  • The United States of America is one of the most favoring countries in which mandatory pre-arbitration clauses in the form of adhesion contract have been widely recognized and supported by courts and the Federal Arbitration Act. However, after the financial crisis in 2008 and the National Arbitration Forum scandal in 2009, in enacting the Dodd-Frank Wall Street Reform and Consumer Protection Act ('Dodd-Frank Act'), Section 1028(a) of the Act requires the newly created Consumer Financial Protection Bureau (CFPB) to provide Congress with a report on "the use of agreements providing for arbitration of any future dispute between covered persons and consumers". Section 1028(b) also grants the CFPB the authority to "prohibit or impose conditions or limitations on the use of an agreement between a covered person and a consumer for a consumer financial product or service providing for arbitration of any future dispute between the parties, if the Bureau finds that such a prohibition or imposition of conditions or limitations is in the public interest and for the protection of consumers." Pursuant to the Dodd-Frank Act, the CFPB issued a report entitled "2015 Arbitration Study: Report to Congress 2015 (Report)" in March 2015. This paper examines some major legal issues of the Report and makes a few recommendations for Korean financial institutions which entered into the U.S. financial market or has a plan to do so in the near future.

Studies on the Biological Attributes of Scelionid Egg Parasitoid Psix striaticeps (Dodd) for the Control of Stink Bug Canthecona furcellata (Wolff) in Sericulture

  • Scelionid eggParasitoids Play an important role in biological control of some economically important pentatomids. Stink bug (Canthecona furcellatta Wolff,) is an important predator of Tasar silkworm larvae (Antheraea mylitta D.) and causes 30-40 percent loss in tasar silk industry. Psix striaticeps (Scelionid: Hymenoptera) has been found to be an important egg parasitoid. The parasitization potential of f striaticeps is mere than 60 percent and the sex ratio is female oriented. Studies indicate that the maintenance of existing scelionid population by avoiding harmful practices and the augmentation of scelionids either directly releasing them in the field or by indirectly making the field environment more favorable for them is an important aspect to control the pentatomid population in sericulture. Female bias sex ratio is advantageous to increase the parasitoid population in the field. 24-hour-old egg of stink bug and one-day old parasitoid is suitable for producing maximum progeny. 1 : 30 of parasitoid: host ratio is needed to regulate the estimated population in silkworm rearing field.

Novel homogeneous burnable poisons in pressurized water reactor ceramic fuel

  • Due to excess reactivity, fresh nuclear fuel often contains burnable poisons. This research looks at six different burnable poisons and their impacts on reactivity, material attractiveness, and waste management. An MCNP simulation of a PWR fuel pin was performed with a fuel burnup of 60 GWd/MTHM to determine when each burnable poison fuel type would decrease below a k of 1. For determining the plutonium material attractiveness in each burnable poison fuel type, the plutonium isotopic content of the used fuel was evaluated using Bathke's Figure of Merit formula. For the waste management analysis, the thermal output of each burnable poison fuel type was determined through ORIGEN decay simulations at 100 and 300 years after being discharged from the core. The performance of all six burnable poisons varied over the three criteria considered and no single burnable poison performed best in all three considerations.

  • For more accurate height/depth control of the agricultural implements , the soil surface as a reference position should be measured as accurate as possible. A new measurement system using microwave was developed to detect the true soil surface even under plant and/or vegetation. Two-frequency continuous-wave radar was used as the measurement system. It could estimate the distance to the target by measuring the phase difference between two different frequencies continuous-waves which reflected on the target surface. The system performance was evaluated on the barely field where the average height of barley was 91.5 cm. The experimental results showed that the system performance was not affected by the existence of barely. The maximum measurement errors were 8.91 com and 8.44cm for two different experimental plots.

  • 분쟁광물이란 특히, 콩고민주공화국(DRC)의 동부지역과 같이 분쟁지역에서 채굴되는 광물에 대하여 부르는 용어이다. 보통 분쟁광물이란 주석, 콜탄(컬럼바이트-탄탈라이트), 중석, 금과 같은 광물로 주로 콩고민주공화국(DRC)의 동부지역에서 채굴되고 있는 광물로서, 이러한 분쟁광물은 여러 가지 전자기기의 제조에 사용되고 있다. 콩고민주공화국(DRC)과 이웃 나라에서 분쟁을 종식시키기 위해 자금원이 되어왔던 분쟁광물의 개발이나 교역의 근원을 차단시키고 분쟁국에 있어서 무장그룹에 의한 분쟁을 억제시킬 필요가 있다. 미국 증권거래위원회(Securities and Exchange Commission, SEC)는 2012년 8월 22일 금융규제개혁법 제 1502조에 근거하는 규칙을 채택하였는데, 이 법에 따라 미국 기업들은 증권거래위원회에 분쟁광물을 이용하여 제품을 생산할 경우 분쟁광물의 원산지에 대한 보고를 하여야 한다. 이 법은 분쟁 광물의 원산지를 추적하여 특히, 분쟁 광물의 자금원이 되고 있는 콩고 민주공화국을 필두로 분쟁국에 있어서의 무장세력의 직 간접 자금원을 끊어 분쟁을 억제하는 것을 그 목적으로 하고 있다.

항암화학요법환자의 오심.구토 및 자가간호 실태 (Nausea/Vomiting and Self-care in Patients with Cancer on Chemotherapy)

  • Purpose: The purpose of this study was to investigate the incidence and self care practice for nausea/vomiting in patients with cancer during chemotherapy. Method: The participants were 100 patients with cancer over 20 years of age who visited the outpatient department or were hospitalized for chemotherapy Self care in the case of nausea and vomiting was measured by the Dodd's scale. Data were analyzed using the SAS program and the following statistics were used frequency, percentage, unpaired t test, and Pearson correlation coefficient. Results: The ratio of the occurrence of nausea/ vomiting in the participants was 70.0%. The incidence of nausea/ vomiting was significantly higher for women than for men. The incidence of nausea/ vomiting was also higher for patients with cancer not in the gastro-intestinal system (GIS) compared to that for patients with GIS cancer. The incidence of nausea/ vomiting positively correlated with anorexia, skin injury, and fatigue. Conclusion: The ratio of occurrence of nausea/ vomiting for the participants was 70.0%. The incidence of nausea/ vomiting was higher fur women and patients with cancer not in the GIS. The incidence of nausea/ vomiting positively correlated with anorexia, skin injury, and fatigue. The results indicate that nausea/vomiting is a frequent symptom, particularly in women and there is a need to provide interventions to decrease the effects of this symptom.

  • Stink bug, Canthecona furcellatta (Hemiptera: Pentatomidae), is an important predator of silkworm larvae. Nymphs and adult attack the early stage silkworm larvae and causes about 10-15 per cent loss to silk industry. Synthetic organic pesticides has tremendous impact on minimizing the pest population but repeated and frequent use has created problems of residual toxicity, development of resistance to insecticides, pest resurgence and out break, phyto-toxicity and hazards to non target species and beneficial organism. Silkworms are very sensitive to pesticides; therefore, attempt has made to control the bug population through introduction of its native natural enemies in the silkworm-rearing field. Biological control has tremendous scope in sericulture because it is eco-friendly in nature and non-harmful farmers. Native natural enemies have been screened. Psix striaticeps, Trissolcus spp. and Telenomus spp. have been recorded as the most potential parasitoid against pentatomid bug. Life cycle, sex ratio and other various attributes of the par-asitoids have been recorded. The parasitization potential of the parasitoid is very high and they have the ability to discriminate between parasitized and unpar-asitized host. Mass propopagation technique under laboratory condition has been standaydized.

진리담지자와 사실 사이의 동일성에 대하여 (On Identity Between Truth Bearer and Fact)

  • 진리 동일론자들은 진리담지자와 사실 사이의 동일성을 주장한다. 우선, 본고는 그들의 주장을 어떻게 이해해야 적절할지를 검토한다. 필자는 진리 동일론자들이 주장하는 동일성 관계를 사소한 관계와 사소하지 않은 관계로 분류한 다음, 사소한 동일성 관계로 이해한 동일론 논제가 왜 진리 동일론자들의 주장이 될 수 없는지를 논변할 것이다. 이어서, 사소하지 않은 동일성에 따른 견해를 줄리언 도드의 분류를 따라 다시 강경한 동일론과 온건한 동일론으로 구분한 후, 전자의 동일론이 그 자체로 비일관적인 견해가 됨을 보일 것이다. 그리고 동일론자들에게 남겨진 대안인 온건한 동일론을 진리 축소주의와 비교해야 하는 이유를 해명하고, 그 비교로부터 온건한 동일론자들 앞에 놓인 두 가지 선택지를 귀결로서 이끌어 낼 것이다. 동일론자들이 그 중 한 쪽을 택하면 축소주의보다 온건한 동일론을 더 선호해야 할 정당성은 얻어지지 않는 반면에, 다른 한 쪽의 선택지를 택하는 경우에는 그들에게 어떤 새로운 문제가 해결 과제로 남겨지는지를 서술할 것이다. 끝으로 결론에서는 이 남겨진 과제가 지닌 한계와 전망을 평가할 것이다.
