A Study on Analysis of Patent Information Based Biotechnology Research Trend and Promising Research Themes (특허정보 기반의 바이오 기술개발 트렌드 분석 및 유망기술분야 도출에 관한 연구)

  • As science and technology are emphasized as national competitiveness, major nations designate new growth engine industry and establish the effective investment and the development strategy to enhance industrial development and competitiveness through science and technology. New industrial sectors such as Biotechnology and renewable energy have been spot lighted as major new growth engines and this competitive situation is getting fiercer. Universities and research institutions in each country selected and announced the future promising technological field which will produce ripple effect in the future on a regular basis. In Korea, various research institutions continue to select and announce the promising technological fields. In this study, we would like to study the method to derive the promising technological field in the field of biotechnology spotlighted as a new growth engine by utilizing patent information. We would like to derive the major technological field by collecting domestic and international patents in the field of biotechnology using IPC code based technological classification and identifying bio technological trends utilizing text mining method for analysis of technological development trends with patents. Patent contour of US and Korea is compared and analyzed through analysis of text mining to derive the general technological development field in the field of biotechnology. After that, we would like to investigate research theme of promising biotechnology focused technological development through details on technological trends through in-depth analysis about technological field which draws interest more and more in Korea and other countries.

지식재산(IP)스타기업 육성 정책과 지식재산활동이 경영성과에 미치는 영향에 관한 연구: 2009년~2011년 스타기업을 중심으로

  • 본 연구는 특허청의 지식재산스타기업 육성 정책을 통하여 발굴 선정된 지역의 지식재산스타기업을 대상으로 지식재산활동이 기업의 경영성과에 긍정적인 영향을 미치는가를 분석하는데 목적이 있다. 이 목적을 달성하기 위하여 2009~2011년 지식재산스타 기업으로 선정된 16개 지역의 383개 기업에 대하여 정책을 지원한 전년도와 당해 년도의 지식재산활동 및 경영성과를 분석하여 지식재산스타기업 육성 정책의 필요성을 기업에 확산시키고, 더불어 지식재산 지원정책의 활성화 방안을 제시하고자 한다. 특허청은 2006년부터 지역 중소기업의 견실한 성장을 위하여 지식재산권 중심의 기술경쟁력을 강화하여 독점적 지위 확보와 새로운 시장 개척(First-mover)의 기반을 확충할 수 있는 방안으로 성장 잠재력과 기술력을 가진 지역의 유망 중소기업을 발굴하여 3년간 지식재산컨설팅 및 특허 디자인 브랜드 등에 대한 맞춤형 종합지원을 제공하여 지역의 대표기업으로 성장시키는 "지식재산스타기업 육성 정책"을 시행하고 있다. 이와 같은 지식재산스타기업 육성 정책 지원을 통한 기업의 지식재산활동 중 지식재산 출원건수와 지식재산 전담인력수가 기업의 경영성과에 긍정적인 영향을 미칠것이라는 가설을 실증분석한 결과, 기업의 지식재산 전담인력이 많은 기업들이 경영성과에 긍정적인 영향(매출액 증가)을 주는 것으로 나타났다. 따라서, 본 연구결과에서는 중소기업에서는 체계적인 지식재산경영을 위한 전담인력 확충 등 노력이 요구되며, 정부 및 관련기관에서는 지역의 대표적인 강소기업 육성을 위하여 기업의 지식재산 경쟁력을 강화할 수 있는 "중소기업의 지식재산 전담인력 양성 프로그램"을 확대하고 지식재산 전담인력 확충에 필요한 지원 정책의 필요성을 시사하고 있다. 본 연구 이후에는 지식재산스타기업의 연구개발(R&D) 투자와 수출역량 등 연구표본의 다양화를 통하여 중소기업의 지식재산경영 실태를 분석함으로써 지식재산 기반의 '글로벌 강소기업 육성 정책'을 수립하는데 실질적인 방안을 제시할 수 있는 연구과제가 실행될 수 있을 것이다.

A Case Study on the Overseas Patent Application Strategies of Korean Innovative Companies (사례를 통해 살펴본 기술혁신형 기업의 해외출원 전략)

  • In order to strengthen competitiveness of Korean companies in the intensifying global market, it is crucial to establish preemptive strategy for filing and securing overseas patent in connection with the company strategies. Therefore, this study conducted in-depth interviews with technology innovative companies such as bio-life, manufacturing industry, information and communication, and information service industries with overseas application experience. By analyzing overseas patent application strategy for selecting a patent application route and country, reducing costs, utilizing agents, and adjusting the timing of the examination request according to the internal and external environment of the company, the direction of establishing an overseas patent application strategy for companies considering the overseas market entry was suggested.

A Comparative Analysis of Convergence Types and Technology Levels of Polymer Technologies in Korea and Other Advanced Countries: Utilizing Patent Information (한국과 선진국 간 고분자 소재 기술의 융합 형태와 기술수준 비교 분석: 특허 정보의 활용)

  • Polymer materials are used in a wide variety of fields such as automobiles, aerospace, energy, IT, and as well as simple household products. Despite high interest in the technological convergence of polymer materials for the sustaining progress, there have been only limited analyzes on the topic. This research attempted to analyze the types of convergence and the level of technology in the polymer materials field. For this purpose, we collected patent information from the PCT database and implemented a co-classification analysis. The research shows that Japan and Korea have more section-level convergence whilst US and Europe focus on field-level convergence. In terms of the quality measured by patent activity, patent competitiveness, and patent effect, Korean convergence technologies seem to be inferior to those of other countries.

The impact on earnings patent technology transfer business performance of the Industry-Academic Cooperation Foundation (산학협력단의 특허실적이 기술이전사업 성과에 미치는 영향)

  • This study examines how the patent results of the University Academic-Industrial Cooperation influence technology transfer. Statistical analysis was performed by using 2013 panel data from the Ministry of Education and Science Technology(MEST) National Research Foundation of Korea(NRF) and the results are as follows. The results show that the patent result factors that have a positive effect on the total number of technology transfers are domestic patent application numbers, foreign patent application numbers, future technology(6T) patent application numbers, science technology patent application numbers. The factors that have a positive effect on increasing royalty are the total number of technology transfers. Domestic patent application numbers, future technology(6T) patent application numbers and science technology patent application numbers have a positive effect on patent results. The results implicate that more research and development is needed for more patents to be applied, that the main focus should be on future technology(6T) and science technology fields, and that effort should be directed at planning negotiation strategies for the term of the contract. However, this study is the need to research, including primary research is so patent performance may be limited in having only been considered in future studies of human and material resources and operating system factors that may be presented to the essential elements of the Industry-Academic Cooperation Foundation this raises.

Patent Valuation for Fair Royalty Distribution in Patent Pool (특허풀에서의 공평한 로열티 분배를 위한 특허가치평가)

  • In this paper, we discuss patent pool and a patent valuation scheme for fair royalty distribution among the patents in a pool. In the knowledge-based economy, intellectual capital-the accumulation of technology and know-how-is recognized as the most important source of company's competitive advantage and economic growth. By providing exclusive rights to patent holders, the patent system aims to encourage innovation-invention & commercialization of new technologies-in order to raise the standard of living. However, drawbacks of patent system, which occur as the number of patents issued increases rapidly and patent ownership is fragmented, may slow down the innovation efforts seriously. A promising solution is the patent pool approach, which was for instance employed by the U.S. congress during World War I to free the airplane manufacturers from the patent tangle by letting them license all the patents for a fee. It is necessary to figure out relative technological contribution of patent for fair distribution of royalty revenues among patent holders. The Rating/Ranking Method seems to fit to that valuation purpose. We examined technology valuation models from various organizations and selected a set of more influential valuation factors which can be incorporated as scoring criteria in the Rating/Ranking Method.

  • This study investigates the trend of the patent applications and the future direction of ICT in Gyeongbuk Province by employing patent portfolio analysis, one of the methodology of map analyses for industry-related ICT issues. Thus, this study aims to investigate the ICT development trend based on ICT patent information in Gyeongbuk Province. The promising technologies in ICT industry are extracted by applying patent portfolio analysis, one of the patent map analyses. The analysis results can be applied to the establishment of research and development strategies. This study extracts ICT trend by applying International Patent Classification to the patents registered in Gyeongbuk. For promising technologies, this study analyzed the patents based on the ICT Classification Code. Based on the analysis results, this study presents the trend of patent application, technology share, patent activity status, the trend of patent application by each technology according to ICT classification, the growth stages of ICT market, registration parties for patents, joint researches of research parties, and primary parties of patent applications. After drawing promising technologies, this study provides the future progress direction of ICT industry in Gyeongbuk Province. The research results also can be applied to securing technology competence and developing strategy of technology policy.

Quantitative Analysis of LTE Essential Patents (LTE 표준특허의 정량적 분석)

  • Patent information, which is generated under a specific, objective rule for a prolonged period of time, has the properties of technology, right, and management. Because of these characteristics of patents, patent analysis is used to identify R&D capacities and performances, and management strategies of a given nation or enterprise. In this paper, we analyze LTE essential patents which are key IPRs for implementing standardized LTE technology and major weapons in a global patent war. Total of 2,307 LTE essential patents, published and registered applications from European Telecommunications Standards Institute(ETSI)'s online IPR database as of January 2011, are analyzed in quantitative methods. The analysis results present status and statistics of LTE essential patents by major countries, applicant companies and technical fields. And a comparative study is done using 4 patent indices limited to the LTE essential patents issued in the United States. It is expected that results herein are useful for not only figuring out the technological competitiveness of countries and companies in LTE market, but also suggesting a guide to strategic IPR management for related industries.

A Study on the Relationship between Patenting Activity Factors and Company Performance of Korean IT Industry (국내 IT기업의 특허활동요인이 경영성과에 미치는 영향 연구)

  • Recently companies consider the patent activity as one of the critical factor for success in global economy even though one of the enterprise's competitiveness factor was productivity in past industry economy. Since there are so many patent dispute globally in IT industry, it is very important for companies to register and manage patents strategically. Therefore, this research analyze relationship between Financial result and 3 patent activity factors like productivity, effectiveness, and high-quality by investigating patent and financial data of 217 Korean IT enterprises. This paper get the following results after building research model and hypothesis based on resource-based theory and analysing the data sets using multiple regression model. First, effectiveness and high-quality of patents showed positive(+) effect on growth of total assets of IT enterprises. Second, three factors of patent activities do not have significant results with average increase rate of sales. Third, only high-quality of patents have positive(+) effect on average increase rate of net income. The differentiation factor of this research is that this paper categorized patent activity factors as quantitative and qualitative factors, and practically suggested strategic direction of patent activities of IT companies which face serious patent distribute globally.

Recast of the EU patent law system and its Lessons (유럽연합 특허시스템의 대대적 변혁과 그 교훈)

  • In 2013 a new era for EU patent law system was launched. The creation of the EU patent with unitary effect and the establishment of the Unified Patent Court established a new legal framework on substantive patent protection and patent litigation in Europe. This year the EU Patent Package would become a reality. It includes a regulation on a unitary patent, a regulation on the translation regime and an international Agreement on the Unitary Patent Court. In contrast to the classical European patent, the post-grant life of unitary patent will be governed by the newly created unified patent court and it will have unitary effect. In this article, I highlight the effect of the unitary patent and the jurisdiction of the unified patent court over unitary patents (and 'traditional' patents granted under the EPC that are not opted-out) for actions in relation to patent infringement or to revocation of a European patent and to licences of right. This article explores on the one hand the relation between national patent, the classical European patent and EU patent with unitary effect and on the other hand the relation of unified patent court to the Brussels $I^{bis}$ Regulation. Particular attention is paid to the institutional changes created by the unitary patent package abd the new supplementary forum that enables the UPC to hear disputes involving defendants from third States that relate to an infringement of a European patent and give rise to damage inside as well as outside the Union. Furthermore on the perspective North-east Asia this essay examines the lessons from the experiences of EU patent package.
