A Checklist for Assessment of Risks Involved in IT Service Project Contract (IT 서비스 프로젝트 계약서 위험 요인 평가 체크리스트)

  • Risk factors are the reason behind cost overruns and delays in long-term large-scale IT service projects. Major risks originate from the integration of complex IT system components, including software, hardware, and solutions; the competitive bidding process; the turnkey and firm-fixed price nature of contracts; and the project execution environment. We have identified several risk factors such as delay in acceptance, low quality of deliverables, delay in payment, adding and changing requirements and scope, unclear definition of roles and responsibilities of the buyer and supplier, and unclear procedures of change and quality management during the project execution phase. One needs to manage risks proactively before signing the contract. In order to weed out or lower the risk factors well in advance, we need to identify and remove risk factors contained in contract clauses and attached contract documents. We propose a checklist for assessing IT service project contracts. To validate the checklist's utility, we applied it to an IT service project in the finance industry. The results show that the checklist is effective in identifying and removing risk factors pertaining to IT service projects.

  • Multiple parties-owners, engineering and construction contractors, and suppliers involve the delivery process of capital facility projects in the construction industry, and each party obtains or provides their workforce, material, equipment, or service tied into specific contracts. Considering that construction projects are based on the contracted relationship between the parties and that contract types are one of the significant factors determining project success. it is critical for project stakeholder to select appropriate contract types for successful deliveries of projects. With these considerations, this paper assesses impacts of different contract types on project cost, schedule, safety, change, or rework. Analyzing data from real construction projects, the differences in project performance between two contract types, Cost Reimbursable and Lump Sum are measured and statistically tested to investigate if the differences are significant. For this analysis, performance metrics developed by Benchmarking and Metrics program, the Construction Industry Institute are used.

  • This paper presented the risk identification and the risk response of the construction project executed by mean of questionnaires/interview, significant risk factors are identified for construction contracts. The purpose of study is to improve the contract method for construction project. Therefore, partnering is increasingly being used on construction project. Partnering involves the parties to a construction project working together in an environment of trust and openness to realize the project efficiently and conflict. Partnering can bring significant benefits, including fewer adversarial relationships and increased end-customer satisfaction, to the construction industry if all parties involved in a project strive for its success.

  • Integrated project delivery (IPD) is suggested as an alternative to traditional delivery methods such as design-build (DB), design-bid-build (DBB), and construction management at risk (CMR). Many foreign research studies have approached IPD not only in the contractual aspect but also the work implementation method aspect. However, most research projects in Korea have focused on the contractual aspect of IPD for asserting that the characteristics are the critical matter. The Korean institutional and legal system does not permit the multi-party agreement; therefore, it is difficult to adopt IPD in Korea's construction industry. The researchers do not wait the system to be changed, but we do identify the possibility of adopting IPD in Korea in the perspective of work implementation method, except the contractual characteristics. Thus, the goal of this research is to identify one project that does not include IPD agreement but utilizes other IPD characteristics whose contractual results have similar performance to those that utilize all characteristics of IPD including agreement. This research is expected to enhance performance of the construction project in a Korean construction environment by embracing IPD characteristics as overcoming limits and bounds of the traditional delivery method.

A Study of Mediative Function by Contract on the Relationship between Employer's Power and Contractor's Behavior (발주자 권력과 시공사 행동 관계에서 계약의 매개적 기능에 관한 연구)

  • Normally there is a one-time relationship between stakeholders in the construction projects. Thus, project participants are easily exposed to opportunistic behavior. According to the theory of transaction costs, a contract effectively influence the behavior of counter-party. The important role of contracts in limiting opponent opportunistic behavior has been academically acknowledged and studied in inter-firm relationships. The purpose of this study is to reveal the mediating effect of the contract on the power of the contractor in the contractor's behavior. Power is divided into mediated and non-mediated power. We surveyed construction companies' employees who have conducted construction projects. Based on the questionnaire response, we examined the influence of the Employer's power on the behavior of the contractor. Both non-mediated power and mediated power were significant for in-role and out-role behaviors. Both non-mediated power and mediated power were found to have a significant effect on the control and coordination function of contracts. The results show that the control function of the contract is significant for the in-role behavior and the extra-role behavior. Finally, the mediating effect of the contract function was significant only in the control function.

  • The purpose of this study is to derive basic data of the Guaranteed Maximum Price(GMP) process and to present specimens that can be used at the time of execution of CM at Risk project in South Korea. CM at Risk project is issued in South Korea, but the actual data is lack. On the other hand, CM at Risk project is universalized and the market of the CM at Risk is steadily growing. Because of that, in this study, The United States cases was selected as a sample. GMP consists of CM's fee, CM contingency, project direct cost, project indirect cost, allowance. GMP negotiations are performed before the end of design completion, and after 3 rounds of estimation comparison, preliminary GMP is confirmed. GMP can be multiple contract and it is useful for Procurement of long lead materials and early construction. If the actual cost is lower than expected GMP, sharing of the saving is an option since the conflict of interests between the client and the contractor can occur.

  • This study analyzed main causes of claims in EPC/Turnkey projects. For this purpose, this study referred to the FIDIC silver book, which lists the international standard contract conditions for EPC/Turnkey projects. The most frequent cause of claim was delay. A process was then proposed to determine whether the owner or contractor was the responsible party when the delay claim occurred. The proposed process was for damages for delay which is the conditions of contract for indemnities against delay claim. The process was based on conditions of the contract of two previous EPC/Turnkey projects that were constructed in 2010, the FIDIC silver book, as well as the obligations of owner and contactors. The proposed process is applicable depending on the conditions of the contract and the owner's meaning. Furthermore, by identifying the responsible party, this study will contribute in identifying the possible claim types before concluding a contract and writing the specific contract.

The Study on the Control Combinations in IS Outsourcing Project Management (IS 아웃소싱 프로젝트 관리를 위한 조합적 통제유형에 관한 연구)

  • 본 연구는 아웃소싱 상황에서 정보시스템 개발프로젝트의 관리에 대한 이해를 목적으로, 시스템개발 프로젝트에 대한 관리를 통제(control) 또는 조정(coordination)의 관점에서 보는 기존의 연구 흐름과 같은 선상에서, IS 아웃소싱 프로젝트 관리의 문제를 조직간 통제관점에서 살펴보고자 한다. 본 연구에서는 다음의 두 가지 측면에서, 기존 연구의 확장을 시도하였다. 첫번째, 조직내부의 시스템 개발프로젝트 관리의 연구결과를 아웃소싱 상황으로 확장하여 적용하였다. 두번째, 기존 연구들이 개별 통제유형에 주목하였으나, 현실적으로는 다양한 통제유형이 동시에 존재하기 때문에, 조합적 측면에 초점을 맞추어 확장하였다. 이를 위하여 공식적 통제와 비공식적 통제를 두 가지 기준을 사용하여, 네 가지의 통제조합에 대한 이론적 유형(typology) - 역동적, 계약중심, 파트너쉽중심, 수동적 유형 - 제시하여, 35개 기업의 66개 프로젝트를 통하여 실증적으로 검증하였다. 연구결과는 파트너쉽중심 유형을 제외하고는 이론적 유형과 유사한 네 가지의 통제조합에 대한 실증적 유형(taxonomy) - 역동적, 계약중심, 중간형, 수동적 유형-이 도출되었다. 각 실증적 유형간의 차이는 역동적 유형과 계약중심 유형이 높은 것으로 나타났으며, 중간형 유형과 수동적 유형의 성과가 상대적으로 낮은 것으로 나타났다.

Analysis and Quantitative Estimation of Risk Factors of Design-Build (턴키 프로젝트에서 리스크요인 분석 및 정량적 평가)

  • The Risks in undertaking a construction project comes from many sources and often involves many participants in the project. This study has identified various kinds of risks, assessed the risk factors quantitatively and suggested risk management method for response pertinent in Design Build(Turn Key)type of projects in Korean context. A questionnaire was designed comprising of 145 possible risks in all types of construction projects. The population from owner, consultant and contractor groups was asked to indicate the risks applicable in DB projects. 25 numbers of critical risks in DB projects were identified and further analyzed for reveling inherent relationship between them through factor analysis. Factor analysis revealed 8 risk factors in DB projects. Construction site related, contract related and design related risk factor consisted about 72% of total risk weight. It has been found out about 6%, while considering the mutual dependency, it is about 10% of total cost of DB project. Therefore, It is suggested that 6% to 10% of construction amount as contingency has to be made provision for risk responses in the DB projects.
