  • The CISG has been legislated for playing roles as uniform rules which govern international sale of goods. The job of getting unification of the diverse domestic legal systems required almost half century of work. In the process of making the Convention some rules resulted from compromises of nation's relevant interests. The Convention, however, promoted both the legal certainty and harmonization in international trade in that the uniform rules suggest the appropriate resolution to the legal problems in the course of concluding a contract as well as in remedies for breach of contract. This paper focuses systematically on the scope of applicability of the CISG. The Convention deals with contracts for the international sale of goods. However, it does not apply to all kinds of the international sale of goods. The CISG confines the sphere of applicability to a certain type of sales. First of all, the CISG is limited to those contracts having been concluded between a particular group of persons, which is called a personal aspect of applicability. Secondly, the CISG covers a specific category of sales, which is called a material aspect of applicability. Thirdly, the CISG are concluded within a particular period of time, which is called a temporal aspect of applicability. Lastly, the CISG is limited to contracts falling within a given territorial sphere, which is called a territorial aspect of applicability.

환경영향평가제도를 둘러싼 한미FTA 투자분쟁의 가능성: Bilcon 대 캐나다 투자자-국가 간 소송 사례를 통한 교훈 (The Possibility of Investor-State Dispute under Korea US FTA in relation to Korean Environmental Impact Assessment: A Lesson from Bilcon v. Canada Case under NAFTA)

  • This study aims to investigate the possibility of Investor-State Dispute under Korea US FTA in relation to Korean environmental impact assessment scheme. The study analyzes the Investor-State Dispute case between Bilcon of Delaware and the government of Canada. The case study shows that Bilcon challenged Canada with violations of NAFTA 1102, 1103 and 1105, arguing that Canada treated Bilcon in an arbitrary and discriminatory manner. The study analyzes two different scenarios that Korea could face with arbitration for alleged breach of its obligations under the Korea US FTA in relation to EIA scheme. From analyzing the case study in relation to two different scenarios, the study finds that problems previously identified and associated with EIA scheme in Korea could directly or indirectly cause Investor-State Dispute Settlement process between Korea and American investors. The study concludes that the risk of violating Korea US FTA related with Korean EIA could be reduced by creating Korean EIA scheme in a transparent and unarbitrary manner which guarantees fair public participation and elaborating the concrete meaning of sustainable development in EIA law.

Intraosseous Calcaneal Lipoma with Subtalar Perforation through Cystic Degeneration: A Case Report

  • Intraosseous lipoma is a benign tumor that originates from proliferating mature lipocytes. It often occurs in the metaphysis of long bones of the lower extremity, and also in the calcaneus, humerus, mandible, sacrum, and rib bones. Frequently, it involutes spontaneously through a process of infarction, calcification, and cyst formation. It can either present as pain, or be asymptomatic and only discovered through an incidental radiological finding. In our case, the patient presented with heel pain. Intraoperatively, it was found that the intraosseous cavity was filled with fat along with an adjacent but separate area of cystic degeneration. There was also a cortical perforation at the cystic lesion which was communicating with the subtalar joint. This cortical breach is most likely the cause of diffuse lateral heel pain experienced by our patient, and such a pathological fracture due to intraosseous lipoma has never been reported.

SAFETY STUDIES ON HYDROGEN PRODUCTION SYSTEM WITH A HIGH TEMPERATURE GAS-COOLED REACTOR

  • A primary-pipe rupture accident is one of the design-basis accidents of a High-Temperature Gas-cooled Reactor (HTGR). When the primary-pipe rupture accident occurs, air is expected to enter the reactor core from the breach and oxidize in-core graphite structures. This paper describes an experiment and analysis of the air ingress phenomena and the method fur the prevention of air ingress into the reactor during the primary-pipe rupture accident. The numerical results are in good agreement with the experimental ones regarding the density of the gas mixture, the concentration of each gas species produced by the graphite oxidation reaction and the onset time of the natural circulation of air. A hydrogen production system connected to the High-Temperature Engineering Test Reactor (HTTR) Is being designed to be able to produce hydrogen by themo-chemical iodine-Sulfur process, using a nuclear heat of 10 MW supplied by the HTTR. The HTTR hydrogen production system is first connected to a nuclear reactor in the world; hence a permeation test of hydrogen isotopes through heat exchanger is carried out to obtain detailed data for safety review and development of analytical codes. This paper also describes an overview of the hydrogen permeation test and permeability of hydrogen and deuterium of Hastelloy XR.

Secure and Efficient Privacy-Preserving Identity-Based Batch Public Auditing with Proxy Processing

  • With delegating proxy to process data before outsourcing, data owners in restricted access could enjoy flexible and powerful cloud storage service for productivity, but still confront with data integrity breach. Identity-based data auditing as a critical technology, could address this security concern efficiently and eliminate complicated owners' public key certificates management issue. Recently, Yu et al. proposed an Identity-Based Public Auditing for Dynamic Outsourced Data with Proxy Processing (https://doi.org/10.3837/tiis.2017.10.019). It aims to offer identity-based, privacy-preserving and batch auditing for multiple owners' data on different clouds, while allowing proxy processing. In this article, we first demonstrate this scheme is insecure in the sense that malicious cloud could pass integrity auditing without original data. Additionally, clouds and owners are able to recover proxy's private key and thus impersonate it to forge tags for any data. Secondly, we propose an improved scheme with provable security in the random oracle model, to achieve desirable secure identity based privacy-preserving batch public auditing with proxy processing. Thirdly, based on theoretical analysis and performance simulation, our scheme shows better efficiency over existing identity-based auditing scheme with proxy processing on single owner and single cloud effort, which will benefit secure big data storage if extrapolating in real application.

A Blocking Distribution Channels to Prevent Illegal Leakage in Supply Chain using Digital Forensic

  • Purpose: The scope of forensic investigations serves to identify malicious activities, including leakage of crucial corporate information. The investigations also identify security lapses in available networks. The purpose of the present study is to explore how to block distribution channels to protect illegal leakage in supply chain through digital forensic method. Research design, data and methodology: The present study conducted the qualitative textual analysis and its data collection process entails five steps: identifying and collecting data, determining coding categories, coding the content, checking validity and reliability, and analyzing and presenting the results. This methodology is a significant research method due to its high quality of previous resources. Results: Applying previous literature analysis to the results of this study, the author figured out that there are four solutions as an evidences to block distribution channels, preventing illegal leakage regarding company information. The following subtitles show clear solutions: (1) Communicate with Stakeholders, (2) Preventing and addressing illegal leakage, (3) Victims of Data Breach, (4) Focusing Solely on Technical Teams. Conclusion: There are difficult scenarios that continue to introduce difficult questions surrounding engagement with digital evidence. Consequently, it is important to enhance data handling to provide answers for organizations that suffer due to illegal leakages of sensitive information.

Stackelberg Game between Multi-Leader and Multi-Follower for Detecting Black Hole and Warm Hole Attacks In WSN

  • Objective: • To detect black hole and warm hole attacks in wireless sensor networks. • To give a solution for energy depletion and security breach in wireless sensor networks. • To address the security problem using strategic decision support system. Methods: The proposed stackelberg game is used to make the spirited relations between multi leaders and multi followers. In this game, all cluster heads are acts as leaders, whereas agent nodes are acts as followers. The game is initially modeled as Quadratic Programming and also use backtracking search optimization algorithm for getting threshold value to determine the optimal strategies of both defender and attacker. Findings: To find optimal payoffs of multi leaders and multi followers are based on their utility functions. The attacks are easily detected based on some defined rules and optimum results of the game. Finally, the simulations are executed in matlab and the impacts of detection of black hole and warm hole attacks are also presented in this paper. Novelty: The novelty of this study is to considering the stackelberg game with backtracking search optimization algorithm (BSOA). BSOA is based on iterative process which tries to minimize the objective function. Thus we obtain the better optimization results than the earlier approaches.

Why Should We Consider Potential Roles of Oral Bacteria in the Pathogenesis of Sjögren Syndrome?

  • Sjögren syndrome (SS) is a chronic autoimmune disorder that primarily targets the salivary and lacrimal glands. The pathology of these exocrine glands is characterized by periductal focal lymphocytic infiltrates, and both T cell-mediated tissue injury and autoantibodies that interfere with the secretion process underlie glandular hypofunction. In addition to these adaptive mechanisms, multiple innate immune pathways are dysregulated, particularly in the salivary gland epithelium. Our understanding of the pathogenetic mechanisms of SS has substantially improved during the past decade. In contrast to viral infection, bacterial infection has never been considered in the pathogenesis of SS. In this review, oral dysbiosis associated with SS and evidence for bacterial infection of the salivary glands in SS were reviewed. In addition, the potential contributions of bacterial infection to innate activation of ductal epithelial cells, plasmacytoid dendritic cells, and B cells and to the breach of tolerance via bystander activation of autoreactive T cells and molecular mimicry were discussed. The added roles of bacteria may extend our understanding of the pathogenetic mechanisms and therapeutic approaches for this autoimmune exocrinopathy.

홍수위험지도 작성을 위한 댐 붕괴 지점에서의 유량곡선 산정 (Development of a Hydrograph Triggered by Earth-Dam-Break for Compiling a Flood Hazard Map)

  • 홍수위험지도를 작성하기 위하여 수치모형을 이용한 잠재적 피해 대상 지역 파악이 선행되어야 한다. 댐 붕괴로 인하여 빚어지는 홍수위험지도 작성에서도 시나리오 별로 댐 붕괴를 모의하기 위한 댐 붕괴 수치 모의가 필요하다. 댐 붕괴 시 첨두 유량은 결정 인자인 댐 붕괴(breach)나 저수지의 수량과 댐 붕괴 형성 및 진행에 민감하므로 이런 요소를 포함하는 물리적 모형이 필요하다. 댐 붕괴 메커니즘과 수리학적 현상이 모든 댐 붕괴에 같다고 가정하고 하나의 물리적 댐 붕괴 수치 모형을 구축하였다. 댐 붕괴지점에서 수문곡선을 추정하는데 초점을 두어 댐 하류의 하도 추적 시 상류부의 경계조건 역할을 하도록 하는 것이며, 연구에서 하류부의 하도 추적은 다루지 않았다. 물리적 모형은 댐 붕괴 형성과정에 필요한 역할과 댐 붕괴를 통한 흐름의 수리학적 설명을 담고 있다. 2008년 중국의 장지산(Tangjishan) 댐 붕괴 시 관측된 현장 자료를 이용하여 모형의 수행능력을 검정하였다. 모의 결과는 만족할만한 수준의 정확도를 가지는 것으로 나타났으며 결정계수는 0.974, NSC는 0.94, RMSE는 $610m^3/sec$ 정도로 나타났다. 이로 미루어보아 연구에서 구축된 댐 붕괴 모형은 실제 댐 붕괴 관측 자료를 현실적으로 잘 재현해내는 것으로 확인되었으며, 댐 붕괴로 인한 홍수위험지도 구축 시 상류부 경계조건으로서 활용성이 높은 것으로 나타났다.

3차원 포인트 클라우드 모델링 기법을 활용한 바이오폴리머 기반 제방 보강공법의 성능 평가 (Application of 3D point cloud modeling for performance analysis of reinforced levee with biopolymer)

  • 본 연구에서는 하천에서의 월류 발생에 따른 제방의 붕괴를 방지하거나 피해를 최소화하기 위한 신소재 보강공법을 제체 표면에 적용하여 그 효과를 검증하기 위한 실규모 횡월류 붕괴 실험을 수행하였다. 본 실험을 위해 제방 모형은 높이 2.5 m, 길이 12 m, 사면경사 1:2로 구성하였다. 또한 제방의 경우 습식 공법을 이용하여 바이오폴리머 분말, 물, 화강풍화토, 황토를 적정 비율로 혼합한 신소재를 제체 표면에 약 5 cm 두께로 분사한 뒤 식생활착 모니터링을 거쳐 최종 실험모형을 완성하였다. 안동하천연구센터 A3 수로 상류에서 4 ㎥/s 의 유량을 유입시켜 횡월류 흐름을 유도하였으며, 음향 도플러 유속계를 이용하여 상·하류의 유량 및 횡월류량의 변동을 측정하였다. 또한, 제방보강공법의 성능을 평가하기 위해 이미지 픽셀 기법 및 3차원 포인트 클라우드 모델링 기법을 활용한 시간에 따른 제방의 표면손실률을 산정함으로써 영상분석 기반의 새로운 평가 도구를 제시하였다. 본 연구결과를 적절하게 활용하게 되면 제방보강공법의 성능을 평가하는데 기초 자료로 활용될 수 있을 것으로 사료된다.
