All kinds of commerces are begun from the contract and the claims are frequently raised by the problem in the contracts. Therefore, the negotiation is very important to make a contract and resolve the claim. This article compared and analyzed the negotiation practice of Korean, American and Islam to strengthen the negotiation power of the Korean domestic companies and suggested the some guidelines when the Korean companies negotiate with the foreign companies. For the negotiator to make a effective negotiation with the foreigners and a make the negotiation performance, The negotiator has to prepare for the negotiation practice and strategy of the foreign countries. Secondly, the negotiator has to be accustomed to the foreign country and make the win-win strategy by giving the benefit to the foreign company as well as him. Especially, in the negotiation with American, it is very necessary that the negotiator persuade him logically by preparing the objective data and include the lawyer into the negotiation team. In the negotiation with Islam, making the personal relationship and, if possible, frequent contact with the person who has the responsibility in the contract is very important.
We are in an era of global business called one world market. These environments require Korean firms to face an unlimited competition and to resolve their dispute by ADR. Few study, however, on the ways of dispute settlement under the changed international business environment has been done. Thus the major purposes of this study are to investigate Busan's trading companies' preference on the dispute resolution ways. Based on the results of my study, I suggest Busan's trading companies the following guidelines. First, Busan's trading companies should improve their negotiating power by using internet trade and problem solving ability through the establishment of claim information system. Second, They should write contract. Lastly, they should investigate their counterparty's credit.
The medical expenses review system in Korea has developed under fee-for-service system with its own unique structure. The importance of reviewing medical expenses has been emphasized, as the size of medical expenditures moving through the health insurance legal context and its weight in the national economy have increased very rapidly. It is, however, analyzed that the feuds and arguments continue among the stakeholders for the lack of laws supporting the medical expenses review system. The medical expenses review is a series of administrative procedures, deciding whether claims from medical care institutions to the insurer are legal and valid or not. It mainly controls the increase of unnecessarily excessive health insurance claim and prevents fraudulent claim and abuse and checks the less use or unsuitable use of medical resources. It also works a function guarantees medical benefits for the appropriate treatment according to the object of health insurance system as a social insurance scheme. The dispute on legal base of the medical expenses review is about the source of law in the medical expenses review. There are the Health Insurance Act and administrative laws as jus scriptum and the guidelines of review as administrative orders. The medical expenses review should reflect various factors, such as the development of medical healthcare technologies, the health expenditures distribution, the financial situation of the health insurance, and the evaluation on the level of appropriate benefits. It is also likely to adapt to the traits of characters of medicine, and trends and transition, Besides it should judge the legality and the validity of medical benefits expenditures by synthesizing these all factors. And the evaluation system of appropriateness of medical benefits was administrative procedure which was consecutive with reviewing the medical expenses system and it was intended to make up for the result of reviewing the medical expenses in more comprehensive levels.

This article analyzed the negotiation practice of Chinese in order to render help to negotiators who enter into negotiations with Chinese business people so that they can enhance their chance for success. Based on this examination on the negotiating style, this paper also provides the some guidelines in working-level negotiating with Chinese. For the purpose this study applies "global negotiation flowchart" and twelve important factors suggested by stephen & stripp to analyze the characteristics of Chinese business negotiating style. The results suggest some useful criteria for negotiators First, In the preparation, the negotiator need a thorough study about the Chinese negotiating style and counter party. Second, In the negotiation with the Chinese, making the personal relationship and, if possible, frequent contact with the person who is the most powerful negotiator in decision-making. Third, since the Chinese has a sense of value that money is very important, it is very necessary that the negotiator persuade him by mutual profits. Finally, negotiators must aim at long-term profit maximization not at short-term.
This study developed learning content and web pages providing information on Health/Functional Food (HFF) for consumers who come across information indiscriminately from a variety of advertising media such as the Internet and TV. After coming to an understanding of the current situation through literature review and fact-finding, we collected information and commercials on HFF that are exposed to consumers. Focusing on advanced countries such as the U.S. and Japan, we examined the current status of consumer education programs, especially in terms of HFF industry. Further, we referred to the guidelines for consumer education provided by the U.S. Food and Drug Administration and monitored the information from a web site that sells dietary supplementary products in the U.S. In addition, we surveyed consumer information on foods for special health use provided by the Japanese National Institute of Health & Nutrition, and investigated a DB of raw materials of function food (functionality/safety documents). Upon a literature review, the 13 functions of HFF were classified. As a result of conducting interviews with consumers, we developed content that was fit for consumers' perspectives. Through this research, we established a web page to enable people to search for information by function and then by raw material. After searching for information by raw materials, searching products by raw materials can be done in cooperation with E-marketplace. Subsequently developed content and education programs were offered on an HFF web page, which has been in operation since 2005. Therefore, it is expected that appropriate information on HFF will be available.
This study is a development of quality scale and a measurement of quality levels for the Hospital Information System(HIS) used in the hospital industry. This study is to provide decision-making guidelines for hospital managers, system analysts, and software designers, and to provide feedback for the users' information needs. The target people of the study were medical doctors, nurses, pharmacists, and clerical staff. The service contexts of usability were diagnosis/treatment, nursing, medicine preparation, and treatment fee receipt/claim. The quality factors were the efficiency, effectiveness, and satisfaction of IS09241-11. This study shows that the current domestic HISs are mostly based on patient diagnosis/treatment and treatment fee accounting, and that other quality scales are necessary according to different job categories, specializations, positions, and service domains. Especially, the low quality of HIS was found in the abnormal service processing, information sharing by outside institutions, and standardization. It may be added that the HIS should be improved and developed in these respects.
Recently, skin diagnosis has been suggested as a promising tool for discrimination of Sasang Constitution, reported by examining the skin characteristics such as thickness, stiffness, slip, and skin textures like wrinkles and furrows. However, the works had a limitation in that clinical decision on the skin characteristics was made by relying upon oriental medicine doctors' subjective sense of touch. In order to objectify the skin diagnosis and claim its efficacy on the discrimination of the Sasang Constitutions, it is necessary to demonstrate its discrimination capability by providing numerical values in terms of physical quantities obtained from measurements using today's sensors and equipment technologies, which motivated this work as a priliminary step towards objectification of skin diagnosis. The skin characteristics focused in this work is the slip property of the back-hand skin that has been exploited using the dynamic friction measurement system. First, curved geometric effects of the back-hand skin on the measured lateral/vertical force signals were estimated using the artificially designed silicon coated structures, which led to a suggestion on a quality controlled experimental design based upon a empirical analysis model. Second, the experimental design thus suggested has been applied to the measurement of dynamic friction coefficients for two healthy male subjects of Taeumin (TE) and Soyangin (SY), respectively. The result shows that the dynamic friction coefficient is less for the SY subject than for the TE subject around the area of the skin used for diagnosis by the oriental medicine doctor, implying the TE subject's skin is more slippery than the SE subject's that is consistent with the oriental medicine doctor's diagnosis. Hopefully, this work can provide guidelines for obtaining quality data in friction measurement to be collected for discussion on the efficacy of the skin diagnosis and its objectification through statistical analysis.

Purpose : Selective functional movement assessment(SFMA) is a movement-based assessment tool designed for clinicians to diagnose and treat pain and functional physical problems. This concept is used for assistance in occupations related to movement, including clinical medical personnel, such as physical therapists, physical education instructors, and athlete coaches. Although this concept is widely used by clinicians, research and scientific proofs are relatively insufficient. This study aimed to review the literature on the understanding, reliability and effectiveness of SFMA, and to consider its role in the future of rehabilitation. Methods : In this review, a total of nine articles were selected according to the eligibility criteria of three major thesis topics. The main topics covered in the literature are reliability and effectiveness of clinical use of SFMA. To gather research articles, we searched official term 'Selective Functional Movement Assessment'. Among the searched 60 studies, nine were mentioned in this study that contained overlapping information and matched our desired topic. We reviewed four reliability analyses, four case reports, and one experimental study. Results : Reliability has an intermediate degree between high raters and within raters. The validity of the SFMA system is influenced by a combination of experience and logic; hence, further improvement is needed. Therefore, if the intervention was effective based on the diagnosis result, then biomechanical evidence is necessary to further support the claim. Conclusion : In future research, to use SFMA as a diagnostic tool with high accuracy, it is necessary to improve the reliability of the main problem through breakout, support for guidelines and validity and efficiency.
The recent medical treatment guidelines and the development of information technology make hospitals reduce the expense in surrounding environment and it requires improving the quality of medical treatment of the hospital. That is, with the new guidelines and technology, hospital business escapes simple fee calculation and insurance claim center. Moreover, MIS(Medical Information System), PACS(Picture Archiving and Communications System), OCS(Order Communicating System), EMR(Electronic Medical Record), DSS(Decision Support System) are also developing. Medical Information System is evolved toward integration of medical IT and situation si changing with increasing high speed in the ICT convergence. These changes and development of ubiquitous environment require fundamental change of medical information system. Mobile medical information system refers to construct wireless system of hospital which has constructed in existing environment. Through RFID development in existing system, anyone can log on easily to Internet whenever and wherever. RFID is one of the technologies for Automatic Identification and Data Capture(AIDC). It is the core technology to implement Automatic processing system. This paper provides a comprehensive basic review of RFID model in Korea and suggests the evolution direction for further advanced RFID application services. In addition, designed and implemented DB server's agent program and Client program of Mobile application that recognized RFID tag and patient data in the ubiquitous environments. This system implemented medical information system that performed patient data based EMR, HIS, PACS DB environments, and so reduced delay time of requisition, medical treatment, lab.
Two controversial issues exist in interpretation of "Force Majeure" set forth in the Article 931 (4) of the Korean Commercial Code. Firstly, its scope of application is ambiguous. Secondly, there is a concern that the "immunity" under paragraph 1 and "Force Majeure" may overlap each other. "Force Majeure" refers an event resulted from either natural disaster or 3rd-party. Meanwhile, the latter implies relatively extensive and comprehensive meaning and its interpretation may vary depends on law enforcement. In general, the aircraft accident hardly results in damage or loss to the 3rd-party. Additionally, it is worth to review newly enacted clause and to define its applicability. When the 3rd party is suffered from damage or loss incurred by any external act, it is necessary to explicit the concept of the non-contractual liabilities with respect to 3rd party. From the perspective of protecting aviation industries, the commercial aviation operator may be entitled to immunity in respect of claim for damage incurred by the event of Force Majeure. However, this approach is directly opposite to the victim's benefit and protection by the law. Therefore, the priority of the legal protection should be considered. Although the interest of the commercial aviation operator is not negligible, the protection of the law should be favorable to the 3rd party. Otherwise, the innocent party has no right to claim for damage incurred by aviation accident. Another issue is about the possibility of overlapping of the provision set forth in the paragraph 1 and 4. The former states that the liabilities shall be exempted on account of either the unsettled political or economic situation but this clause is inconsistent with the interpretation on Force Majeure under the latter. As argued above, this may include any event resulted from either political or economic account by the external influence of the 3rd party, thus these two provisions are overlapped. Consequently, in order to develop ordinances and guidelines and to ensure an equal protection to both parties, above two issues must remain open for further discussions.
