The Main Contents and Developmental Method of Arbitration Industry Promotion Law (중재산업진흥법의 주요내용과 발전적 운용)

  • Arbitration, a form of alternative dispute resolution (ADR), is a technique for the resolution of disputes outside the courts. Parties often seek to resolve disputes through arbitration because of a number of perceived potential advantages over judicial proceedings: Arbitration is generally faster and more inexpensive (cheaper) than litigation in court. The Republic of Korea enacted the "Arbitration Industry Promotion Act" to develop arbitration. This law provides for the establishment and operation of arbitration institutions, training of arbitration experts, and support of arbitration studies and international exchanges. Effective operation of an arbitration institution has an important influence on the development of arbitration. Neutral and good arbitration experts improve the authority of arbitration. The academic study of arbitration theoretically develops the arbitration procedure. In addition, this paper referred to some additional factors that South Korea should have in order to become an attractive place of arbitration. Neutrality and fairness of the court of arbitration are highly important factors in arbitration. Therefore, the arbitration institution should be operated independently and clearly from the government to ensure neutrality and fairness. The parties of arbitration should also be free and able to defend their interests sufficiently in the arbitration proceedings. Lastly, coordination between this law and other laws is necessary.

Suggestions for Establishing the Second Basic Plan for Promotion of Arbitration Industry (제2차 중재산업 진흥 기본계획 수립을 위한 제언)

  • The Korean government has enacted the Arbitration Industry Promotion Act, which aims to foster the arbitration system as an industry, strengthen national competitiveness, and systematically provide government support so that the arbitration industry can become a future growth engine, and has been in effect since June 28, 2017. In accordance with Article 3 of the Arbitration Industry Promotion Act, the Minister of Justice must establish and implement the Basic Plan for the Promotion of the arbitration industry every five years to promote the arbitration industry. Accordingly, the Ministry of Justice established the "Basic Plan for the Promotion of the Arbitration Industry" (2019-2023) at the end of 2018, which has been in effect since January 1, 2019. This study first reviews and evaluates the domestic arbitration sector performance of the first basic plan, then reviews and evaluates the international arbitration sector performance of the first basic plan, and finally suggests what tasks to focus on when establishing the second basic plan for Promotion of Arbitration Industry.

  • 항공운송산업은 여객운송과 화물운송 등에 있어서 그 비중이 계속적으로 증가하여 왔으며 다양한 산업 및 기업들과 연관되어 있다. 그런데 항공운송산업에서 파업이 발생한다면 이를 대체할 만한 수단이 없어 항공사가 막대한 손실을 입을 뿐만 아니라 파업의 연쇄효과로서 적기납품 곤란으로 인한 수출관련 기업에의 타격, 관광 등 연관산업에의 악영향, 기업 및 국가 신인도 하락, 국민생활의 불편과 사회불안 등을 야기시킨다. 이렇듯 항공사 파업에 의한 경제 손실규모가 일반 사업장과는 비교가 안 될 만큼 막대하기에 국가적 차원에서 논의되어야 할 필요가 있다. 현생법상 항공운송산업은 공익사업으로서 노동부장관의 긴급조정 결정으로 노동쟁의를 해결할 수 있게 되어있다. 그러나 긴급조정 제도는 발동요건상 활용에 어려운 점이 많아서 경영계는 직권중재제도의 도입을 주장하고, 노동계는 직권중재 및 일방중재신청제도의 폐지를 주장하고 있으며, 정부는 새로운 대안으로서 최소업무 유지 의무 제도 도입 등을 고려하고 있으나 항공운송산업이 갖는 특수성, 공공성과 국민경제에 미치는 영향을 고려해 볼 때 필수공익사업 지정과 직권중재의 활용이 더 적절한 방법이라고 보여지며, 남용방지를 위해 회부요건·절차 등은 법률로 명시할 필요가 있다. 만일 직권중재제도가 폐지되고 최소업무 유지의무 제도가 도입된다면 항공운송산업이 그 대상업무에 반드시 포함되어야 한다.

필리핀의 중재제도 고찰 (OVERVIEW OF ARBITRATION IN THE PHILIPPINES)

  • 필리핀의 중재제도를 규정하고 있는 법령은 다음과 같다. 즉 필리핀 민법(법률 제386호), 중재법(법률 제876호), 대체분쟁해결법(법률 제9285호), 국제상거래중재에 관한 국제 연합 국제상거래법위원회(UNCITRAL) 표준법 및 건설산업중재에 관한 대통령령(제1008호)이다. 2004년의 대체적 분쟁해결 제도(ADR) 에 관련된 필리핀 의회의 입법은 필리핀의 중재 실무와 절차에 광범위한 변화를 가져 왔다. 또한 국제중재실무에서 필리핀에 많은 도움을 주었다. 다른 한편으로는 상당한 변화를 가진 UNCITRAL 표준법의 채택과 국내 중재를 관장하는 법률속에 표준법 조항을 편입함으로써 필리핀은 분쟁해결의 대체안으로써 정책 결정의 실행에 대한 중재법의 인식과 ADR법에 있어서의 정책조문의 검토로 보다 실질적인 중재제도가 정착되는 기반을 조성하게 되었다. 국내에서 수행하고 있는 국제적인 중재는 아직까지는 비교적 적다고 생각된다. 그러나 ADR법 내에 규정된 강력한 ADR찬성정책과 ADR에 관대하고 특히 중재에 호의적인 대법원의 친중재적 판결로 인해 향후 수년내에 필리핀과 주변국과의 무역이 크게 증대될 것으로 전망된다.

An Integrative Review of Non-pharmacological Intervention for Constipation in the Elderly in Korea (국내 노인을 대상으로 한 변비 비약물적 중재에 대한 통합적 문헌고찰)

  • The purpose of this study is to provide evidences throught integrative review of non-pharmacological intervention studies for constipation in the elderly in Korea. Through the domestic search engines RISS and KISS, eleven studies were selected by searching for theses and academic journals published in Korea from 2010 to January 2023. According to the study result, relevant studies were 11, and non-pharmacological interventions included abdominal massage, foot massage, acupressure, moxibustion, lifestyle intervention, carbonated water intake, and complex therapy. Constipation, sleep quality, and depression were confirmed as effects of the intervention. However, there is no study confirming the quality of life related to constipation in the elderly, so it is necessary to develop and apply a non-pharmacological intervention program for constipation considering the quality of life of the elderly.

Suitability of Arbitration Regarding Types of Disputes in the Fashion Industry (패션산업의 분쟁 유형에 따른 중재적합성)

  • The fashion industry has been growing in Korea, but the law and the dispute resolution have been less than effective so far. Copyright and patent law have proven only minimally effective in fashion, ending up with designers and fashion companies relying on their trademarks to protect their design. Litigating trademark disputes in the fashion industry presents a host of problems and leads to resorting to the Alternative Dispute Resolution (ADR). ADR methods, especially arbitration, however, are emerging as substitutes to litigation. Using these methods, the fashion industry should sincerely consider a self-regulating program in which its members-both fashion designers and corporations alike-can resolve disputes in a manner mutually beneficial to all parties in order to preserve the industry's growth, solidarity, and esteem. From 2016, KCAB's Fashion Industry Dispute Advisory Committee (FIDAC) for ADR has promoted a better solution for disputes in the fashion industry. Therefore, stakeholders in the fashion industry should commit to procuring innovation in fashion on a long-term basis by establishing a panel handling an alternate dispute resolution process. The ADR process can mitigate the uncertainty created by relevant legislation or any other disputes, which could result in shying away from any business in the fashion industry.
