The Development of a Web-based Decision Support System for Construction Claim Management (건설 클레임 관리를 위한 웹기반의 의사결정 지원 시스템 개발)

  • Recently, construction claims have been increased for protecting the rights of construction participants and effectively adjusting the changes under the contract. Thus, the importance of claim management has been emphasized in the construction industry. In domestic construction industry, some claim issues involved in construction activities are often being developed into disputes and even litigations because of the absence of methods or systems for the dispute resolution, and the lack of judicial precedents which can be provided as the references for resolving a particular dispute. In general, the judicial precedents related to the disputes and litigations occurred among construction participants would be extremely valuable in evaluating and analyzing current claims issues. However, such useful information has not been effectively accumulated and utilized in resolving the similar or sometimes identical types of disputes, thus requiring a large amount of additional costs, time and efforts. The primary objective of this study is to propose a web-based decision support system for construction claim management, which enables contractual participants to easily access and use the information of the judicial precedents related to the current construction claims. The decision support system is composed of 'prevention' and 'settlement' modules for avoiding and systematically resolving the construction claims.

Analysis of Defect Repair Cost by Work Type based on Defect Inspection of Apartments (공동주택의 하자진단에 기초한 공종별 하자보수비용의 분석)

  • This study investigated defect status by work type, based on the report data of defect inspection results, acquired by consumers' request to safety inspection agencies, before the expiration of legal defect repair warranty period. In fact, the data was not acquired by centering on suppliers, namely, construction companies in relation with the defects becoming causes to increase construction cost of apartments. This study aims to provide objective and basic data for quality improvement at construction stage and for solution to defect disputes. The study results are presented below: (1) The number of defect cases occurring from architectural work among total work types were 1,986, defect occurrence rate was 62.5%, and defect repair cost was KRW $25,851/m^2$, which stood at 78.2% of the total work types. This means the defect occurrence rate and defect repair cost in architectural work are bigger than those of other work types. (2) Major defects in architectural work were revealed in the following order: cracks from frame work, inferior interior finishing work, inferior finishing work of plaster/masonry works, water leak/damage from waterproof work and withering/omission from landscape work. The total repair cost of the major selected defects was KRW $12,220/m^2$, and was analyzed to take up 37% of the total defect repair cost.

A Study on the Cognition of University Students about Insurance Industry (보험에 대한 대학생들의 인식수준에 관한 연구)

  • The purpose of this article is to measure the level of insurance industry's social cognition based on the university students' survey questionnaire. For this, this study analyzes the cognition of students on the level of social reliability, the causes of low reliability, and the measures of enhancing the reliability level about insurance industry. For the analysis of survey questionnaire, partially ranked data analysis was employed. The results show that most students recognize that the reliability of insurance industry is lower than that of other financial industry such as banks and securities firms. The main reason for this low reliability is the lack of sales forces' specialty, the complexity of insurance products and contracts, and negative media release about insurance industry. To enhance the social reliability level of insurance, establishment of the future insurance image is essential, and that can be achieved through strengthening the insurance education and public relations and simplifying insurance products and contracts.

  • A construction claim is generally caused by several causes, and in the case of developed countries, the most fundamental problem in most claims is a delay claim. Also, it is predicted that the trouble will increase by this one in a domestic case as well. Even though the construction claims occurred by the delay claim are the most frequent ill construction project, it is very difficult to analyze due to the complexity of occurring forms. Therefore, the rational judgement and the solving method need to be concerned through the accurate understanding the clauses accepted in a international contract execution and a domestic contrail when the claim occurred. The purpose of this study is to present problems and improving methods by comparing FIDIC with a domestic accounting regulation in order to expand a general condition into the international contract condition.

An Administration Model for Causes of Delay in Construction Projects to Decide Time Extension Responsibility (건설공사 공기연장 책임구분을 위한 지연사유 관리 모델)

  • Since the cases of time extension have continuously transpired in the public construction project, the potential of economical loss and claims is increasing because the concerned parties such as an owner or a contractor have not properly performed their own responsibility for time extension. One of the main reasons is that the present planning and scheduling do not support the method to apportion the proper responsibility to the right party. This problem has repeatedly led to time extension and made it difficult for the concerned parties to perform the responsibility for time extension. In order to overcome this problem, a framework of delay administration is required as the method to apportion the proper responsibility to the right party. To solve this problem, this paper aimed to develop the conceptual model and prototype system as the practical method to administrate delay causation. Furthermore, the verification result for the reliability and applicability throughout the case studies on real construction projects shows that the conceptual model and prototype system developed would help efficiently to administrate the delay causation.

  • If project time extension were required in the construction projects, either liquidated damages or extension costs should be applied according to causation of the schedule delays. However, in actual cases it is not applied so far according to the contract conditions. The reason why this situation happened Is that function of the present planning and scheduling is not working feasibly. The CPM schedule could not provide a proper solution for apportioning responsibility for the schedule delays. This situation could be considered as breach of contract and will cause potential disputes for schedule delay. Therefore, in this research process based contract administration model for construction delay claim is proposed to prevent schedule delay and solve the claims. The model is based on pro-active management for causation of delay to provide apportionment of responsibility and written evidences.

  • Although there are some technical reports on the example of Korea's first rocket, the Naro, there has been no studies on why there were two technical incidences in the space development programs which massive amount of physical and human resources were invested. For this, the objective of this study is to investigate the example of the Naro from the aspect of management and institutions as well as technical in terms of the responsibility of the R&D organization. Most important part in the responsibility of the R&D organization is the professional responsibility and it is difficult to attain the goals when they are diluted by political situations. Furthermore, this study also looked at the cause of the failure to exert righteous sovereign authority in the conflict with Russia from the discrepancy of goals between the authority and the agent, and studied efforts to prevent the recurrence of discrepancy.

  • The significance of soil environment is gradually increased due to the soil and underwater contamination caused by petroleum leak accidents. It requires a high cost and long period for the purification of soil compared with other environmental matrix such as water and air. For this reason, it has been embroiled in a legal conflict to find the pollution source and charge of cleanup. In this study, we analyzed the physical properties and typical additives of jet fuel to search a method that can distinguish kerosene and jet fuel contamination. In particular, the chemical marker in kerosene was visualized by the developer and the additives in jet fuel, such as antioxidant and metal deactivator were detected by GC-MS. This study could be used to judge petroleum source at soil contaminant accident sites.

  • This study aims to analyze the relationship between the expectation of franchisees to their franchisers before contracting and perceived performance after actually operation. The analysis data was collected from 789 franchisees located in Seoul and Gyeonggi-do of South Korea. The findings are as followings: first, the gap between expectation of franchisees and perceived performance was negative and it becomes an necessary for franchise managers to manage the expectation of franchisees by using various effective marketing strategies. Second, the gaps were different among different franchise industrial classifications and the gap in the food-service industry is the largest.

  • In recent years, the proportion of medium and small-sized apartments within the housing market has seen a noticeable increase, alongside a corresponding rise in disputes related to construction defects. Such disputes are most prevalent in the finishing works phase of construction, which not only are frequent in occurrence but also impose significant repair costs. Furthermore, there is a noticeable scarcity of research focused on the quality management of finishing work defects prior to the completion of construction. Addressing this issue necessitates a methodology capable of preemptively identifying defects by analyzing their frequency and associated costs across various defect types. Consequently, the aim of this study is to propose a risk assessment methodology by conducting an analysis of defect cases across 3,299 apartment units, considering aspects such as frequency and severity. The outcomes of this research endeavor are expected to offer practical management strategies to enhance the quality of apartment finishing works and serve as an academic foundation for the enhancement of construction management systems pertaining to apartment finishing works.
