensive Korean industries in the process of achieving the carbon reduction target by 2030 through the Korean ETS are also analyzed. Design/methodology - First, using the Korean Input-Output (IO) table, this paper calculates the balance of emissions embodied in trade (BEET) and the pollution terms of trade (PTT) to determine Korean industries' carbon leakage status. Analyses of the risk level posed by carbon reduction policy implementation in international trade are conducted for some sectors by applying the EU criteria. Second, using a computable general equilibrium (CGE) model, three BCA scenarios, exemption regulations (EXE), reimbursement (REB), and tariff reduction (TAR) to protect the energy-intensive industries under the Korean ETS are addressed. Compared to the baseline scenario of achieving carbon reduction targets by 2030, the effects of BCAs on welfare, carbon leakage, outputs, and trading are analyzed. Findings - As Korea's industrial structure has been transitioning from a carbon importing to a carbon leaking country. The results indicate that some industrial sectors could face the risk of losing international competitiveness due to the Korean ETS. South Korea's industries are basically exposed to risk of carbon leakage because most industries have a trade intensity higher than 30%. This could be interpreted as disproving vulnerability to carbon leakage. Although the petroleum and coal sector is not in carbon leakage, according to BEET and PTT, the Korean ETS exposes this sector to a high risk of carbon leakage. Non-metallic minerals and iron and steel sectors are also exposed to a high risk of carbon leakage due to the increased burden of carbon reduction costs embodied in the Korean ETS, despite relatively low levels of trade intensity. BCAs are demonstrated to have an influential role in protecting energy-intensive industries while achieving the carbon reduction target by 2030. The EXE scenario has the greatest impact on mitigation of welfare losses and carbon leakage, and the TAF scenario causes a disturbance in the international trade market because of the pricing adjustment system. In reality, the EXE scenario, which implies completely exempting energy-intensive industries, could be difficult to implement due to various practical constraints, such as equity and reduction targets and other industries; therefore, the REB scenario presents the most realistic approach and appears to have an effect that could compensate for the burden of economic activities and emissions regulations in these industries. Originality/value - This paper confirms the vulnerability of the Korean industrial the risk of carbon leakage, demonstrating that some industrial sectors could be exposed to losing international competitiveness by implementing carbon reduction policies such as the Korean ETS. The contribution of this paper is the identification of proposed approaches to protect Korean industries in the process of achieving the 2030 reduction target by analyzing the effects of BCA scenarios using a CGE model.
노무용역 제공사업의 근로자들은 거의 특별한 기능이 필요하지 않는 단순노동에 종사하는 사람들이다. 대부분 노동법의 기본원리상 금지된 근로자공급 사업에 가까운 전근대적인 고용형태로 일하는 경우가 많고 그만큼 근로조건이 나쁘고 고용불안이 일상화되어 있다. 일자리가 없어진 것이 아니라 다른 사업자에게 넘어가는 것뿐인데 근로자나 근로조건만 바꾸어 이윤을 극대화 하는 기업의 행위는 규범적으로 정당화되기 어렵다. 기업변동에 수반되는 일자리의 상실에 대한 두려움은 인격의 존엄성을 모독할 수 있는 심각한 위협요소 중의 하나이다. 이런 점에서 유럽지침의 보호범위를 넘어서 노무용역 제공자의 변경의 경우까지 고용과 근로조건을 보호하고자 한 영국의 사례는 입법모델로서 시사하는 바가 많다. 영국은 법원과 의회가 고용승계의 요건인 사업의 동일성여부 판단기준의 범위를 확대함으로써 EU 지침과는 다른 태도를 취하였다. 특히 2006년 기업이전(고용보호)법은 아웃소싱을 포함한 '서비스공급주체의 변경'이라는 사업이전의 방식을 고용승계의 대상으로 명문화 하였다. 신설된 서비스 공급주체의 변경에는 외부위탁, 노무용역 공급업체의 변경, 외부 위탁한 업무를 다시 내부로 돌리는 내부화의 세 가지 형태가 구체적으로 열거되었다. EU 법에서는 사업이전이란 개념의 확대 해석에 의하여 이 문제의 해결을 시도한 반면 영국은 입법으로 이를 명확히 하고 그 보호범위를 확대하였다. 한국도 안정적인 일자리와 인간다운 근로조건의 보장이라는 헌법적 가치의 실현이 그것을 가장 필요한 사람들을 외면하지 않도록 적극적인 입법 노력이 필요하다.
본 논문에서는 2020년 3월 12일 제시된 EU사법재판소의 A and Others v. Finnair Oyj 판결을 검토해 보았다. 본 판결은 대체항공편에서의 운항지연의 경우에도 금전보상청구를 인정하였다는 점에서 중요한 의미가 있는 판결이다. 이에 본 논문에서는 아직 아직 국내에 소개되지 않은 본 판결을 분석하여, 향후 항공여객의 권리보호 논의 내지는 EC 261/2004 규칙의 해석론적 검토와 관련한 비교법적 참고자료의 역할을 하고자 하였다. 본 논문에서는 먼저 A & Others 판결의 사실관계를 정리하고 EU사법재판소의 판시사항을 개관해 보았다. 몇 가지의 논점들과 EU사법재판소의 판단 법리를 정리한 후, 논문의 구성적 논점을 크게 ① 대체항공편의 운항지연과 그와 관련한 여객의 보상원칙 및 ② 운송인 면책사유로서의 특별한 사정의 해석기준으로 나누었다. 이렇게 논점을 구분하여, EC No 261/2004 규칙의 각 규정들, 기존에 제시된 EU사법재판소 판례의 경향과 함께 본 A & Others 판결을 구체적으로 살펴보았다. 결론적으로는 본 판결의 취지와 항공여객운송실무상의 시사점 등도 생각해보았다. 또한 우리법과의 비교법적 논의도 간략하게나마 언급해 보았다.
본 논문에서는 2018년의 EU사법재판소의 Wegener 판결을 검토해 보았다. 본 판결은 운항지연의 경우에도 보상청구권의 성립을 인정하였다는 점에서, 기존의 Sturgeon 판결, Nelson 판결, Folkerts 판결의 법리를 유지·재확인하였다는 취지가 있다. 그러나 Wegener 판결은 다음과 같은 해석상 문제가 있다. 바로 EC 261/2004 규칙의 역외적용을 명시적으로 인정했다는 점이다. 역외적용은 주로 경쟁제한과 관련한 경제법에서 예외적으로 이루어지고 있었다. 그러나 그마저도 사법권 내지는 영토주권의 침해라는 문제를 야기하므로 상당한 비판을 받고 있는 것이 현실이다. EU사법재판소가 EC 261/2004 규칙의 역외적용을 적극적으로 인정하기 위해서는 EU 역외의 제3국에서 발생한 행위가 반경쟁적 행위가 되어 EU 운송법 체제와 EU 운송업계에 심각한 영향을 미쳐야 하며, 이것은 구체적인 입증을 전제로 하고 있어야 한다. Wegener 판결에서 모로코 카사블랑카에서 환승노선에 탑승하지 못한 여객은 피고항공사의 다른 항공기에 의해 4시간 연착하여 아디가르에 도착하였다. 이 상황이 EU의 항공여객운송법 체제와 운송업계에 반경쟁적 영향을 미칠 수 있을지가 의문이다. Wegener 판결에서 EU사법재판소는 Folkerts 판결을 인용하며, 그 취지를 존중하고 있는데, Folkerts 판결과 Wegener 판결은 사실관계가 본질적으로 다르다. Folkerts 판결에서는 환승지가 프랑스 파리의 EU 역내 지역이었고, Wegener 판결은 환승지가 모로코 카사블랑카로서 EU 역외 지역이었다. 또한 Folkerts 판결에서는 여객이 탑승한 항공사가 EU에 등록된 'EU적 항공기'였고, Wegener 판결에서는 EU 역외 지역에서 등록된 '제3국적 항공기'였다. EC 261/2004 규칙 제3조 제1항의 적용범위를 최대한 넓게 해석한다 하더라도, 카사블랑카에서 아디가르까지의 항공편이 EU 역외 출발에서 EU 역외 도착이라는 사실은 극복하기 힘들다. EU사법재판소는 이를 극복하기 위해 연결운항은 환승노선을 모두 포함하여 전체적인 하나의 운항으로 보아야 한다고 설명하고 있으나, 그것은 Folkerts 사안에서나 적용되는 것일 것이다. 국제항공운송에서는 전통적으로 '항공기는 원칙적으로 등록국의 배타적 관할권에 복종한다'라는 점이 중시된다. 동일한 공항을 출발한다고 하더라도, 등록국이 다른 항공기들이라면, 예컨대 A국적의 항공기와 B국적의 항공기는 각각의 보상규정과 책임유무가 개별적으로 형성되어 있다고 보는 것이 일반적인 시각일 것이다. EU 체제가 항공기의 '국적주의'가 아닌 '발지주의'를 채택하고, 나아가 역외적용마저 인정해 버린다면, 항공기의 국적주의를 채택한 EU 역외의 다른 국가들의 법률은 어떻게 되는 것인가? 제3국이 항공기 발지주의를 채택한다고 보증할 수 있는가? 이는 법제간의 충돌을 넘어 외교 분쟁의 씨앗이 될 수 있다. 이러한 점에서 Wegener 판결은 다소 아쉬움이 남는 판결이라고 생각한다.
본 논문에서는 국내의 철도 항공 육로를 통한 물류운송산업 규제에 대해 살펴보고 여객 및 화물운송업 규제의 개선이 국민경제에 미칠 수 있는 영향을 계량화하고자 한다. 우리나라의 물류산업은 산출 및 생산규모가 점진적으로 확대되고 있으나 산업구조는 비교적 영세한 편이다. 한편 산업의 규제는 OECD 국가에 비해 높은 수준이며 국내의 여타 산업에 비해서도 그 수준이 높은 것으로 나타났다. 경제적 규제의 수준을 비교 제시한 OECD의 국가별 네트워크산업 규제지수를 살펴보면 우리나라의 물류운송산업 규제지수는 지난 40여 년 동안 점차 감소하였으나 여전히 EU, 일본, 미국 등의 국가보다 높은 수준이며 특히 철도물류에서는 가격규제와 진입규제가 상당한 것으로 파악되었다. 본 논문에서는 네트워크산업 중 하나인 물류산업의 규제 지수가 1인당 국내총생산에 미치는 효과를 고정효과 모형을 통해 분석하였다. 실증분석 결과 교통물류부문의 규제지수가 한 단위 개선될 경우 1인당 실질 GDP를 약 8.1% 증가시키는 효과가 있는 것으로 나타났다. 즉, 우리나라 물류운송산업 규제가 약 10%가량 개선될 경우 1인당 국내총생산을 2.16% 상승시키는 효과가 있을 것으로 추정되었다. 특히 이러한 개선효과는 우리나라와 같은 제조업 중심의 국가에서 경제적 규제의 개선에 대해 더욱 크게 나타날 것으로 기대되며 이를 실현하기 위해서는 물류 및 운송업 부문별로 구체적이고 신중한 규제개선 노력이 요구된다.
No one doubts that textile and apparel industries have contributed to economic miracles of the export-led growth in Korea. However, by the turning of 1990′s, these sectors have encountered many problems such as decreasing of domestic production and exports mainly due to wage rise and shortage. Therefore, foreign direct investment to the low labor cost countries has been enlarged for a way of improving its competitiveness and increasing exports. However, no intensive study has been made exploring current investments and future directions. This study focuses Vietnam as one of the promising overseas investment countries. The purposes of this study are to analyze current investment status of Korean textiles and apparel firms in Vietnam, to explore merits and problems Vietnam has, and to present useful implications and strategies for Korean textiles and apparel companies. Analysis of current secondary data suggests that Korean apparel industry, rather than textiles industry, have invested more in Vietnam, mostly in southern Ho Chi Minh City. Investments of Korean apparel and textile firms have shown steady increase from 1990 but have turned to a decrease from 1995. Findings suggested that Vietnam has merits for attracting foreign investment since it provides relatively cheap labor and outstanding skillful hands suitable for apparel and textiles industries. In addition, because of EU quota increase and the trade agreement between Vietnam and USA it is likely for firms in Vietnam to increase exports to EU and USA Rapid expansion of domestic apparel market and "Korean trend (Han Rue)" in Vietnam resulted from successful star marketing of Korean firms are another merits Vietnam has to the Korean fm. However, regulations of central government, low efficiency of bureaucratic and stiff administrative process, difficulty of making decision in case of joint venture, lack of social overhead capital, high factory construction costs, weak construction condition, and the excessive competition among investment enterprises have found to be problems. Based on pros and cons of investment to Vietnam, marketing strategies, practical implications and future directions were suggested.
Rotem Company has designed and manufactured a railway vehicle body according to the European standard EN 12663, which applies to all railway vehicles within the EU(European Union) and EFTA(European Free Trade Association) territories. EN 12663 specifies the loads vehicle bodies shall be capable of withstanding, identifies how material data shall be used and presents the principles to be used for design verification by analysis and test. The structural design of railway vehicle bodies depends on the loads they are subjected to and the characteristics of the materials they are manufactured from. However, the structural requirements of EN 12663 are very different from those of existing Korean and Japanese regulations and standards. Therefore, in order to fulfill the structural requirements, Rotem Company has carried out Finite Element Analysis (FEA) and has performed load tests on the vehicle body according to EN 12663. This research contains the results obtained by the analysis and the load tests. The analysis is carried out using I-DEAS Master Series 8 and specially designed test jigs and equipment are used for the load tests.
The use of chemical products to enhance and improve life is a widespread practice worldwide. But alongside the benefits of these products, there is also the potential for adverse effects to people or the environment. As a result, a number of countries or organizations have developed laws or regulations over the years that require information to be prepared and transmitted to those using chemicals, through labels or Material Safety Data Sheets (MSDS). While these existing laws or regulations are similar in many respects, their differences are significant enough to result in different labels or MSDS for the same product in different countries. Given the reality of the extensive global trade in chemicals, and the need to develop national programs to ensure their safe use, transport, and disposal, it was recognized that a Globally harmonization system of classification and labeling of chemicals(GHS) would provide the foundation for such programs. This study offered complementary details of GHS classification criteria adopted in Korea by analyzing the differences in chemical classification system between UN and Korea Ministry of Labor. Also it is proposed that mutual agreement of information DB used is required by comparing classification results of chemicals in Korea, Japan, and EU. We offered the lists of information sources useful for chemical classification.

② 상기 이용제한 규정에 따라 서비스를 이용하는 회원에게 서비스 이용에 대하여 별도 공지 없이 서비스 이용의
일시정지, 이용계약 해지 할 수 있습니다.
제 17 조 (전자우편주소 수집 금지)
회원은 전자우편주소 추출기 등을 이용하여 전자우편주소를 수집 또는 제3자에게 제공할 수 없습니다.
제 6 장 손해배상 및 기타사항
제 18 조 (손해배상)
당 사이트는 무료로 제공되는 서비스와 관련하여 회원에게 어떠한 손해가 발생하더라도 당 사이트가 고의 또는 과실로 인한 손해발생을 제외하고는 이에 대하여 책임을 부담하지 아니합니다.
제 19 조 (관할 법원)
서비스 이용으로 발생한 분쟁에 대해 소송이 제기되는 경우 민사 소송법상의 관할 법원에 제기합니다.
[부 칙]
1. (시행일) 이 약관은 2016년 9월 5일부터 적용되며, 종전 약관은 본 약관으로 대체되며, 개정된 약관의 적용일 이전 가입자도 개정된 약관의 적용을 받습니다.
