Impact of The Experience of being Discriminated on Their Experience of Discrimination: Focusing on The Moderating effect of the education for human rights (청소년의 차별피해경험이 차별가해경험에 미치는 영향 -인권교육의 조절효과를 중심으로-)

  • This study investigated the impact of the experience of being discriminated on their actual experience of discrimination, and verified the moderating effect of the education for human rights. The data used in this study were sampled from the 2014 children and youth human rights survey of Korea National Youth Policy Institute, and 4,023 students in middle or high school were selected for the final data analysis. The moderation model was analyzed by applying SPSS PROCESS macro. The analysis suggested the following. First, it was shown that the experience of being discriminated and the level of help and frequency of the education for human rights were significantly distinguished in the statistics. Second, even though the experience of being discriminated and the level of help of the education for human rights meaningfully influenced the experience of discrimination, frequency of education did not. Third, it was verified that the level of help from education of human rights moderates the relationship between the experience of discrimination and the experience of being discriminated. It also showed that the higher the level of help is, the more the experience of being discriminated exerts influence on the experience of discrimination. Thus, on the basis of the results, the theoretical discussion on the youth discrimination was drawn out and the practical implication on the direction of the education for human rights was suggested.

  • It was in the 1990s that the human rights of persons with disabilities began to be discussed in our society. Based on the Declaration on the Rights of Persons with Disabilities adopted by the UN General Assembly in 1975, the Charter on the Rights of Persons with Disabilities was adopted on December 8, 1988. The human rights of persons with disabilities explains the important meaning of not being discriminated against just because they are persons with disabilities, the basics of human rights that all human beings have. The human rights of persons with disabilities are universal values, a basic right, and a declaration to protect the socially disadvantaged. Human rights are an important ideology that deals with the dignity and worth of human beings. In our society, people with disabilities should not be discriminated against for any reason. Persons with disabilities should be the center in matters related to the Anti-Discrimination Act and Human Rights. In addition, it can be said that it is necessary to develop and operate a system suitable for the local government for the disabled in the local community.

Stress and Experience of Doing Harm: Moderating Effects of Human Rights Consciousness (아동청소년의 스트레스와 차별가해경험: 인권의식의 조절효과)

  • The main objectives of this study are to examine the effects of stress on the experience of doing harm of the children and adolescents and to examine the moderating effect of human rights consciousness on the relationship between the stress and the experience of doing harm. To do this, we analyzed the data obtained from Survey on Human Rights of Children and Adolescents in 2015. The subject is 10,424 from the 4th grade of elementary school to the 3th grade of high school. To investigate the moderating effects of variable, we have conducted a hierarchical regression analysis and confirmed changes in explanatory power. As a result of that, first, it suggests that stress and human rights consciousness have direct effects on the experience of doing harm. This results show that the lower stress and the higher human rights consciousness is, the lower experience of doing harm is. Second, it was found that human rights consciousness is moderating variable on the relationship of between the stress and the experience of doing harm. Based on this results, this study has proposed the implications and limitations of it and suggestions for further study.

  • In recent years it seems to be accepted as absolutely right by almost all the people in the world that person without disabilities and person with disabilities are equal and should be treated so regardless of their race, national origin, sex, religion, disability, etc. This article deals with (1) "Anti-Discrimination against and Remedies for Persons With Disabilities Act" and (2) Human Rights of Persons With Disabilities. The purpose of "Anti-Discrimination against and Remedies for Persons With Disabilities Act" is to realize the human dignity and worth of persons with disabilities by prohibiting disability-based discrimination in all areas of society, and effectively safeguarding the rights of individuals discriminated based on disability, thus enabling them to fully participate in society and to secure equal rights.

  • This study aimed to identify the impact of human rights violations on elderly discrimination, focusing on the mediating effect of elderly-related experiences. After conducting a two-month survey of 143 dental students in some parts of Busan from September 4, 2020, hierarchical regression analysis was conducted to find out the mediating effects of elderly-related experiences using the SPSS 26.0 program. Dental hygiene students' perception of infringement on elderly human rights was shown to be significant in elderly discrimination(r=-.310) and elderly-related experiences(.185), indicating that elderly-related experiences were partially mediated in elderly human rights infringement and elderly discrimination. Therefore, this study intends to provide basic data on the development of dental hygiene curriculum in a super-aging society by reconsidering the need for senior-related experiences in dental hygiene and education.

Genetic discrimination as another shadow of biotechnology (생명과학기술의 또 다른 그늘: 유전자차별)

  • This study aims to highlight the social aspects of genetic discrimination as another shadow that biotechnology can influence on social life. To do so, the definition of "genetic discrimination" and three perspectives (exceptionalism, expressivism, and human right discourse) were reviewed. In addition, the Genetic Information Nondiscrimination Act (GINA) of the United States and the Bioethics and Safety Act of Korea were analyzed. Several social implications for establishing the research and policies of genetic discrimination based on the existing research results of perceived genetic discrimination (the experiences, fears, and coping strategies of genetic discrimination) were suggested. These included public consensus on the definition of genetic discrimination and emphasis on a human rights approach against genetic discrimination; concerns regarding genetic discrimination in both the personal and public domains; raising the consciousness of both health care providers and the public regarding genetic discrimination; and developing psycho-social coping strategies for decreasing the fear of discrimination of asymptomatic people (hereditary carriers).

  • 매년 12월 1일은 세계에이즈의 날이다. 인류의 건강과 생명을 위협하는 에이즈를 근절하기 위해 UNAIDS에서 제정한 이 날을 맞이하여 세계에이즈의날종합행사조직위원회에서는 정부, 의료, 언론, 법조계 등 다양한 전문가들을 모시고 에이즈 감염인에 대한 사회의 편견과 차별 및 인권증진 방안에 대한 심포지엄을 실시하여 보다 밝고 건강한 사회를 이룩하기 위해 논의하였다. 그 내용중 주요 일부분만을 발췌하여 게재한다.

  • 필자는 최근 국가인권위원회가 의뢰한 '에이즈 감염인들의 인권실태 조사연구'에 참여하며 우리사회에서 에이즈 감염인들이 인권의 사각지대에 방치되고 있음을 극명하게 알 수 있었다. 에이즈 바이러스 그 자체보다 사회의 멸시와 차별이 당사자들에게는 더욱 치명적이며, 이 질병을 마음의 병으로 앓게 하고 있는 것이다. 이러한 후진적인 상황에서 벗어나기 위해서는 에이즈에 대해 객관적이고 과학적인 사실을 적극적으로 알리고, 감염인들이 겪고 이는 사회 곳곳에서의 부당한 처우를 꾸준하게 고발하여, 에이즈에 대한 인식과 사회적 태도 변화를 유도해야 한다. 에이즈에 대한 과도한 공포는 감염인과 비감염인 모두에게 큰 폐해를 끼진 다는 점에서 최우선적으로 개선되어야 할 과제이다.

A Study on Restriction of Access to Medical Institutions and Discrimination on Human Rights of Persons with Disabilities Not Wearing Masks to Prevent Healthcare-Associated Infections (의료관련감염 예방을 위한 마스크 미착용 장애인의 의료기관 출입제한과 인권차별 결정에 대한 검토)

  • In the early stages of the COVID-19 pandemic, Korea took the lead in implementing "social distancing" policies more strongly than other countries. In addition to making it mandatory to wear a mask according to the policy, all patients using medical institutions are tested for COVID-19 to prevent Healthcare-Associated Infections, and only those patients who test negative have been regulated to receive face-to-face medical treatment. In this process, situations such as the disabled, who have difficulty wearing masks, were not taken into account, and emergency patients did not receive timely treatment or surgery from medical personnel. In response, the National Human Rights Commission of Korea has decided that forcing everyone to wear a mask and restricting access to medical institutions constitutes discrimination against the disabled. Therefore, the purposes this study has that, the first is to review cases of human rights discrimination against persons with disabilities due to measures to prevent the transmission of infectious diseases that did not consider the characteristics of persons with disabilities in the COVID-19 situation and issues regarding the decisions of the National Human Rights Commission of Korea, the second is to find a reasonable plan and the need for measures to prevent refusal of treatment by medical institutions for the disabled who have difficulty wearing masks.
