일본의 상호접속은 전기통신사업법에 법적인 근거를 두고 설비를 보유한 특정 전기통신사업자가 설비를 보유한 다른 전기통신사업자로부터 상호접속의 요청이 있는 경우 다음의 특별한 사유를 제외하고는 상호접속을 이행토록 강제하고 있다. 특히, 1종 지정전기통신설비를 보유한 사업자(현재 NTT 동일본, NTT서일본이 각각 지정)는 고정계의 필수설비를 보유한 시장지배적사업자로, 필수설비 접근의 제한 및 지배력남용을 방지하기 위하여 강한 규제를 받고 있다. 특히, 상호접속부문에서는 LRIC에 의한 접속료 규제를 받는 유일한 사업자로 NIT가 지정되어 있는 상황이다. 반면, 2종 지정전기통신사업자(이동계 지배적사업자)와 기타의 전기통신사업자는 이러한 접속료 규제를 받기는 하지만 1종지정전기통신사업장와 같은 접속약관인가가 아닌 신고제를 적용받고 있다. 다만, 이용자들의 end-to-end 서비스의 보장을 위해 상호접속을 실시도록 하고 있다. 이에 본고는 현행 일본의 상호접속관련 규정 및 접속료 산정 guideline인 접속료 규칙을 살펴보고자 한다.

선진국의 요금규제는 이미 자유화 내지 신축적인 규제로 탈바꿈한 지 오래다. 그리고 이러한 추세는 접속료 규제에까지 파급되어 현재 다양한 형태의 신축적 규제가 시행 또는 검토되고 있다. 대부분의 해외 전문가들은 앞으로 접속료가 원가주의의 직접 규제에서부터 신축적 규제를 통해 효율적 접속료로 이행될 것으로 전망하고 있다.

Internet is composed of many independent networks referred to as Internet Service Providers (ISPs) and each provider is generally interconnected based on a commercial agreement. Though many countries are engaged in deregulation in internet interconnection, there is still debate whether the large ISPs are unwilling to peer with small providers, have incentives to lower the quality of data transmission of transit operators or set the interconnection charge regarding the actual costs incurred by the interconnection. Korean government introduced regulations in internet interconnection after observing noticeable anti-competitive behaviors from 2005. This paper analyzes whether there is margin squeeze problem/market concentration, and suggests political proposals in Korean regulation status.

본 고는 1995년 4월 19-21일 ITU 본부에서 개최된 통신망 상호접속의 규제현안에 관한 회의결과를 분석하였다. 규제 관련 ITU 회의는 1993년 2월에 1차 회의가 개최된 이후, 2차 회의는 1993년 12월에, 3차 회의는 1994년 11월에 지속적으로 열리고 있다. 통신망 상호접속은 우리나라에서도 시장개방에 따라 공개경쟁 원칙하에 지속적으로 추진되고 있다. 이러한 상호접속의 정의와 필요성, 국가의 통신 정책에 대한 고려사항 및 영향범위, 규제기관의 필요성과 역할, 예상되는 기술적이고 정책적인 문제 점 등에 대한 각국의 전문가들의 의견을 기술하였다.

This Paper deals with the model of fixed-mobile interconnection. Specifically, how interconnection charge and originating price are determined when there is customer ignorance about terminating network or the price. This paper shows that the terminating charge with customer ignorance is higher than without that, and therefore the retail price becomes higher. This paper discusses the several methods to prevent the increase of the retail price and suggests the scheme to regulate the retail price and interconnection charge, simultaneously.

영국은 그동안 사업자간 협상에 맡겨 두었던 고정망에서 이동망으로의 호에 대한 접속료 정산체제를 원가주의로 전환함으로써 이동망에 대한 규제에 있어서 큰 변화를 불러 일으켰다. 또한 광대역서비스에 대한 접속의 필요성이 급증함에 따라 그동안 가입자회선 세분화에 대해 부정적인 입장을 취하고 있던 OFTEL은 점차 가입자회선 세분화의 필요성을 인식하여 이에 대한 규제를 추진중에 있다. 본 고에서는 최근까지의 영국의 상호접속제도 변천과정을 살펴보고 최근의 주요 이슈에 대해 면밀히 검토해 보고자 한다.

통신망간 상호접속료 산정 방식으로 장기증분비용방식이 확산되고 있는 가운데 국내에서도 2004년 이후 시내, 시외, 공중 및 이동전화망의 접속료는 장기증분비용방식이 적용될 계획으로 있다. 2002년 12월 개정 전기통신설비의 상호접속기준 22조의4의 장기증분비용 방식을 적용함에 있어 유선망은 각국에서 선행연구가 진행되어 왔고 실제 적용사례도 많기 때문에 비교적 사업자간 합의점을 찾기 용이한 측면이 있으나 이동망의 경우 선행연구가 부족하기 때문에 원가범위를 둘러싼 당사자간 논란의 여지가 많은 실정이다. 특히 현행 접속료 산정기준에서 유선의 경우 가입자선로가 착신원가 범위에서 제외되고 있는 반면에 이동망의 경우 가입자접속(access) 비용이 착신접속원가에 포함되고 있어서 향후 LRIC 방식 적용시 이동망의 가입자 접속구간 비용을 착신증분원가 산정 범위에 포함한 것이지 여부를 가지고 논란이 예상된다. 본 고에는 미국의 이동망 착신보상 규제 및 판결사례를 살펴봄으로써 앞으로 개발될 이동망 LRIC 방식 비용산정시 액세스 비용에 관한 원칙을 정하는데 시사점을 제공하고자 한다.

This paper analyzes the impact of the change in telecommunication regulation on network investment such as the integration of telecommunication service. The integration of telecommunication service plays a role of separating the behavior regulation from entrance regulation and reducing a entrance constraints. Therefore, it is expected that the market spill over effect is high through the improvement of behavior regulation such as interconnection regulation, facilities provisions, retail price regulation, bundling, number portability of VoIP. This paper discusses the critical factor affecting the decision making process in respect of the firm level and analyzes the impact path guiding investment and innovation. Finally, the paper proposes the guideline for telecommunications policy.

EC(European Commission)는 유럽의 이동전화시장에서 전반적으로 경쟁이 이루어지고 있지만 호착신시장과 같은 상호접속시장에서는 경쟁이 불충분하다고 판단하고 있다. 이로 인하여 착신접속료를 설정하는데 있어서 경쟁인센티브가 결여된다는 입장이다. 따라서 EC는 이동망 비용규제 방안을 모색하고 비용산정에 관한 지침을 마련하기 위하여 활발히 연구진행중이며 이의 일환으로 EE(Europe Economics)에게 Bottom-up 방식의 이동망 LRIC 모형 개발을 위탁하였다. 본 연구에서는 유럽 각국의 상호접속시장 비용규제 현황을 파악하고 EE에서 개발한 LRIC 비용산정모형을 살펴보고 모형 개발과정에서 발생하는 쟁점이 되는 사항들을 파악하여 국내 이동망 LRIC 비용모형개발에 대한 시사점을 살펴보고자 한다.

본 논문에서는 통신망 신뢰성 및 상호운용성 확보를 위한 상호접속 방안을 고찰하였다. 이를 위해 국내외의 상호접속 관련법 현황 및 상호접속관련 표준기관 분석을 행하였고, 상호접속의 기본개념 및 상호접속의 예와 관련 표준들의 정립을 통한 상호접속 방안을 분석하였다. 그 방안으로서 규제기관 산하의 위원회를 통한 상호접속계획 처리, 상호접속협정, 운용 및 표준개발에 대한 모델정립이 필요하며, 특히 글로벌 초고속 통신망 구현을 위한 국제 표준기판과의 협력이 절실히 요구되고 있다. 분 연구의 결과는 향후 국내의 상호접속 관련 표준개발 및 운용 등의 기초자료로써 활용될 것이다.
