한반도 주변국가의 항공법 비교연구 (A Comparative Study on the Air Law in Korea and Neighboring Countries.)

  • 1944년 체결된 국제민간항공협약에서는 국제항공운송의 안전과 질서를 위하여 항공규칙의 통일화를 위해 국제표준 및 권고관행을 부속서의 형태로 채택하였고, 각 체약국은 이를 기준으로 하여 자국의 법률을 제정 및 개정하도록 하고 있다. 하지만 체약국의 사정상 국제표준과 권고관행을 이행할 수 없을 경우 혹은 차이점이 있을 경우 이를 국제민간항공기구에 통보하여 타 체약국에서 이를 파악할 수 있도록 부속서의 부록으로 게재하고 있다. 한반도 주변국가의 경우 모두 국제민간항공협약의 체약국이며 국제민간 항공협약과 동 부속서의 국제표준 및 권고관행을 자국의 법률로 제.개정하여 항공법의 통일화를 이루고 있다. 하지만 한반도 주변 국가는 자국의 문화와 국내 사정의 이유로 각 항공법의 차이점도 존재하고 있어 최근 한반도 주변의 빈번한 항공운항의 안전을 위해 이를 분석하여 각 국가의 항공법의 특성에 대한 연구가 필요하다. 본 연구에서 한반도 주변국가라 함은 한국 중국 일본 북한을 말하며, 한반도 주변의 항공운송정책에 맞추어 한반도를 중심으로 하는 한국 중국 일본 북한의 항공법에 대하여 살펴보았다. 특히 각 국가의 항공법에 대한 연혁과 구성 체계를 비교 분석하여 한반도 주변국가가 서로의 자국 항공법의 제정에 어떠한 영향을 주었는지 연구하고, 국제민간항공협약 및 동 협약의 부속서에서 정한 국제표준 및 권고관행과 국제민간항공기구에 통보한 자국 항공법규상의 차이점을 주요 내용으로 하여 한반도 주변 국가의 항공법과 비교 하여 각 국가 간 국제표준 및 권고관행의 이행 여부와 차이점 통보가 각 국의 항공법 개정에 어떠한 영향을 끼쳤는지에 대하여 알아보는 것이 본 연구의 목적이다.

The legal regime of air charter in china

  • Charter flight in international air law has, from very beginning, not precisely defined by the International Civil Aviation Organization (lCAO) since 1947 when it came into being. By practice, the operation of charter traffic is, in its very beginning, the subject to the regulations of national rules and bilateral charter agreements (charter annex clause) within the framework of normal bilateral agreement of international air services. Taiwan had signed a series of bilateral air service agreement under the name of the Government of the Republic of China when Taiwan was recognized by the United Nations and major members of international community as the sole legal government representing China before 1971, but that situation was changed since then. Taiwan has only maintained diplomatic relations with 25 States, but maintained semi-official relations with major powers of the world. The former agreements were signed within the framework of the Vienna Convention on the Law of Treaties of 1969 while the latter agreements were signed within the framework of administrative and civil law of two countries which were not in the form of bilateral treaty signed by two sovereign States in its proper sense of international law. The legal regime of charter flights between Taiwan and Mainland China is regulated by special arrangements negotiated by delegated airlines and airlines association or private law institutions.

  • Recently, China & Japan have expanded their responding ADIZ(Air Defence Identification Zone) to implement each Government's maritime policy and to project their Air Power in preparation for maritime provocation & contingency, especially over the piled area where East Asia countries have claimed to have maritime jurisdiction one another. So this is to guide the Development Option for Korea Air Defence Identification Zone to cope with the maritime intentions of the neighboring countries, considering the international law for ADIZ, the maritime policy and the maritime sovereign & jurisdiction area of the Republic of Korea, etc.

Target Practising in a Global Commons: The Chinese ASAT Test and Outer Space Law

  • When the People's Republic of China destroyed one of its own defunct meteorological satellites, the Fengyun-1C, at an altitude of some 865 km above the earth's surface, the PRC was accused of initiating, or at the very least risking an(other) arms race in outer space also. The test also gave rise to a few legal questions as to the permissibility of this test, and the broader permissibility of using space for military and other weapon-touting activities, Whilst the test cannot be considered to constitute a direct threat to international peace and security so as to invoke relevant legal principles and consequences in terms of the UN Charter for example, it highlights the importance of such clauses in international space law as requiring international cooperation and consultation, due regard for the interests of all other countries both on earth and in outer space, and the further development of general regimes of registration and space debris-prevention. From that perspective, the PRC violated international outer space law not so much by the test itself but by the accompanying lack of information, consultation and due regard for other states', and indeed mankind's, interests.

국제형사재판소(國際刑事載判所)통한 항공기(航空機)테러범죄 규제에 관한 연구- ICC규정(規程)개정 위한 입법론적 고찰을 중심으로 - (A Study on the Legal Control of Aircraft Terrorism by International Criminal Court(A Suggestion for the Amendment of ICC Statute))

  • The purpose of this paper is to investigate the legal controㅣ, by using the International Criminal Court(ICC) that will enter into force to the most serious crimes of concern to the international community as a whole, and regulates the jurisdiction with respect to the following crimes: (a) The crime of genocide; (b) Crimes against humanity; (c) War crimes; Cd) The crime of aggression. However, the existing ICC Statute excludes (e) Crimes, established under or pursuant to the treaty, which was regulated by the ICC draft statute that the International Law Commission(ILC) examined and submitted to the UN General Assembly in 1994, and which contained aircraft terrorism such as hijacking in the Hague Convention of 1970 or sabotage in the Montreal Convention of 1971 in Annex of ILC draft. Therefore, this paper examines the legal character of aircraft terrorism as one of the most serious crimes of concern to the international community as a whole, and suggests two kinds of legislative comments for the amendment of the ICC Statute including aircraft terrorism as an object of the jurisdiction of the Court, for suppressing aircraft terrorism in advance and ensuring equitable penalty by ICC system.

  • 항공기술의 발달과 더불어 항공기가 날로 무기화하는 추세에 있어서 특히 세계적으로 조밀한 공역을 자랑하는 동아시아에 위치한 우리나라의 입장에 서는 북한과의 대치상황과 더불어 영공 기타 공역에 대한 대응이 현실적으로 절실한 상황이다 그러나, 현재 우리의 관련 법제는 법률적인 차원에서 이에 대한 대응을 하지 못하고, 군 내부의 관련규정에만 의존하고 있어 실제로 침범사고의 발생시에 그 처리에 있어서 많은 문제점이 제기될 가능성이 존재한다. 이 논문에서는 한반도 주변의 공역을 영공, 방공식별구역, 비행정보구역, 배타적 경제수역 상공, 접속수역 상공, 공해 상공으로 구분하여 각 공역의 특성과 이에 대한 우리의 대응조치 등을 살펴보고, 나아가 문제점을 해결하는 방안으로 관련법제의 입법방향에 대해서 검토해 보고자 한다.
