This paper conducts a comparative analysis of the KORUS FTA and the TPP Agreement to assess the current state of affairs in international trade rules for the pharmaceutical industry. Intellectual property rights as well as public health related regulations have evolved to strengthen the position of innovator drug companies. In particular, the TPP Agreement which adopted data exclusivity for biologics for the first time, will set the standard for the future. Apart from this however, the TPP Agreement has not gone further than the KORUS FTA and in some respects, even contains greater policy flexibilities and provisions for market access than the KORUS FTA. Korea should take advantage of such differences when and if she must engage in negotiations to join the TPP Agreement or a renegotiation of the KORUS FTA.

1,2차 협상을 평가하기에 앞서 지적할 것은 정부가 가공 자료를 철저히 비공개로 하고 있다는 점이다. 심지어 모든 협상이 영어로 진행되고 합의문이 영어로만 되어 있다. (한글로 된 합의문은 아예 없다) 이런 조건에서 이 글은 각종 신문 자료를 토대로 작성할 수밖에 없었다. 한미 FTA는 한국의 모든 분야, 모든 사람들에게 이전의 어떤 협상과도 비교할 수 없을 큰 영향을 미칠 것이다. 따라서 협상 내용이 국가기밀에 해당하는 중요한 것이 아닌한 최대한 공개되어야 한다. 또한 한미 FTA로 영향을 받게 될 모든 국민들은 협상 내용의 공개를 강력히 요구해야 한다. 협상 내용을 모르면 협상에 개입할 수 없고 자신을 방어할 수 없다. 본고는 그 중요성을 특별히 강조하고자 한다.

Numerous discussions on the KORUS FTA has been centered around issues on trade in goods, services, or dispute settlement mechanisms. On the other hand, little attention has been given to Chpater 21 of the KORUS FTA on transparency, especially Article 21.6 which states about anti-corruption. Article 21.6 and the Foreign Corrupt Practices Act shares the common purpose to prevent corruptive business practice, and they show similarities in many aspects. The FCPA enforcement has dramatically increased over the past ten years by the U.S. Department of Justice and Securities Exchange Commission stretching its jurisdiction to foreign nationals and companies. Korean business professionals and corporations are exposed to both Article 21.6 and the FCPA on corruption issues. Thus, it is imperative to understand Article 21.6 to be equipped with anti-corruption compliance programs. This paper examines the FCPA and Article 21.6 through comparative analysis and proposes appropriate measures for Korea to take.

경기도 평택시에 위치하고 있는 한미약품(주) 평택공단. 이 공단이 지난 2007년 준공됐을 당시 의약 제약 업계에서는 각별한 관심을 보였었다. 세파플랜트, 바이오플랜트 등 단 두 개의 공장만 들어섰지만 한미약품 자체적으로 '공단'이라고 명명할 만큼 어느 곳과도 비교할 수 없을 정도의 규모로 지어졌기 때문이다. 특히 이곳 세파플랜트는 국내 세파계 항생제의 약 70%까지 공급할 수 있는 전용 공장의 면모를 갖추고 있어 시장에 막대한 영향을 미칠 것으로 예상되기도 했다. 여기에 더해 이곳은 지역 안전인들 사이에도 남다른 관심을 받았다. 공장이 설계될 때부터 근로자들의 안전을 최우선 가치로 삼아 재해발생 요소를 최소화했기 때문이다. 아울러 공단이 가동된 직후부터 현재가지 빈틈없는 안전관리를 전개하면서 말 그대로 '안전 사업장'으로 유명세를 타고 있는 것이다. 안전경영을 바탕으로 제약산업을 선도해나가고 있는 한미약품(주) 평택공단을 찾아가 봤다.

Currently the nations which join the WTO shall observe understanding on rules and procedures governing the settlement of disputes in WTO agreement. In addition this agreement provides it will be able to apply dispute settlement mechanism of the WTO. Korea and the United States are accomplishing an important role as the core members of the WTO. Regardless of this, The Korea - US FTA is providing a separate dispute settlement system. This paper pursues a comparative analysis concerning rules and procedures of dispute settlement between The Korea - US FTA and the WTO, and furthermore derives problems from the viewpoint of effectiveness, and suggests alternatives and implications in view of trade policy. I hope this study contributes to setting-up and development of national trade policy and is applied to FTA negotiation hereafter.

Therefore, the purpose of this study is to compare and analyze the following activities related to the education ${\cdot}$ art ${\cdot}$ culture ${\cdot}$ industry of their cartoon & animation; 1) The education of their cartoon & animation is deeply specified in the establishment of department, composition of curriculum, and research & development. 2) The art of their cartoon & animation is widely diversified in the art creation of cartoon & comics, vanguard experiment of animation, and awarding system. 3) The culture of their cartoon & animation is clearly distinguished in the setup of organizations, expansion of cultural facilities, and festival events. 4) The industry of their cartoon & animation makes ultramodern contents of cartoon & comics, film digitizing of animation, and brand merchandising of characters. Finally, we must research and develop the ${\ll}$digital cartoon, webtoon, and mobile animation${\gg}$ in Korea.
