업무상 재해의 판례 - 운전자가 집 근처에 주차한 차량을 이용하여 업무장소로 가다가 발생한 교통사고는 업무상 재해이다

  • 운수 회사의 사업장 소재지나 이 사건 차량의 차고지 및 원고의 주거지 관계에 비추어 원고가 이 사건 차량 이외에 청주나 송탄사료공장까지 출 퇴근하는 방법이 있었다고 보이지 않고, 그에 따라 원고의 입사 당시 사업주가 이 사건 차량을 원고의 주거지 부근에 주차한 후 이를 이용하여 청주나 송탄사료공장으로 가서 사료를 공급받아 업무를 수행하도록 용인하였던 점, 그에 따라 이 사건 차량에 대한 관리 이용권이 전적으로 원고에게 전담되어 있었고, 원고의 주된 업무가 빈 화물차량을 운전하여 사료공장으로 가서 사료를 공급받은 후 각 양계농장에 사료를 운반 배송하는 업무로 이러한 업무내용이나 근무형태 등에 비추어 원고가 화물차에 탑승하여 운전을 개시하는 때로부터는 업무수행이 시작되어 사업주의 지배 관리하에 있다고 보이는 점(원고가 자택에서 이 사건 차량에 도착할 때까지가 출근에 해당하고, 그 이후 차량에 탑승한 이후에는 바로 업무의 개시가 있었다고 할 것이다) 등에 비추어 보면, 원고가 재해 당일 새벽 청주사료공장으로 가기 위하여 이 사건 차량을 운전하다가 발생한 이 사건 재해는 업무상 재해라고 봄이 상당하다.

  • Recently, interesting of U-city with ubiquitous computing technologies has increased and u-city services can improve people's quality of life. Among the u-city services, traffice service is actively developed in our lives. In this paper, we propose the business model and business model process in u-car tracking service. To propose the research purpose, we examined the prior business model and investigated u-car tracking information. And also, we draw scenario and used it to identify business model. To efficiently understand proposed business model, we built business model process of u-car tracking service. The results of study, we proposed business model and business model process with stakeholder, benefiter and value model. This study concludes with implications of the study results as well as limitations and future research directions.

  • 본 논문에서는 스마트폰을 이용하여 차량을 원격시동 제어 및 관리하는 원격시동 관리 시스템을 제안한다. 이 시스템은 고가의 차량을 관리 및 제어하는 시스템인 만큼 작동의 신뢰성을 중요시 한다. 그래서 기존의 소형 리모콘 방식의 차량 원격시동 제어관리 시스템을 활용하여 시스템 작동의 신뢰도를 높였으며, 기존의 소형 리모콘 제어 환경에서 스마트폰으로 옮겨옴으로써, 기존의 입력 및 제어의 불편함을 해결하였다. 그리고 기존 존재하는 블루투스와 CDMA를 사용하는 차량 원격시동 제어 관리 시스템의 거리 및 속도, 비용 등의 문제점도 개선하였다.

  • Vehicular communication networking is one of the most important building blocks of Intelligent Transportation System (ITS). The vehicular communication network is a wireless communication system enabling vehicles to communicate with each other as well as with roadside base stations. Mobility management of vehicles which move at high speeds and occasionally make a long journey is an interesting research area of vehicular communication networks. Recently, The Proxy Mobile IPv6 (PMIPv6) protocol is proposed for network-based mobility management to reduce the overhead of mobile nodes. PMIPv6 shifts the burden of the mobility management from mobile nodes to network agents to decrease the overhead and latency for the mobility management. In this paper, we derive the scenario of deploying PMIPv6 in vehicular communication networks and propose a new LMA handover mechanism for realizing the scenario. By carrying out the ns-2 based simulations, we verify the operability of the proposed mechanism.

Preventive Congestion Management Algorithm for Ubiquitous Freeway System (유비쿼터스 교통환경을 위한 연속류 정체예방관리 알고리즘)

  • The ubiquitous transportation system environments make it possible to collect each vehicle's position and velocity data and to perform more sophisticated traffic flow management at individual vehicle or platoon level through V2V and V2I communication. It is necessary to develop a new traffic management paradigm to take advantage of the ubiquitous transportation system environments. This paper proposed a preventive congestion management algorithm for uninterrupted flow, whose goal is to minimize the incident potential and maximize the productivity by maintaining traffic flow stability. The algorithm includes the following steps: Processing the raw data to produce the 3-dimension speed/flow/density profile and to produce the platoon profile and the shock wave profile, Determining the traffic state and the flow stability based on the processed data, Deciding the desirable speed the according the traffic flow state, and finally Providing the desirable speed information. It remains as further work to perform field experiments and calibrate the algorithm parameters.

  • In the present age, a vehicle works important part in our lives and economical domain that transport people, freights, and everything. And both of its number and value are increasing more and more. But user's convenience, control system could not be archived improvement than technological success. In this paper, we suggest some kinds of administrative agendas; simplifying executive processes, designing vehicle information system using by RFID which includes Ubiquitous skill and optical communication network. Especially, this paper suggests public vehicle control model which can simplify every executive processes of vehicle's life in the newest method. There are many kinds of RFID applicative products about transportation. And a dual invest should be interrupted for economical purpose. So this paper also proposes some way for problems of these types.

A Study on the Effectiveness of the Hazardous Chemical Transport Vehicle Management System (유해화학물질 운반차량 관리제도 실효성 연구)

  • Purpose: The effectiveness of the transport vehicle management system of the Chemical Substances Control Act will be studies and used as basic data for future system improvement plans. Method: After the enforcement of the Chemical Substances Control Act, the effectiveness for the transport vehicle management system was studies by comparing the transport plan, guidance and inspection status, safety training completion management, ect., and the reduction rate of chemical accidents. Results: The average number of chemical accidents in transport vehicles nationwide is 20 each year. And It is decreasing with the stabilization of the Chemical Substances Control Act('15.1.1). The first reason for the decrease in chemical accidents is the increase in submission of transport plans. Second, as the guidance and inspection rate increased every year, the shipper company's management of transport companies was naturally strengthened. Finally, it is judged that chemical accident caused by transport vehicles decrease through safety education. Conclusion: The current tranport vehicle management system of the Chemical Substances Control Act is effective. However, further research is needed to improve the practical and efficient transport vehicle management system.

  • 지능형 교통 시스템의 주요 인프라 중 하나인 VANET 은 차량과 인프라 간의 통신을 통해 교통을 예측함으로써 도로 상에서의 안전을 보장한다. VANET 은 모든 노드가 네트워크에 가입할 수 있는 개방형 네트워크이기 때문에 개인 정보 보호가 주된 관심사이다. 분산형 신뢰 관리 시스템은 차량 네트워크에서 수신된 메시지가 신뢰할 수 있는 지에 대한 여부를 결정함으로써, 악의적인 공격자로부터 차량을 지킬 수 있다. 분산형 k-익명성 체계와 블록체인을 결합한 신뢰 관리 시스템은 주변 차량들과 협력하여 익명의 은폐 영역을 구축한다. 본 논문에서는 블록체인을 적용한 분산형 신뢰 관리 시스템을 통해 차량의 위치 정보를 보호하는 최근 연구들을 살펴본 뒤에 향후 발전 방향에 대해 논하도록 하겠다.

Traffic Flow Management under Ubiquitous Transportation System Environments (유비쿼터스 교통 환경하에서 교통류 관리구상)

  • It is crucial in traffic flow management to maintain productivity and the traffic stability at the same time especially under congested traffic conditions. This issue has not been explicitly addressed under the intelligent transportation system environments. However, the ubiquitous transportation system environments make it possible to collect the data for each vehicle's position and velocity and to perform more sophisticated traffic flow management at individual vehicle or platoon level through V2V and V2I communications. In this paper, a preventive traffic flow management scheme is proposed, in which the objective is to maintain traffic flow stability while the productivity of the system is not decreased. The management scheme is proposed based on Greenshield's model because it is simple and easy to handle. It is considered that further research should be performed to evaluate the various traffic flow models.
