정부는 하도급대금 및 건설기계대여대금 체불로 인한 하도급업체 및 건설기계대여업체의 피해를 예방하기 위해 지난 2월 3일 건설산업기본법 제34조 제7항 및 제68조의3 제6항을 개정하고 8월 4일부터 시행키로 했다. 이에 따라 국가 지방자치단체 및 공공기관 발주자는 8월 4일부터 하도급대금 지급보증서 및 건설기계대여대금 지급보증서의 교부 여부를 의무적으로 확인해야 한다.

In the event of a housing sale guarantee accident, the Housing and Urban Guarantee Corporation shall be responsible for the guarantee by refunding the moving-in money unless there are special circumstances to the contractor. The Housing and Urban Guarantee Corporation may refuse to perform the refund based on the Terms and Conditions Regulations Act, but disputes continue to arise between interested parties in this regard. Therefore, the purpose of this study is to study the problems and improvement measures for legal issues related to the implementation of the refund. First, the issue of guarantee effectiveness and scope of guarantee under the Terms and Conditions Regulation Act. Second, the problem of guarantee contract for conditional third parties of Housing and Urban Guarantee Corporation. Third, the problem of the attitude of the existing precedents of the Supreme Court was examined. As a result of reviewing these legal issues, it was confirmed that the interpretation of terms and conditions according to the implementation of the refund is being interpreted in accordance with the principle of good faith, but according to individual cases, precedents can be divided into positive and negative judgments. In addition, despite the fact that the housing pre-sale guarantee is a guarantee contract for a conditional third party, it was confirmed that the buyer suffered damages in good faith through active disputes with the interested parties. Accordingly, the Housing and Urban Guarantee Corporation proposed an improvement plan for roles and cooperation items to meet the purpose of establishment for the stability of the customer's housing.

As the coverage of Web services become wider and the number of implementation cases is growing, the importance of applying the Web services quality model to real world is increased. For maintaining the level of Web services qualify, it should be required to study on assurance method of Web services qualify level. Assurance for Web services, which is newly proposed by OASIS TC, means the totality of activities for managing the quality level of them. For managing Web service quality, Web service associates could usually use SLA(Service Level Agreement) method in which a service consumer contracts for some service level with a service provider and gives for penalty or pays incentives according to the result of evaluation of services. But, there are some difficulties in applying SLA to Web services, because Web services have publicity, multiple users, and 3rd party for management. So, we need a new assurance method for Web service by considering the characteristics of Web services. This paper provides the new concept of committed assurance level for Web services. This concept can be defined as the set of maximum level of quality expected by each user, which provide the consistent view of Web service quality. This paper presents the method for duality associates to preserve some quality level of Web service by using this concept.

공정거래위원회가 하도급계약 추정제에 따른 통지나 회신 방법 규정, 기술재료의 정의 등을 골자로 하는 '하도급거래공정화에관한법률시행령' 개정안을 마련하고 지난 7월 26일부터 시행에 들어갔다. 하도급계약 추정제는 하도급거래에서 수급사업자를 보호하기 위해 수급사업자가 구두로 맺은 계약에 대해 확인을 요청할 때 원사업자가 15일 이내에 이를 부인하지 않으면 계약이 있었던 것으로 추정하는 제도이다. 공정위는 또 수급사업자가 원사업자에게 위탁을 받은 작업의 내용과 하도급대금, 위탁받은 일시, 원사업자와 수급사업자의 사업자명과 주소 그밖의 원사업자에게 위탁한 내용 등으로 정했다. 개정된 하도급법에는 원사업자가 수급사업자에게 기술자료를 제공하도록 강요하지 못하도록 기술자료의 범위도 정했다. 또한 상습적으로 법을 위반하는 사업자의 명단을 공개하는 기준도 마련됐다. 명단 공개 기준은 최근 3년간 벌점이 4점을 초과한 자로서, 사업자명과 대표자, 사업장 주소 공개와 함께 공정위 인터넷 홈페이지에 이를 게시할 때는 그 기간을 1년으로 했다. 이와 함께 입찰명세서와 낙찰자결정 품의서, 견적서, 현장설명서, 설계설명서 등 하도급대금결정 관련서류를 의무적으로 보존토록 하고 하도급대금 지급보증기관에 소방산업공제조합을 추가해 원사업자의 지급보증기관 선택 범위를 확대했다.

After several collapse accidents of large structures in the early 1990s in Korea, the government enacted a law that architectural, engineering and construction firms are obliged to have insurance for projects over a certain size. Particularly, with regard to insurance in design and construction supervision works (i.e. engineering insurance), although several operation-based problems were pointed out from practitioners, still little research has been done on analyzing current regnlartory and operational state and suggesting policy alternatives. Hence, this study applies Delphi technique to solicit current operational problems and propose a series of improvements on engineering insurance based on interview surveys targeting major market participants: municipalities, engineering firms, and insurance companies. Key findings culminate in adopting guarantee limits based on credit evaluation, abrogating joint surety, covering a loss of life, increasing insurance entrance fee, extending time covered, and etc. Reaching a consensus on the proposed alternatives between the market participants will form the foundation for sound developments of construction design and engineering industry.

품질보증 활동은 제품의 품질등급을 그 규격기준에 따라 규정하고, 발주자가 지정하는 품질의 제품을 실현하는 것이지만, 압력용기 등의 특정 제품에 대해서는 공적인 제3자가 기관에 의한 검사 인증제도가 요구되는 경우가 있다. 미국에서는 압력용기 등의 규격체계는 민간 Base의 ASME Code를 중심으로 하고, 운용에 있어서의 품질보증제도는 ASME Stamp에 의한 제작공장 인증과 적검사기관을 대행하는 보험회사와의 협조에 의한 개별제품인증이 행해진다. 소위 체제 지향의 품질 관리방식을 채택하고 있다. 미국 외의 구라파제국의 이와는 상대적으로 제품지향의 제품질관리를 하였다고 할 수가 있다. 그러나 87년에 제정되어 세계적으로 확산되고 있는 ISO-9000 시리즈는 미국식의 체제지향의 품질관리로서 양자간 접근방식이 대동소이하다. 그러므로 ASME Code의 품질관리에 대하여 그 본질과 구조 및 활동 내역 등을 고찰해 보는 것은 품질관리의 시대적 조류 파악에 도움이 될 것이다.

본고는 기업 내부의 경영자와 일단 투자자들 사이에 정보 비대칭이 존재하는 기업 공개 시장에서 신주의 저평가 현상을 완화하는 제3자의 보증 역할에 관한 연구이다. 일찍이 Megginson and Weiss(1991), Hamao, Packer and Ritter(1998) 등의 연구에 의하면 미국, 일본 등의 경우 벤처 캐피탈의 지원을 받는 벤처 기업이 그렇지 않은 경우에 비해 신주 저평가 현상이 비교적 적게 나타나 벤처 캐피탈이 일정한 명성 효과를 발휘하는 것으로 보고되고 있다. 그러나 남명수(1993), 이기환, 임병균, 최해술(1998) 등의 실증 분석에 의하면 국내 벤처 기업의 경우에는 그렇지 않은 것으로 보고되고 있어 벤처 캐피탈의 보증 역할이 미미한 것으로 나타난 바 있으나 이들의 연구는 KSE 시장의 신규 벤처 기업들을 대상으로 하였기 때문에 최근 KOSDAQ 시장에서의 벤처 기업의 신규 등록이 활발해지면서 벤처 캐피탈의 보증 역할에 관한 연구는 재검토를 요구하고 있는 실정이다. 본 연구는 96년 7월 이후 KOSDAQ 시장에 등록되어 있는 기업 중 벤처 캐피탈의 지원을 받은 34개의 벤처 기업과 그렇지 않은 34개의 벤처 기업을 대응 추출하여 구성한 표본에 대해 신주의 등록 초기의 시장초과 수익률을 분석하여 신주 저평가 현상을 살펴보고 각 기업의 수익률과 공모 잔량에 대한 회귀분석을 통하여 벤처 캐피탈의 보증역할을 규명하였다. 본 연구 결과는 현재 KOSDAQ 시장에서 벤처 캐피탈의 보증 역할은 거의 나타나지 않았으며 상장 직전의 세후이익과 전체적인 시장 상황만이 수익률과 공모 잔량에 영향을 주는 것으로 나타났다. 이러한 연구 결과는 기존의 KSE 시장에서의 벤처 캐피탈의 보증 역할에 대한 연구 결과와 유사한 것으로 미국 등 선진 시장의 연구 결과와는 달리 국내 벤처 캐피탈의 KOSDAQ 시장에서의 미미한 역할을 입증하는 실증 결과라고 할 수 있다.

The construction guarantee market is a rear market affected by changes in the construction industry and market. As the restructuring of the construction industry's production system is being carried out, such as the abolition of regulations on business field between general and specialty contractors, major changes are expected not only in the construction market but also in the construction guarantee market. In construction guarantee market, there are currently three Contractor Financial Cooperatives, which are divided based on business field and business type(General, Specialty and Plant & Mechanical). The abolition of business field regulation will have various effects on construction guarantee market, such as forming a competitive structure among the three Contractor Financial Cooperatives. Therefore the role of the construction guarantee institutions are also required to change. This study predicted the changes in the construction guarantee market after the restructuring of construction industry and analyzed the ripple effect on the market. This study reviewed the details of the reorganization plan on the construction industry, policies and statistical data related to construction guarantee, and lastly conducted the survey on each member of the three Contractor Financial Cooperatives to analyze the usage behavior in the future guarantee market. Based on the result of this study, the members of both the General Contractor Financial Cooperative and Specialty Contractor Financial Cooperative are not willing to change the existing institutions, but a lot of them are expected to use other institutions in duplicate. The members of the Plant & Mechanical Contractor Financial Cooperative are most willing to use other guarantee institutions.

Zipper manufacturing belongs to the small and medium industry. And it requires very accurate process and perfect quality control. In addition it is necessary to assure customers zipper qualify to explore new market. TQC as well as integration of existing quality control techniques for accurate and perfect processing should be implemented to assure product quality. To implement TQC zipper firms should invest in education programs for employees. Y zipper firm has succeeded in implementing the education program for TQC and Quality Circle and achieved the perfect quality control and quality assurance of products.
