After establishing the EIA(Environmental Impact Assessment) act in the Federal Republic of Germany there still remain methodical and substantial deficits. So nearly every environmental impact study went to be a matter of experiments. The requirement for standardization of data sampling and evaluation has permanently been increasing. This is meant to ensure quality standards for the assessment of environmental impacts as well as to maintain reliability required by the projecting company. Such a harmonization is of special importance because of the strongly accelerated expansion of traffic infrastructure caused by the reunification of Germany. That is why the guideline "EIA carried out" for the German Railways company is in process of development This guideline, focussing on practical demands, comprises impacts of railways, adequate sets of indicators, feasible tools for the prognosis and evaluation of environmental reactions. "EIA carried out" will be introduced not only as a manual but also through workshops and pilot studies.
This study, focusing on the area expansion of limestone mines, identifies the problems of Environmental Impact Assessment(EIA) and what impact the current problems exert on another mines developing process. The legal relations analysis reveals that the Management of Mountainous Districts Act and other related laws effect on EIA process, especially the case of area expansion of limestone mines excluded from EIA. However, these problems can create mismatch with the policy goal of EIA system and have a negative impact on the environment in the future. A series of indepth interviews with managers in related agencies found that those agencies have been unaware of the seriousness of the problem. Without any strategy, negative result made by development activities would get more serious and sustainable development may not be possible at all. In order to solve these problems, government should modify the current interdependent legal provision and create the incentive structure to participate actively related agency in the EIA system.
In orderto cope with the post-2020 in accordance with the Paris Agreement, greenhouse gas (GHG)reduction in Environmental Impact Assessment (EIA) and its contributions to post-2020 were discussed. The 26 Environmental Impact Statement (EIS) administered by Geum-River Basin Environmental Office from 2010 to 2019 were analyzed for reviewing GHG mitigation measures. From the case study, it was found that the assessment of GHG emissions reduction and climate change adaptation were not appropriately performed. In this study, the following measures are proposed to improve the inappropriate assessment of 'GHG subject matter' associated with EIA according to post-2020, 1) allotment of enforced charge on GHG emission during the EIA process, 2) addition of the 'GHG subject matter' in 'establishing permissible discharge standards' which is based on "Act on the Integrated Control of Pollutant-discharging Facilities", and 3) the participation of stakeholders in early EIA stage for governance. To improve the ecological function of urban areas, the guideline for applying the Biotope Area Ratio to the Environmental Impact Assessment (EIA) was developed in 2005 and modified in the July, 2017. This study investigates whether the guideline has been actually practiced in the real world by searching reports including 648 cases of the Strategic Environmental Impact Assessment (SEIA) and 471 cases of the EIA. The results show that the 38% of SEIA and the 43% of EIA include sections about Biotope Area Ratio, and the 15% of SEIA and the 25 % of EIA are satisfied the threshold of the Biotope Area Ratio suggested by the guideline. The statistical analysis results show that this low level of practice was not improved through the modification of the guideline in 2017. This is because the guideline is forcibleness, its explanation is unclear, and stockholders' understanding of it lacks. In addition, lack of tracking management on SEIA and EIA also contributes to the low level of practice of the guideline. To promote the practice, the efforts to legislate and publicize the guideline are required.
This study analyzes the problems of environmental laws, development planning laws, Metropolitan Area Development Planning (MADP), and the level of environmental pollution at Asan-bay metropolitan area, where MADP will be realized in the near future. In order to prevent environmental pollution by the implementation of MADP, the Environmental Impact Assessment (EIA) Act and EIA systems in Korea should be revised so as to reflect the followings. First, the impact of national landuse planning changes on the environment should be considered at the beginning of the EIA procedures. Second, the overlapping and greater impact of many projects upon surrounding metropolitan areas should be simultaneously evaluated, though each project is the subject of EIA, and the environmental pollution protection and abatement alternatives must be made in accordance with the above impact of the projects. Thirdly, total effluent regulation of water pollution, air pollution and solid wastes should be enforced based on the self-purification of the metropolitan area environment.
Before the EIA was established in the Federal Republic of Germany, the impact mitigation principle - a planning instrument, which has its legal foundation in the German nature conservation legislation already had {and still has} the function to valuate environmental impacts. The valuation principles and methods which have been developed in correlation to this instrument are now also used in the EIA. Particularly for the valuation of alternating effects on the different ecological landscape functions and for the valuation of ecological mitigation and compensation measures this valuation methods are used. Public participation in the Environmental Impact Assessment(EIA) has been implemented since the August 1 of 1991 with the Environmental Policy Act promulgation in the August 1 of 1991. It is structured to comment on draft Environmental Impact Statement(EIS) through open reviewing, public meeting and hearing. Though public participation has an important role in determining environmental significance, it is room for improvement. With positive public participation and system development such as Environmental Impact Assessment Act on June 11 of 1993, the effectiveness of it will be improved. This article is composed of status of public participation, comparison with other countries, comparison analysis by items of EIS prepared before and after public participation, and contents of public opinions in EIS.
The total pollution load management system of watershed has been implemented upon Special Law pertaining to the Han River Watershed Water Quality Improvement and Residents Support, Special Law pertaining to the Nakdong River Watershed Water Management and Residents Support, Special Law pertaining to the Youngsan River Watershed Water Management and Residents Support, and Special Law pertaining to the Seomjin River Watershed Water Management and Residents Support in Korea since 2002. But many other similar systems with total pollution load management system of watershed are being operated separately or independently, even though its purpose is nearly same with those of the total maximum pollutants load management in Law on Water Quality Environmental Protection, environmental impact assessment(EIA) in Law of Impact Assessment on Environment, Transportation and Disaster and Pre-environmental assessment of Environmental Policy Act. Therefore the contents of total pollution load management system of watershed and many other related systems could be overlapped and at some times have inconsistency among them. This study suggests first the integrated operation of total pollution load management system of watershed, EIA, pre-environmental assessment, urban planning, and sewage planning and secondly EIA system development by integration of EIA and pre-environmental assessment and strategic environmental assessment(SEA).

Environmental Impact Assessment(ElA) in Korea has been used to improve environmental conservation and decision-making since environmental impact statement(EIS) was introduced in 1981 with the promulgation of the Environmental Preservation Act in 1977. which replaoed the Pollution Control Act legislated in 1%3. Together with a rapid growth of environmental perception as well as the diversification of development activities, however, it has recently bring about a strong demand for a new assessment process related to the strategic level of policies, plan, programs. In order to overcome such a limit in ElA system, Prior Environmental Review System(PERS) was introduced for assessment of administrative plans mainly concerned with development projects in 1993. In 1999. the regulations for PERS have been established by an amendment of the Basic Environmental Policy Act.Therefore the foundation of EIA system to integrate environmental concerns in planning processes and project works has been refonned. However the results of the execution of PERS were somewhat insuffident due to the institutional and technical matters. As the world's attention turns to sustainability and the considerations of cumulative effects, the concept of strategic envirorunental assessment(SEA) has taken on more significance and urgency and increasing number of countries and international organizations now undertake some form of SEA. The term SEA, however, is variously defined and understood, generally it means a formal process of systematic analysis of the envirorunental effects of development policies, plans, programmes and other proposed strategic actions. This process extends the aims and principles of EIA upstream in the decision-making process, beyond the project level and when major alternatives are still open. In this paper, we are discussing the significance of SEA and its relevance to EIA and the international trends and institutionalization of SEA. In conclusion we are discussing the comprehensive developing plan for SEA in Korea, then proposing a plan to make institutional arrangements for its application.
In the Republic of Korea, the target project scope of the small-scale EIA is stipulated as the plan area above around 5,000~60,000m2 depending on a type of project and classification of land use. Whereas, the lower limit of the corresponding local government EIA project is generally located above the small-scale EIA's limits, and overlapping ranges exist. This situation has been enlarged since road construction and district unit planning were included as the target projects for small-scale EIA in the "Enforcement Decree of the Environmental Impact Assessment Act", which was partially revised in November 2016, and the current consultation system needed discussion in that small-scale EIA is allowed to be done without gathering review opinions at the local level. In fact, projects subjected to local government EIA but consulted as small-scale EIAs may seem insignificant because of a small number of total cases; however, it is worth paying attention to the fact that a local government may not add a target project due to the small-scale EIA. This study suggested the three policy measures for improving small-scale EIA to enhance the effectiveness of local government EIA: supplementing the institutional arrangements to incorporate the review opinion from the local region in small-scale EIA, giving priority to local EIA for conducing the projects in overlapping ranges with partial amendments on EIA law regarding exceptions to local government EIA, including small target projects (not to be small-scale EIA targets) to the ordinance that are deemed necessary to be conducted as local government EIA. Even though a positive function of small-scale EIA has been confirmed, efforts should be made to improve the situation in which many projects within local governments are consulted without review from the region.
