The Welfare Investment of the National Pension Funds: Its Necessity and Policy Development (국민연금기금의 복지사업 당위성과 정책방향 연구)

  • The use of the national pension funds to welfare has been criticized due to its low profitability, with concern about financial instability and the lack of funds. Despite the small amount of the funds employed to the welfare, therefore, it has been decreasing so far. It is resulted from the fact that the use of funds to the welfare sector failed to provide its valid reasons, and take the policy direction firmly. There are three main logical reasons for the welfare investment of national pension funds: Firstly, no state is capable to take the full responsibility for the entire social welfare, and therefore, the funds can be used for social welfare. Secondly, the funded system, contrasted with the case of pay-as-you-go system, has inevitably caused discriminations to the present elderly through excluding them institutionally from pension participation. At last, so as to its selective system, the minimum contribution period of 10 years brings about the equity problem between the people who can afford it and the people who hardly can. Therefore, investing a proportion of funds to the welfare is entirely reasonable in that it can alleviate the discriminations to the present elderly generation and the marginal participants, rather than to meet their social welfare needs. With regard to the policy decision, the profitability of the investment, and the choice of the welfare work, on the other hand, the policy direction should be given a sufficient consideration of a various policy factors such as the necessity of social consensus, independence of the welfare work in relations with other national welfare work, policy identity to judge whether the work is worth long-run or short-run, and the reliance of direct-operated work and indirect-operated work. As a result of all these efforts above mentioned, an investment to the welfare of the national pension funds could be vitalized, and gain public confidence.

A Study on Legal and Institutional Improvement Measures for the Effective Implementation of SMS -Focusing on Aircraft Accident Investigation-

  • Even with the most advanced aviation technology benefits, aircraft accidents are constantly occurring while air passenger transportation volume is expected to double in the next 15 years. Since it is not possible to secure aviation safety only by the post aircraft accident safety action of accident investigations, it has been recognized and consensus has been formed that proactive and predictive prevention measures are necessary. In this sense, the aviation safety management system (SMS) was introduced in 2008 and has been carried out in earnest since 2011. SMS is a proactive and predictive aircraft accident preventive measure, which is a mechanism to eliminate the fundamental risk factors by approaching organizational factors beyond technological factors and human factors related to aviation safety. The methodology is to collect hazards in all the sites required for aircraft operations, to build a database, to analyze the risks, and through managing risks, to keep the risks acceptable or below. Therefore, the improper implementation of SMS indicates that the aircraft accident prevention is insufficient and it is to be directly connected with the aircraft accident. Reports of duty performance related hazards including their own errors are essential and most important in SMS. Under the policy of just culture for voluntary reporting, the guarantee of information providers' anonymity, non-punishment and non-blame should be basically secured, but to this end, under-reporting is stagnant due to lack of trust in their own organizations. It is necessary for the accountable executive(CEO) and senior management to take a leading role to foster the safety culture initiating from just culture with the safety consciousness, balancing between safety and profit for the organization. Though a Ministry of Land, Infrastructure and Transport's order, "Guidance on SMS Implementation" states the training required for the accountable executive(CEO) and senior management, it is not legally binding. Thus it is suggested that the SMS training completion certificates of accountable executive(CEO) and senior management be included in SMS approval application form that is legally required by "Korea Aviation Safety Program" in addition to other required documents such as a copy of SMS manual. Also, SMS related items are missing in the aircraft accident investigation, so that organizational factors in association with safety culture and risk management are not being investigated. This hinders from preventing future accidents, as the root cause cannot be identified. The Aircraft Accident Investigation Manuals issued by ICAO contain the SMS investigation wheres it is not included in the final report form of Annex 13 to the Convention on International Civil Aviation. In addition, the US National Transportation Safety Board(NTSB) that has been a substantial example of the aircraft accident investigation for the other accident investigation agencies worldwide does not appear to expand the scope of investigation activities further to SMS. For these reasons, it is believed that investigation agencies conducting their investigations under Annex 13 do not include SMS in the investigation items, and the aircraft accident investigators are hardly exposed to SMS investigation methods or techniques. In this respect, it is necessary to include the SMS investigation in the organization and management information of the final report format of Annex 13. In Korea as well, in the same manner, SMS item should be added to the final report format of the Operating Regulation of the Aircraft and Railway Accident Investigation Board. If such legal and institutional improvement methods are complemented, SMS will serve the purpose of aircraft accident prevention effectively and contribute to the improvement of aviation safety in the future.

The Jurisdictional Precedent Analysis of Medical Dispute in Dental Field (치과임상영역에서 발생된 의료분쟁의 판례분석)

  • Along with the development of scientific technologies, health care has been growing remarkably, and as the social life quality improves with increasing interest in health, the demand for medical service is rapidly increasing. However, medical accident and medical dispute also are rapidly increasing due to various factors such as, increasing sense of people's right, lack of understanding in the nature of medical practice, over expectation on medical technique, commercialize medical supply system, moral degeneracy and unawareness of medical jurisprudence by doctors, widespread trend of mutual distrust, and lack of systematized device for solution of medical dispute. This study analysed 30 cases of civil suit in the year between 1994 to 2004, which were selected among the medical dispute cases in dental field with the judgement collected from organizations related to dentistry and department of oral medicine, Yonsei university dental hospital. The following results were drawn from the analyses: 1. The distribution of year showed rapid increase of medical dispute after the year 2000. 2. In the types of medical dispute, suit associated with tooth extraction took 36.7% of all. 3. As for the cause of medical dispute, uncomfortable feeling and dissatisfaction with the treatment showed 36.7%, death and permanent damage showed 16.7% each. 4. Winning the suit, compulsory mediation and recommendation for settlement took 60.0% of judgement result for the plaintiff. 5. For the type of medical organization in relation to medical dispute, 60.0% was found to be the private dental clinics, and 30.0% was university dental hospitals. 6. For the level of trial, dispute that progressed above 2 or 3 trials was of 30.0%. 7. For the amount of claim for damage, the claim amounting between 50 million to 100 million won was of 36.7%, and that of more than 100 million won was 13.3%, and in case of the judgement amount, the amount ranging from 10 million to 30 million won was of 40.0%, and that of more than 100 million won was of 6.7%. 8. For the number of dentist involved in the suit, 26.7% was of 2 or more dentists. 9. For the amount of time spent until the judgement, 46.7% took 11 to 20 months, and 36.7% took 21 to 30 months. 10. For medical malpractice, 46.7% was judged to be guilty, and 70% of the cases had undergone medical judgement or verification of the case by specialists during the process of the suit. 11. In the lost cases of doctors(18 cases), 72.2% was due to violence of carefulness in practice and 16.7% was due to missing of explanation to patient. Medical disputes occurring in the field of dentistry are usually of relatively less risky cases. Hence, the importance of explanation to patient is emphasized, and since the levels of patient satisfaction are subjective, improvement of the relationship between the patient and the dentist and recovery of autonomy within the group dentist are essential in addition to the reduction of technical malpractice. Moreover, management measure against the medical dispute should be set up through complement of the current doctors and hospitals medical malpractice insurance which is being conducted irrationally, and establishment of system in which education as well as consultation for medical disputes lead by the group of dental clinicians and academic scholars are accessible.

Estimation and evaluation of irrigation water need using net water consumption concept in Jeju Island (순물소모량 개념에 의한 제주도 농업용수 수요량 산정 및 평가)

  • In order to estimate the demand for water resources planning and operation, methodology for determining the size of water supply facilities has been mainly applied to agricultural water, unlike living and industrial water, which reflects actual usage trends. This inevitably leads to an overestimation of agricultural water and can lead to an imbalance in the supply and demand of each use in terms of the total water resources plan. In this study, the difference of approaches of concept of net consumption was examined in comparison with the existing methodology and the characteristics of agricultural water demand were analyzed by applying it to whole Jeju Island. SWAT model was applied to estimate the amount of evapotranspiration, which is a key factor in estimating demand, and watershed modeling was performed to reflect geographical features, weather, runoff and water use characteristics of Jeju Island. For the past period (1992~2013), demand of Jeju Island as a whole was analyzed as 427 mm per year, and it showed a relatively high demand around the eastern and western coastal regions. Annual demand and seasonal variation characteristics of 10 river basins with watershed area of $30km^2$ or more were also analyzed. In addition, by applying the cultivated area of each crop in 2020 in the future, it is estimated that the demand corresponding to the 10-year frequency drought is 54% of the amount demanded in the previous research. This is due to the difference in approach depending on the purpose of the demand calculation. From the viewpoint of water resource management and operation, additional demand is expected as much as the net consumption. However, from the actual supply perspective, it can be judged that a facility plan that meets the existing demand amount is necessary. In order to utilize the methodologies and results presented in this study in practice, it is necessary to make a reasonable discussion in terms of policy and institutional as well as engineering verification.

An Evaluation of the Private Security Industry Regulations in Queensland : A Critique (호주 민간시큐리티 산업의 비판적 고찰 : 퀸즐랜드주를 중심으로)

  • The objective of this article is to inform and document the contemporary development of the private security industry in Queensland Australia, a premier holiday destination that provide entertainment for the larger region. The purpose of this review is to examine the comtemporary development of mandated licensing regimes regulating the industry, and the necessary reform agenda. The overall aim is threefold: first, to chart the main outcomes of the two-wave of reforms since the mid-'90s; second, to examine the effectiveness of changes in modes of regulation; and third, to identify the criteria that can be considered a best practice based on Button(2012) and Prenzler and Sarre's(2014) criteria. The survey of the Queensland regulatory regime has demonstrated that, despite the federal-guided reforms, there remain key areas where further initiatives remain pending, markedly case-by-case utilisation of more proactive strategies such as on-site alcohol/drug testing, psychological evaluations, and checks on close associates; lack of binding training arrangement for technical services providers; and targeted auditing of licensed premises and the vicinity of venues by the Office of Fair Trading, a licensing authority. The study has highlighted the need for more determined responses and active engagements in these priority areas. This study of the development of the licensing regimes in Queensland Australia provides useful insights for other jurisdictions including South Korea on how to better manage licensing system, including the measures required to assure an adequate level of professional competence in the industry. It should be noted that implementing a consistency in delivery mode and assessment in training was the strategic imperative for the Australian authority to intervene in the industry as part of stimulating police-private partnerships. Of particular note, competency elements have conventionally been given a low priority in South Korea, as exemplified through the lack of government-sponsored certificate; this is an area South Korean policymakers must assume an active role in implementing accredited scheme, via consulting transnational templates, including Australian qualifications framework.

Technical Standards and Safety Review of the Low and Intermediate Level Radioactive Waste Disposal Facility (중.저준위 방사성폐기물 처분시설에 대한 기술기준 및 안전심사)

  • On July 31, 2008, the Government issued the construction and operation permit for the first low and intermediate level radioactive waste disposal facility in the Republic of Korea. In this paper, the fundamental regulatory framework, regulatory requirements and technical standards of the disposal facility are introduced, and the phased review process adopted for evaluation of the safety of the facility is briefly described. The Atomic Energy Act sets forth a stepwise regulatory framework for the whole life-cycle of the disposal facility such as siting, design, construction, operation, closure and institutional control. More detailed regulatory requirements and technical standards are stipulated in the subsequent regulations of the Atomic Energy Act and a series of Notices issued by the Ministry of Eduction, Science and Technology. The Korea Institute of Nuclear Safety, as entrusted by the Ministry under the Atomic Energy Act, conducted safety review on the disposal facility, and evaluated the compliance with relevant criteria in all technical elements(i.e. siting and structural safety, radiological environmental impact, operational safety, systems and components, quality assurance, and total systematic performance assessment, etc.). The overall safety review process can be phased into inception phase, initial review phase, main review phase and completion phase. The review results were reported to and deliberated by the five Sub-committees of the Special Committee on Nuclear Safety, and then reported to the Ministry. The Ministry issued the construction and operation permit of the disposal facility through the deliberation of the review results by the Nuclear Safety Commission. Hereafter, the safety of the repository will be reassured by a series of subsequent regulatory inspections and reviews under the Atomic Energy Act. In addition, the licensee's continuous implementation of the "Safety Promotion Plan" may also enhance the long-term safety of the repository and contribute to build-up the confidence of the safety case.

Influencing Factors Analysis for the Number of Participants in Public Contracts Using Big Data (빅데이터를 활용한 공공계약의 입찰참가자수 영향요인 분석)

  • This study analyze the factors affecting the number of bidders in public contracts by collecting contract data such as purchase of goods, service and facility construction through KONEPS among various forms of public contracts. The reason why the number of bidders is important in public contracts is that it can be a minimum criterion for judging whether to enter into a rational contract through fair competition and is closely related to the budget reduction of the ordering organization or the profitability of the bidders. The purpose of this study is to analyze the factors that determine the participation of bidders in public contracts and to present the problems and policy implications of bidders' participation in public contracts. This research distinguishes the existing sampling based research by analyzing and analyzing many contracts such as purchasing, service and facility construction of 4.35 million items in which 50,000 public institutions have been placed as national markets and 300,000 individual companies and corporations participated. As a research model, the number of announcement days, budget amount, contract method and winning bid is used as independent variables and the number of bidders is used as a dependent variable. Big data and multidimensional analysis techniques are used for survey analysis. The conclusions are as follows: First, the larger the budget amount of public works projects, the smaller the number of participants. Second, in the contract method, restricted competition has more participants than general competition. Third, the duration of bidding notice did not significantly affect the number of bidders. Fourth, in the winning bid method, the qualification examination bidding system has more bidders than the lowest bidding system.

Analysis of Utilization and Maintenance of Major Agricultural machinery (Tractor, Combine Harvester and Rice Transplanter) (핵심 농기계(트랙터, 콤바인 및 이앙기) 이용 및 수리실태 분석)

  • In a survey in which farmers were asked about their levels of satisfaction with agricultural machines, Japanese products scored higher than local products by 1.2, 1.3, and 1.4 times for tractors, combine harvesters, and rice transplanter, respectively. Japanese products corresponded to generally high satisfaction levels in terms of operating performance, operability, frequency of breakdowns, and durability, excluding sales price and after-sales services. Effective countermeasures through quality improvement are therefore necessary for Korean products. Furthermore, a survey of dealers showed that the components and consumables for core agricultural machines had high frequencies of breakdowns and repairs. Four major components of tractors represented 85.3% of all breakdowns and repairs, five components of combine harvesters represented 89.6%, and three components of rice transplanters represented 80.5%. Moreover, a comparison of the technological levels between local and imported machines showed that the local machines' levels were at 60-100% for tractors, 70-100% for combine harvesters, and 70-95% for rice transplanters. Small and mid-sized tractors, 4 interrow combine harvesters, and 6 interrow rice transplanters showed similar levels of technology. The results of the analysis suggest that action is urgently needed at a policy level to establish an agricultural machinery component research center for the development, production, and supply of commonly-used components, with the participation of manufacturers of agricultural machines and components, in order to enhance the competitiveness of local manufacturers and to revitalize the agricultural machine market.

Changes in North Korea's Financial System During the Kim Jong-un Era - Based on North Korean Literature (김정은 시대 북한의 금융제도 변화 - 북한 문헌 분석을 중심으로 -)

  • This paper analyzes the changes in financial reform during the Kim Jong-un era based on North Korean literature. We find that North Korea has systematically and functionally separated the central bank from commercial banks since the Kim Jong-un era began. In addition, enterprises have been allowed to withdraw cash from bank accounts and make inter-enterprise cash payments. In other words, nowadays non-cash currencies with passive money can partially serve as active money with purchasing power. With the systematic and functional separation of the central bank and the commercial bank, the issuance of the central bank changed to a money supply method through the commercial bank, and changes in the currency distribution structure have allowed commercial bank's credit creation function to be implemented. This means that the banking system and the monetary·payment system of the socialist planned economy are changing in the way of the market economy. Reforms in the financial sector are believed to have been necessary to support changes in the economic system and to restore the function of the public financial sector. These changes have progressed in terms of the level of reform, but they are still considered similar to the period of the former Soviet Union's Perestroika or to the early period of China's reform and opening. Although North Korea's financial reform is superior in terms of enacting the banking law, it is insufficient in terms of realizing the functions of commercial banks. In addition, it is assessed that institutional constraints such as maintaining a planned economy, and the lack of confidence in public finances limit the effectiveness and development of the financial system. It should be noted that these results are based on literature published in North Korea. In other words, there is a limit in the fact that such recent changes have been carried out on a trial basis in some areas, or have been carried out in a full-scale manner with a blueprint, since Kim Jong-un's inauguration.

Analysis of Market and Technology Status of Major Agricultural Machinery (Tractor, Combine Harvester and Rice Transplanter) (핵심 농기계(트랙터, 콤바인 및 이앙기) 시장 및 기술 현황 분석)

  • Alternatives for increasing the competitiveness of locally manufactured agricultural machinery in domestic and foreign markets has been proposed. This was done by analyzing the major agricultural machinery's price and market share as well as their performance and quality. In the Korean domestic market, the market share of Japanese agricultural machinery has been identified to be 14.5% for tractors, 31.1% for combine harvesters, and 35.8% for rice transplanters, and on track for further increase. Japanese manufacturers' domestic patent shares are 58.5% for tractors, 79.9% for combine harvesters, and 69.8% for rice transplanters, showing the dire need for Korean domestic firms to expand their technological rights. To strengthen the industrial competitiveness of agricultural machinery, therefore, researches that develop the fundamental and elemental technology to reduce the frequency of breakdown should be needed in the short term. To achieve this, it is imperative to establish technology roadmap, promote greater cooperation between academia and industry, and systematically increase research funding. In addition, as a long-term solution for enhancing the competitiveness, an establishment of Agricultural Equipment Technology Institute is strongly recommended to systematically support R&D for developing core technologies, particularly high-quality components that guarantee durability and quality.
