Ocean Dumping Policy in Korea and its International Trend (우리 나라의 폐기물해양배출제도와 국제동향)

  • 폐기물의 특성상 유지에서 처리가 곤란하고 처리비용이 과다하게 소용되는 폐기물 을 지정된 해역에서 적정 처리방법에 따라 해양에 배출토록 허용하는 폐기물의 해양배 출 제도가 있다. 폐기물의 해양배출에 대한 법적근거는 국내법으로 해양오염방지법과 폐기물관리법, 수질환경보전법 그리고 오수, 분료 및 춘산폐수의 처리에 관한 법률이 있고 국제협약으로 폐기물 및 기타 물질의 투기에 의한 해양오염의 방지에 관한 협약 (일명 런던덤핑 협약:LDC-London Dumping Convention)이 있다. 여기서는 배출이 허용 된 폐기물의 종류 및 체계와 우리 나라 인근 해역에서의 폐기물의 해양배출 현황과 외 국의 해양배출 현황을 언급하고, 폐기물의 해양배출이 해양환경에 미칠 영향과 폐기물 의 해양배출에 대한 감시체계 그리고 배출해역 관리를 위한 배출해역에 대한 수질조사 에 대하여 언급하였다. 그리고 앞으로의 폐기물의 해양배출제도에 대한 국제적 동향과 향후의 전망을 언급하고, 우리 나라의 입장 및 정책방향에 대하여 언급하겠다.

  • Since ocean dumping of wastes was permitted by law in 1900, the amount of wastes dumped into the sea has increased ten times for 15 years. As a result, the dumping sites has been deteriorated so much that the pollution has become a social problem. The 96 Protocol to the 72 London Convention, which requires the contracting party's stricter control on the disposal of wastes at sea, took effect on March 24, 2006. Therefore, our country has become confronted to the situation on which it cannot delay putting a restraint on ocean dumping. Hereupon, Korea Coast Guard (KCG) initiates a dumping sites recovery program. The program is intended to curb the amount of wastes dumped at sea and to recover the polluted dumping sites. In this paper, the current status of our country's management of ocean dumping of wastes is examined and the future condition is anticipated KCG's ocean dumping management measures are also presented.

  • In order to take measures for solving conflicts between Korean government such as MOMAF(Ministry of Maritime Affairs and Fisheries) and MAF(Ministry of Agriculture and Forestry) and the relevant industry circles such as KSA(Korea Swine Association) and KODA(Korea Ocean Dumping Association) regarding the prohibition of marine disposal of livestock. excreta wastes from land, the present conditions of marine disposal of livestock excreta wastes and the standpoints of MOMAF, MAF, KSA and KODA were reviewed in Korea.

As measures for solving the conflicts, the followings were proposed; A prior examination into the possibility of the treatment and/or disposal on shore for the total amount of livestock excreta wastes in Korea, measures for solving civil appeals against the problems arising from the treatment and/or disposal on shore of livestock excreta wastes, a prior examination into the possibility of the execution of the amendments to the relevant rules and regulations of Korean marine pollution prevention law for the prohibition of ocean dumping of livestock excreta wastes, measures for supporting the relevant industry circles such as KSA and KODA which were expected to suffer from the prohibition of ocean dumping, and an overall review of the national system for ocean dumping of terrestrial wastes in nationwide level.

A Leg Analysis on the Discharge of Cargo Residue at Sea (화물잔류물의 해양 투입처분(배출) 사안에 대한 법률적 분석)

  • The Consultative Meeting of the Convention on the Prevention of Marine Pollution by Dumping of Wastes and other matter, 1972 (London Convention 1972) has requested to International Maritime Organization (IMO) Marine Environmental Protection Committee to collaborate and help clarify a boundary issue between International Convention for the Prevention of Pollution from Shops, 1973 as modified by the Protocol of 1978 (MARPOL) and the London Convention concerning 'dumping' versus 'discharges' during normal operations of ships in 2004, and subsequently established a Joint London Convention/MEPC Correspondence Group. The Contracting Parties to London Convention expressed their environmental concerns on the broad interpretation of the "cargo-associated wastes" by the States, which could be discharged by ships under MARPOL. Regulatory regimes for the cargo residues appear to vary among states. Some countries require fur ships to discharge their cargo wastes into the port reception facility and IMO also recommends doing so. This paper examines the related current national and international legal texts for the regulation of disposal of wastes from ships in order to analyze the current global concern on the marine pollution associated with waste discharge during operations of ships. In particular, we attempt to evaluate the likely marine environmental consequences arising from the disposal of cargo residue using an hypothetical case for the coal cargo residue among bulk cargos in this paper, since location, magnitude and frequency of the discharge of coal cargo residues into the sea adjacent to Korean Peninsula are not readily available. The cargo residues may be discharged to the sea according to MARPOL 73/78; however, its marine environmental consequences can be significant depending upon the characteristics and amounts of wastes to be discharged. Also the public tolerance of the environmental consequences would be widely different among nations. Multilateral environmental agreements, in general, more strictly apply their rules if there are other options to disposal at sea, i.e. port reception facility in this case. Therefore, port reception facilities for the wastes generated by ships are recommended to be further constructed in major national ports in order to reduce the risk of environmental damages during the operations of ships.

Improving the Port-Reception-Facility System (선박 배출 오염물질 항만처리시스템 확보방안 연구)

  • In this study, we sought to establish a vessel-discharge pollutant-treatment system recommended by IMO by first investigating advanced facilities overseas to help us understand and evaluate our domestic facility and needs. IMO recommends the installation and operation of port pollutant-storage facilities to adequately treat pollutants emitted by ships entering the port, and we reviewed the registration and operation of these facilities in IMO member countries, focusing on the IIII Code. Due to recent environmental regulations, additional facilities are required to treat the washing water discharged from equipment such as scrubbers mounted on the ship so pollutant-storage facilities must be established. Currently, Korea's ship-discharged wastes are being moved from ports to land waste-treatment plants, and their quantity and properties are not being monitored. Therefore, in this study, we improved monitoring of the discharged pollutants and investigated the proper arrangement of pollutant storage facilities as recommended by IMO. The system we established can help provide smooth service to incoming ships - and appropriate treatment of pollutants and will greatly benefit international maritime operations.

Oceanographical Consideration on waste disposal in the Marine environment (폐기물 해양배출에 대한 해양환경적 고찰)

  • 해양에 투기된 폐기물의 시공간적인 분포와 변화과정은 해양 물리학적 확산과 이 동, 생물학적 흡수 및 변환과정, 화학적 반응 및 상태변화등 여러 과정이 복합적으로 작용하여 일여난다. 이러한 폐기물의 해양투기가 해양생태계 및 환경보전에 미치는 여 러 가지 영향은 이에 대한 규제 및 적절한 운용을 통하여 원활한 해양생태 및 환경을 유지할 수 있도록 최소화되어야 한다. 해양투기의 최적화를 위하여서는 첫째, 생태학 적 배제원칙(biological exclusion)이 최우선적으로 고려되어야 하고 둘째, 생태계 및 수산자원 보존을 위하여 원활한 해수교환 및 물질확산이 극대화된 투기장소의 입지 선 정(hydrographic option)이 매우 중요하다. 둘째 로는 적법한 투기행위 및 적절한 투 기장 운용을 위한 감독 및 감시체제의 확립이 필요하다. 현재 우리 나라의 해양 폐기 물 투기는 초기의 단계에 있으나 최근 점차 요구되는 인접 해양국가 간의는 지역환경 협의체 구성 및 국가간 환경 부담 비용을 고려할 때 공해상의 해양투기는 더 이상 국 내적 문제가 아니므로 보다 신중한 해양투기 활동 및 타당성의 국토가 필요하다. 황해 에 위치한 투기장의 경우 현재까지의 관련자료를 검토할 때 적정 투기 규모 및 투기장 입지 선정, 그리고 불법 폐기물 투기가능성의 미비점에 대한 보완책이 필요한 것으로 사료된다.

  • 유럽 국가들이 해양환경 오염의 심각성을 인식하여 1972년 최초로 해양투기를 규제하기 위한 지역협정인 오슬로 협약(Oslo Dumping Convention)을 체결하게 되었다. 이를 모체로 하여 런던에서 범세계적인 규제의 필요성이 제기되어 국제협약인 런던협약(London Convention)이 1972년에 체결되었다. 그 후 1990년대에 들어 런던협약 당사국들은 협약을 보다 근본적으로 개정할 필요가 있다는데 의견을 같이 하게 되었다. 1993년 제1차 개정그룹회의 이후 3년간의 작업 끝에 1996년 11월 7일 IMO 본부에서 열린 특별회의에서 1996년 의정서('96 의정서)가 채택됨으로써 협약의 전면적인 개정작업이 완성되었다. 우리나라는 2009년 1월 22일 가입하였으며 2009년 2월 21일에 발효되었다. 이에 따라서 우리나라는 폐기물 해양배출량을 지속적으로 감축하고자 노력 중이다. 본 논문에서는 폐기물 해양배출의 감축과 관리를 보다 효율적으로 하기 위하여 필요한 기술개발과 시스템 구축, 그리고 정부 및 지방자체단체의 정책수립과 법률개정을 위한 자료를 제공하고자 한다.

A Study on the User Experience of Food Waste at Home (가정에서의 음식물류 폐기물 처리에 대한 사용자 경험 연구)

  • The environmental problems caused by food waste have been a steady social issue, and the severity of the problem emerged as the 2013 London Convention banned the marine emissions of waste water. The government implemented measures related to food waste, but prior studies showed that it lacked continuity and lacked strategies for each area of occurrence, and emphasized that citizens' participation is important to implement effective reduction policies. Therefore, this study proposed a food waste disposal machine through user experience analysis as a way to induce civic participation. To this end, the design development direction was outlined in this study after the pre-research and user survey stages through FGI and user journey maps. Based on this, the proposed treatment machine facilitates the frequent discharge of waste and simplifies the process of food waste in the home. In addition, the moment of direct contact between the user and waste is only the point at which the waste is released to the handler, thereby minimizing the negative experience the user has experienced.
