  • Deep-sea fishing vessel No. 501 Oryong was fully flooded through its openings and sunk to the bottom of the sea due to the very rough sea weather on the way of evasion after a fishing operation in the Bearing Sea. As a result, many crew members died and/or were missing. In this study, a full-scale ship flooding sinking simulation was conducted, and the sinking process was analyzed for the precise and scientific investigation of the sinking accident using highly advanced Modeling & Simulation (M&S) system of Fluid-Structure Interaction (FSI) analysis technique. To objectively secure the weather and sea states during the sinking accident in the Bering Sea, time-based wind and wave simulation at the region of the sinking accident was carried out and analyzed, and the weather and sea states were realized by simulating the irregular strong wave and wind spectrums. Simulation scenarios were developed and full-scale ship and fluid (air & seawater) modeling was performed for the flooding sinking simulation, by investigating the hull form, structural arrangement & weight distribution, and exterior inflow openings and interior flooding paths through its drawings, and by estimating the main tank capacities and their loading status. It was confirmed that the flooding and sinking accident was slightly different from a general capsize and sinking accident according to the simple loss of stability.

  • This paper was provided to apply the ITC-Hulls Clauses & ISM Code for the accident of sunken ship which was occurred by seamen's barratry. For the causes of the sunken accident, the underwriter insisted toot shipowner submerged the vessel intentionally for the purpose of the insured amounts, while shipowner protests toot the ship was submerged because of crews faults. In this connection, the judge sentenced toot this accident was caused by humans errors as the Provisions of 6.2.4 of ITC-Hulls, however shipowner is responsible for hiring onboard qualified seafarers and carrying out the due diligence for performing ISM Code for ensuring ship's safety and seaworthiness.

  • Deep-sea fishing vessel No. 501 Oryong was fully flooded through its openings and sank to the bottom of the Bering Sea. The tragic accident was attributed to rough sea weather after a fishing operation in the Bering Sea, and led to the death or loss of many crewmen. In this study, the ship stability calculation was carried out using KST-SHIP (ship calculation system of KST), considering the free surface effect and fish catch arrangement according to the progress of its sinking accident, and stability after flooding was analyzed. The calculation results obtained using KST-SHIP were verified by comparing them to intact stability calculation sheet of the accident ship under the full load departure condition, and intact stability according to displacement from the departure of accident ship up to the moment of the accident was calculated and analyzed. The stability after flooding was also calculated and analyzed according to the progress during its sinking accident.

  • The purpose of this article is to examine maritime accident and corporate criminal liability in comparison with cases and laws in UK and US. In Anglo-American law, a corporation can be convicted of and sentenced for a criminal offence. However, some theoretical difficulties lie in fixing a corporation with the appropriate mens rea. The Corporate Manslaughter and Corporate Homicide Act 2007 in England is to solve those difficulties and punish a corporation like a natural person. Comparing to Anglo-American law, a corporation is difficult to be punished in Korean law because it is a well recognized theory that only natural person is capable of committing a crime. However, safety in society and workplace is earning great concern in Korea, and emphasis is put on responsibilities of corporations. This article discusses the need for legislation on corporate manslaughter act in Korea with regard to the sinking of the MV Sewol.

  • Sunken vessels accidents have harmful impacts on the marine environment because of oils and chemicals in the vessels. The government has managed them and developed risk assessment which can evaluate potential risk quantitatively since 1999. But the grades of present risk assessment has changed greatly depending on quantity of remaining fuel oils, and the list of remaining fuel oils omitted in status report of sunken vessels. Therefore, the aim of the study is to estimate and develop model for quantity of remaining fuel oils and verify the remaining fuel estimation comparison with active vessels. To accomplish the purpose of the study, apply this verified estimation model to current risk assessment and recommend guideline for an accurate sunken vessels risk assessment.
