비약적인 기술발전과 각국간의 시장개방에 따라 표준화를 추진하는 각국의 정책에도 많은 변화가 오고 있다. 종래의 표준화는 국제통신망간 또는 사업자 통신망간의 상호접속성을 위주로 하여 표준화가 진행되었다. 그러나 현재의 표준화 추세를 보면 개발된 기술을 표준으로 유도함으로써, 시장선점의 무기로 삼는 것이다. 이에 따라, 선진국에서는 기술개발에 대한 지적재산권의 보호를 점점 강화해 가고 있다. 이제 표준화와 지적재산권은 밀접한 관계를 가지게 되었으며, 이에 따라 선진 각국에서는 표준화를 추진함에 따른 지적소유권의 취급에 대한 방침을 설정해 놓고 있다. 표준화 사항에 일부 또는 전부가 포함되는 특허사항은 소유권자의 의지에 따라 표준화를 좌지우지하게 된다. 무상으로 특허의 사용을 허락하는 경우 또는 공정 타당한 조건으로 사용을 허락하는 경우에는 표준화의 추진이 가능하나, 그 이외의 경우에는 표준화 추진의 전반적인 사항에 대해 재검토를 필요로 하게 된다. 이러한 사항은 국제표준화기구나 선진 각국의 표준화기구에서도 거의 비슷한 방법으로 규정이 되어 있다. 우리나라에서도 국내 및 국제 표준화활동에 활발히 참여하는 사람이 많아짐에 따라, 표준화과정에서 일어날 수 있는 지적재산권과의 마찰 문제에 대해 어떻게 대처할 것인가를 숙고해 볼 시기가 온 것 같다. 이에 이본의 전기통신분야 표준화 기관인 ''사단법인 전신전화 기술위원회(TTC)''의 공업소유권에 대한 지침 등을 소개함으로써 이에 대한 관계자 여러분들의 이해를 돕고자 한다.

Global commerce is apparently here to bind Korean firms as well as Koreans. The advertising, buying and selling of goods and services recognizes no borders. As a result, enforcing territorially based trademark rights has become ever more challenging. Remote trademark owners who peacefully coexisted in a time before the internet and increasing globalism are now bumping heads. The internet also has made it easier for unscrupulous operators to deceive consumers and divert customers from established businesses by misappropriating trademarks on web-sites and in domain names. U.S. federal courts have been willing to help American businesses halt trademark infringements that reaches outside the United States. This is particularly true for e-business, via the internet, and the trend toward enforcement seems to be in favor of the trademark owner. This article discusses this trend as well as the extraterritorial enforcement of trademark rights by U.S. courts under the Lanham Act. It also offers suggestions for protecting valuable trademark rights worldwide. This paper will contribute to global Korean firms and Koreans who carefully read arguments in this valuable literature.

인터넷 사용자의 폭발적 증가와 콘텐츠 제공업체의 범람은 지적재산권 보호에 관심을 갖게 하였다. 본 논문에서는 지적재산권을 보호할 수 있는 기밀성을 보장하는 키관리 시스템을 제안하고 실시간 데이터의 특성을 수용하여 효율적인 멀티미디어 전송을 보장할 수 있는 암호화 기법인 선택적 암호화 기법을 제안한다. 또한 제안한 기법을 바탕으로 멀티미디어 데이터 서비스에 적합한 DRM시스템 모델을 제안한다.

디지털 컨텐cm의 지적 재산권 보호를 위한 디지털 워터마킹 기술 및 핑거프린팅의 연구가 활발히 진행되고 있다. DRM(Digital Rights Management)는 디지털 컨텐츠 지적 재산권 보호뿐만 아니라 컨텐츠 에 대한 출판, 유통 및 사용에 필요한 관리와 보호체계이다. 본 논문에서는 컨텐츠 보호 기술 중에서 컨텐츠에 대한 유통/서비스에 해당하는 기술을 만족하는 프로토콜을 제시한 것이다. 이를 위해 컨텐츠 불법복제 빛 불법사용을 방지할 수 있도륵 Agent를 이용한다. Agent는 특별한 설치가 필요 없이 컨텐츠 내에 내포되어 있게 된다. 내포된 Agent는 불법복제 및 불법사용에 대해 체크함으로써 불법복제의 사용을 차단할 수 있도록 한다.

The protection of intellectual property right in international conventions are worldwide or regional areas already exists a century. Therefore, our country is positive affiliated with international conventions. After that time, such as a violation of international convention and an example of imitations are continually that we prognosticate the international trade market activities was difficult not only became an issue of country credit risk. At this point, the major purpose of this study make an analysis of both paralleled with the case study follow an example and the comprehension with concerned about recognition of intellectual property right. In additionally, it stands a plan of package design protections under the WTO systems. This study have carried out a theoretical and practical analysis of intellectual property right and statistical analysis through the inside and outside of the country packaging design study and a case study of troubles with intellectual property. Besides, it is accomplish the purpose of the study that established exploratory study survey about inside and outside of the country packaging design infringement case study and relative package design industry employees with consumptions real research. I hoped that this study will be a foundation on which packaging, design industry protections to intellectual property right.

According to the rapid development of IT technologies, between different technologies and weakness of entry barriers, standardization for interoperability and intercompatibility is being recognized as a core strategy for preoccupation of global IT market and strengthening of national competitive power. Recently IPR(Intellectual property Rights) including patents is considered indispensably in international standardization. Also advanced countries strengthen their positions through preemption of global IT market by linking their IPR with international standardization. Therefore relationship between IPR and standardization is being changed to mutually complementary from mutually exclusive. In this paper, we will examine ITU-T's IPR policy and related discussion trends in ITU-T and try to find national policy for IPR related issues.

산업이 발전함에 따라 지적재산권에 대한 가치는 점점 중요해지고 있고, 기업의 흥망성쇄를 결정짓는 가장 큰 요인중 하나로 자리잡고 있다. 엄청난 비용을 투자하여 사업화하고 있던 세계 굴지의 기업들도 경쟁회사의 핵심특허 단 몇 건만으로 순식간에 몰락하는 경우도 발생하고 있다. 이제 지적재산권은 살아남기 위한 유일한 방어수단이자 공격수단이 되었다. 이와 같은 급박한 상황하에서 각 기업은 경쟁회사의 지적재산권을 분석하고, 이를 통해 자사의 연구개발 전략을 수립하기 위해 노력하고 있다. 그러나 이와 같은 분석작업은 다수의 전문가 일지라도 상당한 시일이 소요되는 방대한 작업이며, 이를 자동으로 실행하기 위해 많은 소프트웨어 회사들은 특허분석용 툴을 개발하였다. 그러나 이들 종래의 특허분석용 툴들은 대부분 외형적인 정량분석 정보만을 제공할 뿐, 실제 필요로 하는 정성적인 정보는 거의 제공하지 못하였다. 즉, 종래의 특허분석용 툴에서는 자사 및 경쟁사의 특허에 대한 가치가 어느 정도이며, 경쟁회사 특허에 대해 자사 제품의 칭해 가능성은 어느 정도이며 회피할 수 있는 전략은 무엇인지, 자사 특허에 대한 경쟁사 제품의 침해 가능성은 어느 정도인지 등을 제공하지 못하였다. 이에 본 논문에서는 특허 출원시 인용했던 선행특허들의 인용 관계를 분석하여 특허간 관계를 규명하고, 각 기술 분야에서 영향력이 높은 특허를 찾는 방법과 시스템을 제시하고자 한다.

Beyond the digital world from the analog age, the contents are very easily copied under the illegal conditions and these are rapidly distributed by the information super highway. The increase of illegal usage and conflict in digital content market would diminish motivation of creators for their work, furthermore break down digital content market on cyberspace. Watermarking technology support to the legal users by the protection technique based on the digital content copyright protection method(DRM). Most of previous digital watermarking have embeded to the content. In this paper, we researched the standardization of digital rights management and developed more efficient watermark embedding method.
