4차 산업혁명의 주요 기술 중 하나로 언급되는 사물인터넷 기술은 헬스케어분야에서 질병의 예측, 관리뿐만 아니라 보건의료 산업 전반에까지 영향을 미치고 있으며, 기술의 고도화 및 적용 분야가 점차 확대되고 있다. 이에 본고에서는 사물인터넷이 헬스케어 산업 분야에 적용 동향을 살펴보고, 한국, 미국, 일본, 유럽 특허청의 특허분석을 통해 공백 기술 및 분야에 대한 분석과 함께 향후 기술 개발이 요구되는 분야에 대해 논하고자 한다.

양자컴퓨터의 개발이 가속화됨에 따라 기존의 공개키 암호에서 양자내성암호로 시급하게 전환해야 하는 상황이다. 이러한 상황을 가장 신속하게 대응하고 있는 미국은 NIST를 통해 양자내성암호로의 전환을 위한 표준화를 진행하고 있으며, 표준화 대상 알고리즘까지 선정한 상황이다. 그 외 일본, 중국, 및 유럽의 각국도 양자내성암호 기술을 확보하기 위해 많은 투자를 하고 있다. 본 고에서는 양자내성암호의 국적 및 세부기술별 특허출원 동향을 살펴보고, 나아가 양자내성암호의 구현특허 출원 동향도 함께 분석한다.

최근 막대한 매장량으로 인해 미래의 비재래형 에너지원으로 주목받고 있는 천여가스 하이드레이트는 고압 저온 환경에서 수소결합을 하는 고체상 격자 내에 객체분자인 가스분자가 포획되어 형성된 가스하이드레이트의 일종으로 영구 동토지역과 심해저의 퇴적층에 광범위하게 분포되어 있다. 본 연구에서는 이러한 가스하이드레이트의 개발기술과 천연가스의 저장과 운송기술에 관한 미국 일본 유럽 등 특허 3극 및 한국 특허 총 357건을 추출하고 특허정보 분석을 실시하여 국내외 기술개발 동망 및 기술변화 추이를 살펴보았다. 특허 검색에 사용된 DB와 분석도구는 특허청 선행기술 전문조사기관 등으로 지정된 (주)윕스사의 WIPS와 ThinKlear이며, 미국/일본/유럽 등 특허 3극과 한국에서 공개 또는 등록된 특허를 검색대상으로 하였다 자원으로서 천연가스 하이드레이트를 개발하는 기술과 관련하여 총 193건의 특허가 추출되었으며, 이 때 사용하는 방법에는 감압법, 열처리법, 억제제 주입법 등이 있었다. 또한 연료용 가스, 특히 메탄가스의 수송 및 저장에는 통상 액화하여 액화천연가스로 수송하는 방법이 사용되고 있으나 가스하이드레이트를 이용할 경우 액화천연가스를 이용하는 것보다 더 경제적임이 보고되면서 이와 관련된 연구가 활발히 진행 중이며, 총 164건의 특허가 추출되었다. 상기 추출된 총 357건을 대상으로 연도별 출원동향, 국가별 점유율 및 시계열 분석, 분류기술별 출원동향 등의 특허정보 분석을 수행하였다.

인터넷 이용자의 급속한 증가에 따라 인터넷을 이용한 새로운 비즈니스 모델들이 급격히 증가하는 추세를 보이고 있다. 이러한 새로운 비즈니스 모델들은 사업추진을 위한 방법에 있어서 컴퓨터 기술 등 일정 부분 기술적인 속성들을 내재하고 응용하고 있다는 점에 착안하여 비즈니스 모델에 대한 특허를 부여하고 있다. 그러나, 미국, 일본 등 선진국 뿐만 아니라 최근에는 우리나라에서도 적극적으로 검토되고 있는 비즈니스 모델에 대한 특허부여는 인터넷 기술의 급속한 진보와 인터넷이 네트워크를 매개로 자유로운 정보공유를 목적으로 출발하였다는 점, 영업방법에 대한 특허를 부여할 경우 그 영업분야에 대한 사실상의 독점인정이 될 것이라는 점 등 다양한 측면에서 비판적인 의견들이 제기되고 있다. 비즈니스 모델에 대한 특허부여는 인터넷을 이용하여 전세계를 그 영업대상으로 한다는 점에서 영업범위가 매우 광범위 하다는 점 및 파급효과의 즉시성 등의 특성으로 인하여 우리나라 뿐만 아니라 범세계적 차원에서 공동의 논의의 장과 규범을 마련해 나가야 할 것이다. 본 고에서는 특허청 등 특허관련 업계와 인터넷 서비스 업계 등을 중심으로 산발적으로 다루어지고 있는 비즈니스 모델 특허의 개념정의와 요건, 최근의 비즈니스 모델 특허관련 전개동향, 논점 등에 대해 살펴보고, 우리의 전략적 대응방안을 제시한다.

Patents for postharvest technology of fresh fruits, vegetables and mushrooms fluctuated in their filing number until the 2000s, but then there has been a steady increase in the 2010s, indicating that the technology has high growth potential in the international agricultural market. Using 551 valid patents for fresh fruits and 337 for fresh vegetables of 5 countries, patent trend of postharvest technology was analyzed in this study with two categorized technologies as packaging and storage. In Korea, patents from national research institutes such as the Korea Food Research Institute and Korea (Rural Development Administration) are dominated, and a number of patents for the postharvest storage of fresh vegetables by Mitsui Chemicals, a Japanese chemical company, have been registered. Agrofresh, a multinational company in the USA, holds a number of patents for postharvest storage of fresh fruit not only in its own country, but also in Japan and Europe. Postharvest technology of fresh fruits and vegetables was found to has a number of patents, mainly from national research institutes and multinational corporations, and this suggests that R&D and commercialization of the technologies are actively taking place.

This paper studies localization effects of knowledge spillovers in Korea using U.S. patents granted over the period 1996-2015. The "sample-matching" analysis initiated by Jaffe, Trajtenberg, and Henderson (1993) is adopted. We do not find evidence of positive localization effects in Korea. In particular, controlling for the existing geographic distribution of knowledge production, the frequency of domestic citations of Korean patents is no more than the citation frequency from overseas, and the difference is decreasing within the sample period. We also examine localization effects across regions and industries, and compare Korea with Taiwan and Japan.

According to Japanese Patent Act, the Japanese Patent Office, administrative organization, was authorized to decide validation of patent. However, Supreme Court of Japan held that a court is able to decide the invalidation of patent in 11th April, 2000, which caused the reform of Japanese Patent Act in June 2004. Reformed Patent Act established the article 104-3 and makes it for a court to decide the patentability where there are grounds for a patent invalidation. Through this amendment to the Patent Act, the legislative system to decide the patent validation has been reorganized and furthermore alleged infringer is allowed to argue against the patent validation by making use of infringement litigation procedure through defenses against patent invalidation as well as invalidation trial procedure for to file a request for a trial for patent invalidation to the Japanese Patent Office. That is to say, the article 104-3 was established in the Japanese Patent Act in the wake of Kilby, and thus a court, which is judicial authority, not administrative disposition agency is also able to decide the patent validation. Thus this article discuss how a court, the authority of which only patent infringement cases fell under, has been authorized to arbitrate cases about the patent validation and the decision of the patent validation in a court.

Highly cited patents (HCPs) were selected from the patents published from 2002 to 2006. Citation frequencies of patents were obtained from the database provided by DWPI and were analyzed with respect to the IPC (International Patent Classifications). HCPs were selected as those who occupy top 1% of citations in the sets of patents given by IPCs and publication year. After selecting the HCPs their distribution over IPCs, Industrial Classifications and patent assignees' nationalities were analyzed. According to the result the US held 5,634 patents (66.9%) out of the total 8,416 patents occupying the the first rank in the distribution of patent assignees' nationalities. Japan and Germany ranked the 2nd and 3rd place holding 885 (10.5%) and 521 (6.2%) HCPs, respectively. On the other hand, Korea were positioned at 6th holding 151 (1.8%) HCPs. Among the industrial sectors classified by the Industrial Classifications provided by the Korean Intellectual Property Office, Manufacturing Sector occupied the 1st place with 7,692 HCPs (81.7%) and Waste Treatment Sector occupied the 2nd place with 578 HCPs (5.9%).
