Dispute Mediation Cases and Suggestions for Calculating Compensation for Dust Damage (먼지 피해의 환경분쟁조정 사례 분석과 배상액 산정안 제언)

  • In this study, we analyzed 82 dust damage dispute mediation cases over the past 5 years and evaluated cases where the probability of damage was verified through dust concentration measurement, modeling prediction, and chemical composition analysis. The cause of dust damage was a construction site, which accounted for most of the damage (97%), and was closely related to the distance from the construction site, total floor area of the construction site, and construction duration. Compensation was decided in only 33% of dust damage cases, and in only 6% (five cases) were damages determined using scientific techniques such as dust measurement, and forecasting. The main criteria for determining compensation were whether administrative measures were taken and evidence of damage in the form of videos and photos. In the future, measuring or model for the amount of dust damage is necessary to determine whether the limit has been exceeded and to revise the standard for calculating compensation through various lines of evidence of dust damage.

A Study on Calculation Method of Compensation for Indirect Damage of Fishery by Undertaking Public Project (공익사업시행(公益事業施行)으로 인한 어업(漁業)의 간접피해(間接被害) 보상액(補償額) 산출방법(算出方法)에 관(關)한 연구(硏究))

  • Under the provision of Article 63 of the Enforcement Regulation of the Act on Acquisition and Compensation of Land and Others for Public Project that is recently enacted and implemented (hereinafter referred to as the 'Lend Compensation Act') the compensation is required to make 'When the Actual Damage Amount' is confirmed for the damage in fishery affairs that is outside of the public project area. The compensation for fishery business on the indirect damage area has been excluded from the advance compensation subject to conflict with the existing laws on fishery business compensation with the controversy in method, procedure, time and others to confirm the actual damage amount, and it lacks the standard of calculation for detailed compensation on partial damages outside of business implementation area, which caused the ceaseless conflicts and straggles between the project implementation party and the victimized fishermen regarding the calculation method of damages, standard, compensation period and others. In particular, from the numerous problems in damage compensation in fishery on the indirect damage area, the most recent problem emerged is the issue on application method of damage period in calculating the damage compensation amount that the struggle has been deepened with the differences between the project implementation party and the victimized fishermen without the stipulation on the compensation, that caused the difficulties in carrying out the public project and other serious social problems. In this study, the reasonable application method for the damage period and the calculation plan of the damage amount for calculating the damages on fishery industry outside of the public project implementation zone that is not fully specified under the Land Compensation Act, and the indirect damage area is not influenced for the notification of project recognition, and the compensation to undertake with the damage in the fishery industry in project implementation area to have the nature of damage compensation, the right to engage in fishery industry has the perpetual nature of rights, the fishery damage compensation system of Japan also recognizes the perpetual right on fishery industry to calculate the compensation amount, and the compensation for damage amount has been exercised for the period of actual damage occurrence period regardless of remaining effective period for most of fishery permit and license for fishery compensation outside of the project implementation area following the recent various public projects as well as the development process of theory on fishery loss compensation that the calculation of damage amount on the fishery industry outside of the project implementation zone would be prudent to compensate by calculating the applicable damages during the period of actual damages, and by doing so, the 'just compensation' guaranteed under the Constitution may be materialized. Therefore, the calculation of the damages from the implementation of the public project shall consider the actual period of damages and the degree of damage from the public project to calculate by the income capitalization method, however, considering the equitable consideration with the compensation following the cancellation, it shall not exceed the compensation following the termination of the applicable fishery businesses. Furthermore, the calculation method of partial damage amount on the fishery business following the project implementation shall apply, depending on the period of damage occurrence, by (1) the case of calculating the future damage amount at the present time, and (2) calculating the damage from the past to the present time as well as the damage to be incurred later, by selecting the calculation method for damages following the damage occurrence type.

Damage detection in jacket type offshore platforms using modal strain energy

  • Structural damage detection, damage localization and severity estimation of jacket platforms, based on calculating modal strain energy is presented in this paper. In the structure, damage often causes a loss of stiffness in some elements, so modal parameters; mode shapes and natural frequencies, in the damaged structure are different from the undamaged state. Geometrical location of damage is detected by computing modal strain energy change ratio (MSECR) for each structural element, which elements with higher MSECR are suspected to be damaged. For each suspected damaged element, by computing cross-modal strain energy (CMSE), damage severity as the stiffness reduction factor -that represented the ratios between the element stiffness changes to the undamaged element stiffness- is estimated. Numerical studies are demonstrated for a three dimensional, single bay, four stories frame of the existing jacket platform, based on the synthetic data that generated from finite element model. It is observed that this method can be used for damage detection of this kind of structures.

  • This study is for calculating the equation of the inner temperature in the concrete, mainly by the theory or heat conduction in the solid. The results are as follow ; 1. The equation of the Fourier's heat diffusion is used formally to get the distribution of inner temperature or the concrete members, and this is programed by using the computer. 2. As study in the past, heat constant of concrete is calculated for function of temperature described recommendation heat constant value in comparison with the existing inner heating experimental result.

  • Studies on the calculation of accident costs include the approach on calculating damage costs covering all accidents regardless of first or secondary party and the one calculating damage costs generated by a single victim. These two approaches have a limitation of considering a subject for costs analysis as a single entity. In addition, research on estimating the interaction effects caused in the relationship between diverse traffic accident features and factors remains inadequate since most studies focused on calculating costs incurred in a single entity such as a victim, damaged building, or social organization in charge of managing car accident. This study intends to identify the expected range of old age where a specific interaction effect would remain, compare accidents between old age section and the entire age section, and discover an exogenous variable to be applied in accident drop effects in senior people and reduced benefits by calculating and testing additional accident costs in case the first party and the second party all pertain to the senior age section. By classifying the entire accidents caused by old drivers according to the types of cars, significant coefficients representing the influence that affects car accidents according to the characteristics are calculated and set them as the representative variables by selecting top variable in accordance with from low to high order. Furthermore, characteristics on five age groups such as a group of over 65 and less than 70, a group of over 70 and less than 75, a group of over 75 and less than 80, a group of over 80 and less than 85, and a group of over 85 are elicited and compared them with these preselected accident characteristics variables, thereby identifying what changing effects come out.

Calculating Expected Damage of Breakwater Using Artificial Neural Network for Wave Height Calculation (파고계산 인공신경망을 이용한 방파제 기대피해도 산정)

  • An approach to calculating expected damage of breakwater assisted by artificial neural network was developed. Wave height in front of a breakwater was predicted by a trained artificial neural network with inputs of wave height in deep ocean and tidal level. Prediction results by the neural network can be comparable to that by professional numerical model for wave transformation. Using the wave prediction neural network, it was very easy and fast to obtain a number of significant waves at breakwater and finally analysis time for expected damage can be shortened. In addition, the effect of considering tidal level in the calculation of expected damage was revealed by comparing the expected damages with and without tidal variation. Therefore, it was pointed out that tidal variation should be considered to improve prediction accuracy.

  • Recently, people's desire for the waterfront space has been increasing, and more people want to spend their leisure time close to the water. This paper proposes a damage detection technique using the static strain for the floating structure. An existing damage index, in which the modal strain energy was utilized to identify possible location of damage, is expanded to apply the static strain. The new damage index is expressed in terms of the static strains of undamaged and damaged structures. After calculating damage index, the possible damage locations in the structure are determined by the pattern recognition technique. The accuracy and feasibility of the proposed method is demonstrated by using experimental strain data from a scale model of floating structure.

A Study on the Realization of Dust Damage Compensation Calculation for the Prevention of Dust Damage in Construction Site (공사장 먼지피해 예방을 위한 먼지피해 배상액 산정 현실화 방안 연구)

  • Purpose: Even if a damage is applied to the dust of the construction site containing the first-class carcinogen, it is dismissed or 5~30% of the amount of noise damage compensation is paid., Because of such loopholes, some construction companies are neglecting the dust management of the construction site, and the damage of the workers and the residents in the construction site continues. Method: The purpose of this study is to examine the problems of the calculation criteria of damage compensation amount of construction site dust, the measurement of dust concentration, the analysis of measurement data (the data of electric signboard measuring device by the mining scattering method), the prediction and evaluation methods such as modeling, and to suggest improvement measures. Result: It is found that it is impossible to calculate the amount of damages from dust damage in the construction site by calculating the current dust damage compensation amount and dust concentration modeling and measurement. Conclusion: It will receive an application for compensation for damage within the site where damage is expected (about 100m in the straight line and the boundary line of the site), and present a method of calculating the amount of compensation that differentially evaluates dust damage to the degree of dust management and compliance with dust-related legal standards.

  • The vibration fatigue is suitable case of fatigue problem that system is exposed to the random or other irregular sources. Even some kinds of effort using power spectral density (PSD) and statistical concept was presented to cope with the intangible force signal, it is still lack of providing a reasonable solution when its exciting frequency is near or beyond of first eigenvalue. In this paper, energy approach method is presented to calculate a vibration induced fatigue damage in frequency domain. Since the corresponding damage become much larger than nominal case when the vibration is coupled with a mode shape of given structure, the new technique compensate the characteristics of structure with a measured frequency response function (FRF) between forcing acceleration and responding stress.

Application of Arbitrary Lagrangian-Eulerian Technique for Air Explosion Structural Analysis for Naval Ships Using LS-DYNA

  • Survivability improvement method for naval ship design has been continually developed. In order to design naval ships considering survivability, it is demanded that designers should establish reasonable damage conditions by air explosion. Explosion may induce local damage as well as global collapse to the ship. Therefore possible damage conditions should be realistically estimated in the design stage. In this study the authors used ALE technique, one of the structure-fluid interaction techniques, to simulate air explosion and investigated survival capability of damaged naval ships. Lagrangian-Eulerian coupling algorithm, equation of the state for explosive and air, and simple calculation method for explosive loading were also reviewed. It is shown that air explosion analysis using ALE technique can evaluate structural damage after being attacked. This procedure can be applied to the real structural design quantitatively by calculating surviving time and probability.
