Welfare of Video Production Professionals in Accordance with Enforcement of Artist Welfare Act (예술인 복지법 시행에 따른 영상제작 종사자의 복지)

  • "Artist Welfare Act" from the November 18, 2012 is being implemented. However, in the field of traditional culture and art the artists are the subject of a variety of policies by the newly launched Korean Artist Welfare Foundation Artists, but most of video production professionals are not aware of law enforcement and their legal status is ambiguous. This research raised the issue of poor video production workers welfare, and to seek the ways took a look at the key information of "Artist Welfare Act" and social issues. To this end, by in-depth interviews with video workers I analyzed the relationship between the parties, such as comments about the issues. Accordingly, a wide range of video production to reflect the welfare of workers in the "Artist Welfare Act" of the amendment shall be made. Above all, this should be reflected in measures to raise funds for artist welfare.

  • Through the improvement of the Labor Relations Act, the Social Insurance Act, and the Artists Welfare Act for occupational status and rights of artists, the character of workers, joining exception in the Employment Insurance Act, and applying exception in the National Health Insurance Act and the National Pensions Act should be recognized. For this, the scope of workers should be expanded through the interpretation of the court and legislation of the Labor Relations Act, and supporting range of social insurance should be expanded by applying exception in the National Health Insurance Act and joining exception in the Employment Insurance Act for artists who are currently excluded. Artists' compensation insurance that is an optional entry system and paid entirely by artists need to have effectiveness of the system through insurance support. The Artists Welfare Act also needs to be revised to strengthen legal protection for artists and it is important to secure finances for artists' welfare projects. The standard contract should be mandatory and a career certification system for artists should be established so that artists who need welfare benefits can not be omitted.

Policy-making Process of Artists Welfare Law: Based on Kingdon's Policy Streams Model (예술인복지법 정책결정과정 연구: Kingdon의 정책흐름모형을 중심으로)

  • This study analyzes the policy-making process to promote the artists' welfare. In the problems stream, the artists have been found to suffer without any governmental support. In the policy stream, there have been various alternatives but they were not actualized. Meanwhile, a writer died of illness and famine in 2011. In the political stream, the public opinion to require the promotion of the artists' welfare, was strengthened. It made the policy-window open and resulted in the legislation of the Artists Welfare Law. Based upon these analyses, this article concludes that Kingdon's model is applicable to this case. Especially, this study shows that this policy was made with accidental events and the roles of informal participants such as netizen were more critical. However, it should be noted that the content of this Law was modified and trimmed because there was no policy entrepreneur to persuade the dissenters. It could made the policy-making process of this Law distinguished from others.

A Policy Plan for the Improvement of Artists's Welfare Law (예술인복지법 개선을 위한 정책방안)

  • This study analyzed the issue and limit of artists's Welfare Law. The issue is about artists' labor, their status, and the process for buying social insurance. In this study, we used the literature method the existing data collection clean up, analysis, and evaluating. The solution plan for the vitalization of the guarantee of social insurance for stage actors is as follows. First, based on social insurance law, is to grant an exceptional status to stage artists. Second, the process for buying social insurance has to be changed to posterior judgement by Ministry of Culture, Sports, and Tourism after buying social insurance through Ministry of Employment and Labor. And when a theater company as a leaseholder rent a theater, it should be mandatory for it to get existing industrial accident compensation law. As a new numerical formula, there are an unemployment insurance numerical formula considering distinct characteristics of artists' labor and a formula of calculating insurance fee for industrial accident compensation. Last, there needs to be an introduction of exceptional method allowing a preparatory period for the production of a play and stage actors' side job.

A Systematic Review of the Literature on Tattoo and Semi-permanent Makeup (문신 및 반영구화장에 관한 체계적 문헌고찰)

  • This study was conducted for a systematic literature review according to the period, subject, and research method for 198 papers related to tattoo and semi-permanent makeup published from 1979 to 2022. By period, it was divided into the first period (1979-1994), the second period (1995-2005), the third period (2006-2012), and the fourth period (2013-2022). In the first period, research on health and medical aspects was the main focus, and in the second period, studies in various aspects such as art and culture began to appear. The 3rd period was characterized by increased research on semi-permanent makeup, and the 4th period was marked by a rapid increase in research on tattoos and semi-permanent makeup. By research topic, it was analyzed by dividing it into health and medical care, beauty, fashion and art, society and culture, law and system. As a result, cosmetic studies were most actively conducted to identify consumers' preferences and perceptions, and health and medical studies were the second most common. Recently, as the need for legalization has increased, studies related to laws and systems have increased rapidly, and studies on culture, history, and fashion have also been conducted. By research method, survey research were used the most, and various methods such as literature study and case studies were also used. This study is expected to further promote follow-up research in the future and contribute to the development of related industries.

Rent-seeking Analysis of the Cultural Voucher from the Viewpoint of Culture and Arts Management (문화예술경영 관점으로 본 문화이용권사업의 지대추구론적 분석)

  • This study deals with the rent-seeking behavior that exist in cultural voucher from the viewpoint of culture and arts management. Art organizations open to consumers, producers and governments of the arts are dependent on the internal and external influence of an open system. Researcher has found rent-seeking in the course of introducing policies and legalization of the cultural voucher business which has been promoted in the direction of democratization of culture or cultural democracy. Cultural voucher business is a legal term. Although the government has increased the budget or tried to change the policies of the cultural voucher business, the implementation of the cultural voucher business has been opposed to the diversity of consumption and equity as the consumption of genre and the concentration of the capital region have increased. These results were structurally related to the process of legalization and rent-seeking behavior in bureaucracy. This study reaffirms that the efficient operation standard of the cultural voucher business is a balance between the choice of the beneficiary, the competition of the supplier, and access to the cultural voucher. And the theory of rent-seeking was applied as a criterion to analyze this balance. Thus, it is suggested that the criteria of evaluation and improvement to check the conservativeness of bureaucrats are needed to establish a legal system applied to the purpose of 'cultural democracy' and 'democratization of culture' ideology and to guarantee individual creativity and autonomy.

Study of the Small Theater of Traditional Dancing as a Cultural Welfare (문화복지로서의 전통춤의 소극장공연 의미)

  • This study examined Korean traditional dancing performances in small theaters as a phenomenological approach. Korean traditional dances, as cultural welfare, are expected to be attractive to the public and our cultural heritage is expected to be inherited from them. The purpose of this study was to provide basic data for Korean tradition dancing to be supplied to the public as a Traditional Cultural Welfare Program. A qualitative approach was taken to best achieve the aims of this study. The data used in this study were collected from July 10th to September 1st, 2016, using in-depth interviews. Seven Korean dance professionals with more than 15 years' experience in traditional dancing performance were enrolledin this study. The traditional dancing performance in small theaters is necessary in terms of providing concert halls to local cultural artists and high quality performances to audiences as traditional cultural welfare. The traditional dancing performance in small theaters as cultural welfare will provide a platform to enjoy various traditional cultures across all ages and all class levels of the society in auniversal dimension.

정책토론회 - 건축설계의 국제경쟁력 확보와 전문화 방안

  • 우리 협회는 지난 11월 26일 오후 2시 협회 대강당에서 '건축설계의 국제경쟁력 확보 및 전문화 방안'을 주제로 토론회를 개최하였다. WTO출범과 건축설계시장개방 등 급격한 대내ㆍ외적 환경변화에 처해 있는 우리 건축계의 국제경쟁력 확보 방안을 마련하기 위해 열린 이날 토론회에서는 경쟁력 확보를 위해 건축설계사무소마다 다양한 전문분야를 확보하고, 건축설계 생산성 향상을 위해 설계업계와 구조, 설비 등 관련 전문분야가 협력체제를 구축해야 하며, 건축의 상품성과 문화예술성이 함께 고려된 건설관련 법안이 마련돼야 한다는 주장이 제기됐다. 이날 서울시립대 최찬환교수는 '건축설계의 경쟁력 확보 방안'이란 주제발표를 통해 해외건설업계의 국내진출에 대응하기 위해서는 설계사무소가 전문성과 효율성을 확보해야 한다고 강조하면서 전문영역을 크게 주거, 상업시설, 공공시설, 교육문화시설, 사회복지시설, 교통 및 운수시설 등으로 구분하였다. 최교수는 또 외국업체에 의한 국내시장 잠식을 막고 우리가 해외에 진출하기 위해서는 해외건설업체와 협력해 정보와 기술, 경험 등을 지원받아야 하고 R&D에 대한 투자를 적극적으로 해야한다고 강조했다. 이어 '건축설계의 전문화'에 대해 주제발표를 한 강원대 박경립 교수는 국내 건설관련문제점 개선과 대외경쟁력 강화를 위해 현재 입법추진되고 있는 건설산업기본법이 건축설계의 독자성과 전문성을 고려하지 않고 있다고 지적하면서 이에 대한 보완필요성을 제기하였다. 박교수는 또한 건축설계분야가 갖고 있는 전문성과 함께 '건축문화'라는 사회문화적 측면의 중요성이 인식돼야 한다며 건축의 상품성과 문화예술성이 함께 고려된 건설관련 법안이 마련돼야 한다고 지적했다. 박교수는 이밖에도 사회발전에 따른 새로운 전문영역의 개발로 실내 설계와 도시설계를 예로 들었으며 정보화에 맞게 고도의 전문성을 바탕으로 Network체계를 구축하고 그 핵심은 건축사협회에 정보Network를 구축하여 활용하는 것이라고 제안했다. 한편 주제발표 후에는 약 3시간여에 걸쳐 이문보(동국대 교수), 손세관(중앙대 교수), 이병담(현대산업개발 부사장), 김인호(국방부 건설기술과장), 유경철(삼육건축사사무소 대표), 이관영(본 협회 이사)씨 등 건설ㆍ건축관계자들이 참가한 종합토론이 이어졌다. 이 자리에서는 사회의 인식에 앞서 건축계 내부적으로 전문성과 효율성의 확보에 나서야 한다는 의견과 함께 무한경쟁속에서 우리 건축설계의 경쟁력을 높일 수 있다는 다양한 의견들이 제기되었다. 본지에서는 이번 토론회의 주제발표 내용을 요약 정리하여 게재한다.

Suggesting a Plan of Tables of Preference for KDC4 (한국십진분류법의 우선순위표 설정에 관한 연구)

  • This study suggests a plan of tables of deference for Korean Decimal Classification, 4th edition, based on the study on those in Dewey Decimal Classification, 21st edition. It suggests two tables for the Auxiliary Tables, one for standard subdivisions and one for subdivisions for literature. Twenty-two tables are suggested for the Schedule of ten main classes.

A Study on Restriction of Access to Medical Institutions and Discrimination on Human Rights of Persons with Disabilities Not Wearing Masks to Prevent Healthcare-Associated Infections (의료관련감염 예방을 위한 마스크 미착용 장애인의 의료기관 출입제한과 인권차별 결정에 대한 검토)

  • In the early stages of the COVID-19 pandemic, Korea took the lead in implementing "social distancing" policies more strongly than other countries. In addition to making it mandatory to wear a mask according to the policy, all patients using medical institutions are tested for COVID-19 to prevent Healthcare-Associated Infections, and only those patients who test negative have been regulated to receive face-to-face medical treatment. In this process, situations such as the disabled, who have difficulty wearing masks, were not taken into account, and emergency patients did not receive timely treatment or surgery from medical personnel. In response, the National Human Rights Commission of Korea has decided that forcing everyone to wear a mask and restricting access to medical institutions constitutes discrimination against the disabled. Therefore, the purposes this study has that, the first is to review cases of human rights discrimination against persons with disabilities due to measures to prevent the transmission of infectious diseases that did not consider the characteristics of persons with disabilities in the COVID-19 situation and issues regarding the decisions of the National Human Rights Commission of Korea, the second is to find a reasonable plan and the need for measures to prevent refusal of treatment by medical institutions for the disabled who have difficulty wearing masks.
