한 세기전, 라이트 형제와 커티스의 비행기 기술 특허권이 특허 소송으로 시작하여 특허풀 결성으로 마무리된 분쟁은 한낱 다른 나라의 과거사로만 볼 수는 없다. 그 이면에는 우리 산업이 앞으로 무엇을 반복하지 말아야 할지, 바람직한 지식재산 전략의 방향이 무엇인지를 알려주는 교훈이 숨어있기 때문이다.

In this paper, we discuss patent pool and a patent valuation scheme for fair royalty distribution among the patents in a pool. In the knowledge-based economy, intellectual capital-the accumulation of technology and know-how-is recognized as the most important source of company's competitive advantage and economic growth. By providing exclusive rights to patent holders, the patent system aims to encourage innovation-invention & commercialization of new technologies-in order to raise the standard of living. However, drawbacks of patent system, which occur as the number of patents issued increases rapidly and patent ownership is fragmented, may slow down the innovation efforts seriously. A promising solution is the patent pool approach, which was for instance employed by the U.S. congress during World War I to free the airplane manufacturers from the patent tangle by letting them license all the patents for a fee. It is necessary to figure out relative technological contribution of patent for fair distribution of royalty revenues among patent holders. The Rating/Ranking Method seems to fit to that valuation purpose. We examined technology valuation models from various organizations and selected a set of more influential valuation factors which can be incorporated as scoring criteria in the Rating/Ranking Method.

A variety of methods of patent valuation are written in this paper. The typical methods such as scoring method, income approach method, market approach method, DCF method, real option method, are introduced in this paper and each of them is criticized respectively. A new method, so called "GVP Method", is introduced and shows how much effective it is when patent valuation is required. And specially MPEG patent licensing method is introduced in this paper.his paper.

21세기 디지털비디오 시장의 장을 연 DVD는 무한한 가치를 지닌 잠재력이 높은 기술이며 그로 인해 파생되는 다양한 제품들은 향후 디지털 정보가전시장에서 우위를 점하리라 예상된다. 이에 본 고에서는 DVD에 대한 종합적인 평가와 더불어 국내외의 시장상황을 살펴보았다. 또한, 현존하는 DVD 시장의 문제점과 DVD와 관련해 특허풀을 이루고 있는 DVD 포럼에 대해서도 조사하였다.

디지털 컨버젼스 시대에 다양한 기술들이 고정된 기기보다는 Mobile 기기들에 집중되고 있으며, 이에 따라 보다 효율적인 통신 방식에 대한 차세대 이동통신 기술표준의 중요성은 증가하고 있다. 흔히 기술표준과 관련한 필수특허(Essential Patent)란 기술표준규정에 따라 제품 또는 방법을 실시하는 경우 해당 특허의 claim을 침해하게 되는 특허를 의미한다. 표준필수특허는 개별 라이센싱(licensing)을 통해 활용될 수도, 특허풀(Patent Pool)을 통해 활용될 수도 있기 때문에 Prosecution단계에서부터 각 활용형태에 따른 고려가 필요하다. 한편, 표준필수특허의 창출 과정에서, 출원 후 보정을 통해 필수특허를 창출하는 것의 적법성, 묵시적 라이선스(Implied License) 문제, Claim의 주체 문제 등이 문제될 수 있으며, 각각에 따른 대응 전략이 필요하다. 또한, 표준필수특허의 활용과정에서 반독점법상 견제에 대응하기 위한 FRAND 조건, 선언 의무 위반 등이 문제될 수 있다. 본고에서는 표준필수특허의 창출 및 활용에 있어서 법률상 문제와 이에 대한 대응 전략에 대해 알아본다.
