In the legislation interpretation and fundamental viewpoint about the legal system of insider trading, Japan strictly legislate under the proposition, the principle of 'nulla poena,' adopted 'the principle of limited enumeration,' and United states, under 'the principle of comprehension,' has entrusted courts with establishment of concrete concepts and standard, so the courts are very flexible in determining the range of insiders and the importance of inside information to show a strong will to eradicate insider trading. Korea has a legislative position of 'the principle of limited indication' which has been created by the negotiation between those principles of United states and Japan. Though this court has interpreted insider trading, insider trading using non-disclosed information has increased lately, needing the strengthening of its regulations. However, this shows us that sophisticate the regulations may be, the exposure of insider trading has limitations. The most important thing is to change recognition for transparency of the securities market, security of investors and to establish the atmosphere which is that fair stock trading made in a sound capital market to raise funds for corporation. The policies of improving unfair trading, self-regulation bodies, raising the transparency and legality of procedures of supervision and monitoring and applying 'compliance program' to stock companies are very needed to eliminate unfair trading in the securities market and establish the order of trading.
The purpose of this study is to screen for the effects of climate change and climate change adaptation in the insurance industry. There is now a consensus that the climate is changing, with potential risk to the global economy and human health and so on. On the other hand, unknown is the extent to which insurance business pattern have already been affected. But the increase in damage due to climate change is likely to raise insurance company losses. In this regard, I conduct especially an effects of the insurance industry on climate change. And than, I analyzed what insurance companies would do to lessen the impact of climate change. As a result, the impact of climate change on the insurance industry is a huge increases in claims due to disasters and diseases arising from climate change. And another thing is growth in climate change-related legislation, regulations and reporting requirements such as financial soundness regulation and climate change risk disclosure. Therefore, the insurance industry needs to build a climate change adaptation strategies include capital raising, liquidity of assets, faithful debt management and so forth.

The study aims to examine the interaction of formal and informal institutions for strengthening economic development, particularly entrepreneurship growth. The research will also assess the impact of control variables on political index within the formal and informal markets. The research is quantitative, which analyses panel data of 6 years in 22 countries comprising middle and high-income countries with diversified and unique political, economic, and social systems. The findings suggested that reducing the entry regulation and promoting the social capital within the formal and informal institutions would grow formal and informal entrepreneurship and be a greater source for new venture creation. Moreover, the political index, a control variable, was found significant in the relationship of institutional mix with formal and informal entrepreneurship. Entry regulations in formal and informal institutions are a complex phenomenon in the entrepreneurship literature, moderated by the political development index as tested by the current study. The time horizon for this paper is much longer since it analyzes 6 years (2014-2019) of data on 22 developing and developed countries to see the entrepreneurial growth across multiple regions on different income levels, geographic conditions, and contrasting political and social systems.
This research analyzes and evaluates The Korean Security Industry Law(TKSIL) putting the regulation of the present government about the private security industry. It nowadays becomes the important axis of the police services offered in the aspect of 'the national life safety' in connection with 'the materialization of society which is safe from the crime'. TKSIL is one of the national administration strategies which Park Gun-hye government aims on supervision policy. After seeking out the core values of the private security industrial policy which sets up in order to approach the national life safety which Park Gun-hye government aims, we make some assessments of this revised security industry law systematically. Particularly all keynote of policy about the private security of the police tried to be confirmed and the desirable direction of policy tries to be presented as to the security industry law application and real operation. In the site of organized civil complaint, the revised security industry law was revised as the direction which intensifies the administrative regulation as to the partial regulation such as it established the reason of the introduction of the arrangement license system. And grounds for disqualification of security instructor and guard, and rules of punishment is intensified order to intercept previously illegal and violent act of the security company etc. However it has the feature that it accomplishes 'the law principle(principle of statute)' the substantial portion through the effort of them changing a lot the content for the form of the law when being the clauses of the fundamental human rights limit, although it has been prescribed in "the security industry law enforcement ordinance" or "the security industry law enforced regulation". The security industry law revised this time brought from the change of the sharp policy through the revision of 17 clauses or new establishment. It can divide into 4 categorizes. We conduct a comprehensive risk analysis of household debt in Korea for the first time using the whole sample credit bureau (CB) data of 2.2 million individual debtors. After analysing debt service capacity profiles of debtor groups classified by the borrower characteristics such as income, age, occupation, credit scoring, and the type of creditor business companies, we investigate the impact of interest rate and income changes on debt service-to-income ratios (DTIs) and default rates of respective debtor groups. Empirical results indicate that debt service burdens are relatively high for low income wage earners, high income self-employed, low income capital and card loan holders, and high income mutual savings loan holders. We also find that debtors from multiple financial companies are particularly weak in their debt service capacity. The scenario analysis indicates that financial companies, with the current level of capital buffers, may be able to absorb negative consequences arising from the increase in DTIs and loan default rates if the interest rate and income changes remain modest. However, the negative consequences may fall disproportionately on non-bank financial companies such as capital, credit card, and mutual savings banks, whose debtors' DTIs are already high. We also find that the refinancing risk of household debt is relatively high in Korea as more than half of household mortgage debts are bullet loans. As the DTIs of mortgage loan holders are already high, under the current DTI regulation, mortgage loans may not be readily refinanced especially when the interest rate rises. Disruptions in mortgage loan refinancing may put downward pressure on housing prices, which may in turn magnify refinancing risk under the current loan-to-value (LTV) regulation. Overall our analysis suggests that, for more effective monitoring of household debt risk, it is necessary to combine existing surveillance schemes based on macro aggregate indicators with more comprehensive and detailed risk analyses based on micro individual data.

Recently, regulations on toxic compounds in aquatic environment have been strengthened in korea due to the increasing public awareness of the water quality. Typically, these regulations include introduction of emerging toxic compounds and stricter effluent limitations for the already regulated compounds. However, too strict regulations may cause excessive burden on the industry. Therefore it is also important to assess the economic impacts when the new effluent limitation guidelines are introduced. The estimation of the additional cost for the wastewater dischargers to meet the new guidelines are based on the selected treatment technology to handle the hazardous substances and the regulatory levels for effluent limitations. To explore the procedures for cost estimation in enforcing new effluent limitations, a case study was performed specially for 1,4-dichlorobenzene. The pollutants of concern are surveyed for different industrial categories and various treatment technologies. For a given pollutant, the general performances of the treatment technologies are surveyed and a representative technology is selected. For a given technology, the capital cost and annual Operation and Maintenance (O&M) cost was calculated. The calculation of baseline costs to operate ordinary treatment technologies is also important. The ratio between the cost for introducing new treatment process and the baseline cost required for conventional technology was used to evaluate the economic impact on the industry. For 1,4-dichlorobenzene, steam stripping and activated carbon processes were selected as the specific treatment technologies. The cost effects to the regulation of the compound were found to be 6.4% and 14.5% increase in capital cost and O&M cost, respectively, at the flow rate over $2,000m^3/d$ for the categories of synthetic resin and other plastics manufacturing industry. For the case of petrochemical basic compounds manufacturing industry, the cost increases were 5.8% and 12.4%, respectively. It was suggested that cost effect analysis to evaluate the economic impacts of new effluent limitations on the industry is crucial to establish more balanced and reasonable effluent limitations to manage the industrial wastewater containing emerging toxic compounds in the wastewater.

After global economic crisis, China has become one of the two pillars in the global economies and the country contributing to the Korean economy. Nevertheless, the research on Chinese financial market, particularly capital market, is rare to date. This study examined the growth enterprise market that emergedat the Shenzhen stock exchange and made comparative analysis on before and after listing for the Chinese small and medium sized firms and venture firms. The listing requirements at the Chinese growth enterprise market for the technologically innovative venture firms and fast-growing small and medium sized firms with financing purpose were more alleviated than the main board of Shenzhen stock exchange. Moreover, the listing procedures are simplified as well. Accordingly, many Chinese enterprises tend to list and the competition for listing is also intense. In particular, with the 36 initially listed firms at growth enterprise market as the research target, the investigation for the business performance before and after listing reveals that the three indexes including return on common equity, debt ratio and operating profit growth rate dropped dramatically for most all the firms. That is, the profitability and growth for the venture firms and small and medium sized firms listed on the Chinese growth enterprise market decreased rapidly after going public, only the stability improved due to the great financing. Taking a step forward, this phenomenon may result from the exaggerated reporting for the business performance before listing with the purpose of going public by the venture firms and small and medium sized firms. Thus, Chinese Securities Regulatory Commission should strengthen the accounting evaluation standard and regulation for the listing firms before going public. In addition, strict sanctions should be imposed on the firms with fraudulent accounting to establish healthy capital market.
In this research I investigate different firm characteristics between environment-friendly companies which are awarded by the Government and companies which violate environmental regulations. I set up three hypotheses in terms of managers' environmental attitude and firms' characteristic in technical, financial and structural aspects, considering environmental experts' opinions and findings of previous papers. Main research findings are as follows. First, both acquisition of the ISO 14001 certificate and ownership structure are used as proxy of top management attitude towards environmental decision-making. It is hypothesized that it is found that the certificates of ISO 14001 is a good proxy to represent top management environmental attitude and a firm with the certificate would have less likelihood of violation. Second, it is hypothesized that technical ability affects violation tendency of environmental regulations. It is found that as R&D investment increases, violation likelihood of environmetal regulations decrease. It can be conjectured that R&D investment may improve technical abilities of observing environment regulations. Third, it is investigated whether a firm's financial capability affects violation tendency of environmental regulations. Fourth structural aspects of a firm such as capital intensity, the number of employees and export ratio are investigated. It is found that a firm with more employees per sale amount tends to violate environmental regulations. It is not found any effects of expert ratio nor capital intensity on violation tendency of environmental regulation.

The government announced a plan for fund support to the enterprises with high possibility of recovery and early restructuring for the enterprises with low recovery by objectifying credit assessment system. Such announcement of government could be extended to restructuring risk of middle standing enterprises with low financial soundness by establishing the basis to prepare prompt restructuring by reinforcing the basis for restructuring through capital market. This research analyzed financial soundness based on the financial evaluation of bank by selecting 10 middle standing construction companies which focused on housing business in 2019, based on such analysis result, it was confirmed that there was a high possibility of restructuring risk. This research determined that there would be a decrease in growth rate of construction industry on the whole in 2020 due to fall of economic growth rate and reinforced real estate regulation, accordingly, there's a big possibility for middle standing construction companies with paid-in capital ratio due to its low possibility of maintenance of stable credit rating. This research established KCSI assessment model by utilizing the material of a reliable research institute in order for middle standing construction companies to evade restructuring risk, and indicated risk ratio differentiated per each item through a working-level expert survey. Such research result could suggest credit risk reduction method to middle standing construction company management staffs, and prepare a basis to evade restructuring risk.
