그동안 법적 윤리적 합의가 이루어지지 않은 상태에서 의료계의 합의에 의해서만 장기이식이 시행되어 왔다. 그러나 뇌사 인정과 장기이식에 관해 우리사회에서도 어느 정도 합일점을 찾아 인정하는 쪽으로 방향을 잡아가고 있는 분위기에서 얼마전 장기이식에 관한 사회적 공감대와 윤리적$\cdot$법적 합의가 이루어지고 공식화 절차를 거쳐 법률안이 마련되었다. 이에 장기이식에 관한 법률적인 이해를 돕기 위해 2번에 걸쳐 박오순 변호사의 글을 싣는다

현대 의학계는 사람의 수명연장의 수단으로 장기이식 연구가 활발하게 진행되고 있다. 그러나 사람의 장기수요가 달리자 다른 동물의 장기이식 실현에 눈을 돌리고 있는데 가장 눈독을 들이고 있는 동물은 돼지라고 한다. 그럼 과연 돼지의 장기를 사람에 이식할 수 있을까?

불살생계를 제1계율로 내세우는 불교는 기본적으로 생명을 해치는 그 어떠한 행위도 용납하지 않는다. 따라서 원칙적인 입장에서는 사신(捨身) 행위에 해당하는 뇌사와 장기이식 등에 부정적인 입장을 견지한다. 그러나 현실적인 측면[적용의 융통주의]을 고려하면서도 본질적인 측면[원칙주의]을 간과하지 않는 불교의 자비와 중도주의적인 입장에 따른다면, 특수한 경우에 한해서 뇌사와 장기이식을 고려할 수도 있을 것이다. 즉 불교는 뇌사와 장기이식을 기본적으로 인정하지는 않지만, 자비의 원칙에 따라 어떤 상황에서는 엄격한 규제를 통한 제한적인 범위 내에서 뇌사와 장기이식을 허용할 수도 있다는 중도적인 입장을 취한다고 할 수 있다.

장기 등을 적출하거나 이를 이식하고자 의료기관은 보건복지부장관으로부터 장기이식 의료기관으로 지정받아야 하고 의료기관의 시설, 장비, 인력에 관하여 장기별로 별도로 요건을 규정하고 있다.

The purpose of this study was to investigate the influence of Consciousness of biomedical ethics on Nursing professionalism on Attitudes of organ transplantation among nursing students. Data were collected among 202 nursing students in G,P city, from october 12 to 22, 2021. The collected data was analyzed a using t-test, One way ANOVA, Pearson's correlation coefficient and Stepwise multiple regression using SPSS 20.0 WIN program. The average score for Consciousness of biomedical ethics was 3.39±0.44, Nursing professionalism was 3.84±0.56 and Attitudes of organ transplantation was 3.67±0.25. Factors Influencing Attitudes of organ transplantation were Right to life of newborn, Euthanasia, Social recognition, Professionalism of nursing and Role of nursing service. These variables accounted for 52.4% of Attitudes of organ transplantation. Based on the outcome of this study, developing an education program related to organ transplantation to contribute to the activation of organ transplantation.

ABO incompatible allografting is contraindicated in most organ transplantations including heart because of the hyperacute and acute rejections caused by preexisting antibodies. However several reports showed that ABO incompatible organ transplantation could be managed successfully by plasmapheresis, antibody adsorption, immunosuppression, splenectomy, and so on. We experienced one success in ABO incompatible cardiac transplantation by means of plasmapheresis and immunosuppression. However, this does not justify heart transplantation across ABO blood group barriers. Because the effect of ABO incompatibility on continued acute rejection or chronic rejection has not been fully understood, long-term follow-up study is required.
