공공공사 입낙찰제도의 현황과 효율적 운영 방안 -최저가낙찰제를 중심 으로-

  • 입낙찰제도의 효율적 운영은 건설산업의 발전과 산업구조 선진화를 위한 정부 정책의지 실현에 있어 핵심적인 요소가 된다. 본고에서는 현행 입낙찰제도 중 가장 큰 논란이 되고 있는 최저가낙찰제도를 대상으로 그 시행성과와 실태를 짚어보고, 그 개선방향과 효율적 운영방안을 제시하였다. 실태분석 결과, 현행 최저가낙찰제도의 핵심적인 문제는 지나친 저가낙찰로 인한 건설업체의 수익성 악화와 부실공사의 우려이며, 이는 건설업계의 차원을 넘어 국가와 공공의 이익에 있어서도 위험요소로 적용할 가능성이 크다. 그러나 건설산업의 선진화 관점에서 볼 때, 최저가낙찰제라는 제도 자체는 많은 긍정적인 가능성을 가지고 있는 제도이다. 따라서, 최저가낙찰제가 정착되기 위해서는 단기적으로는 실효성 있는 저가낙찰 방지대책의 조속한 수렵이 필요하며, 장기적으로는 최저가낙찰제가 제 기능을 발휘할 수 있도록 보증제도 개선, 발주자의 역량 강화 등 건설산업 전반에 걸친 제반 여건들을 정비해 나가야 할 것이다.

  • Construction demands will become high. Defects liability is treating with a consumer on a defect. Maintenance bond is overlooking excessive responsibility of construction industry participants. This study classified the problem that are divided to systematic and internal matter. And this study presented an improvement proposal. An improvement proposal of a process may reduce a financial burden of contractors and sub-contractors. And improved rate decision will do additional consideration of the study result, so that it is appropriated a rate rationally.

  • For the restoration of construction industry, the government have offered the policy since the end of 1990. It has offered to develop the world-class technology and establish the effective production structure. In the government policy, the delivery and contracting method has improved so that construction industry could be recognized. Foreign countries have conducted the R&D and application of Innovative Contracting for improvement of facilities, reduction of LCC and innovation of contractor. Among the Innovative Contracting, 'Performance Warranty Contracting' is defined that A guarantee of the integrity of a product and of the makers responsibility for the replacement or repair of deficiencies. Performance Warranty Contracting is used for technology developments of contractor, improvement of quality, reduction of LCC, prevention of early deficiencies and reduction of owner's inspection works. This paper analyzes concept and effects of Performance Warranty Contracting and presents considerations according to the introduction.

Efficiency Analysis of Credit Guarantee Institutions in North-eastern Asian Countries and Its Implication : Comparison Analysis of Credit Guarantee Corporations of Japan, Taiwan, and Korea (동북아시아지역 신용보증기관의 효율성 분석과 정책적 함의: 일본, 대만, 한국 신용보증기관의 비교분석)

  • Credit Guarantee scheme is one of the most effective tools for the small business policy. The performance analysis on domestic institution level is relevant in terms of various factors of assisting tools factor. This study measured comparative global efficiency by DEA model and Super-efficiency model among 70 credit guarantee institutions in Japan, Taiwan, and Korea who are operating the schemes. At the result of the analysis, Korean credit guarantee institutions are comparatively efficient than Japanese institutions, and the DMU shows moderate in operation efficiency. The Super-efficiency ranked by Hiroshima, Taiwan SMEG, Pusan, Chiba, Shizuoka, Ulsan, and KOTEC. Most of the Credit Guarantee Institutions showed increasing returns to scale, and it indicates increasing input strategy. The statistical difference of efficiency level in Japan and Korea shows very meaning numbers. This research suggest that (1)Periodical Analysis are needed on Japanese Schemes, (2)The analysis on the impact of credit guarantee scale to the national economy and SME policy, (3) Analysis on the conclusive factors of the efficiency, (4)The policy direction has to be made by inefficient factor analysis, (5) The measurement tools of efficiency of the schemes in various aspects.

Legal Problems and Improvement Measures Concerning the Monopoly of Housing Construction Sales Guarantee Business by Housing and Urban Guarantee Corporation (주택도시보증공사의 주택건설 분양보증업무 독점에 관한 법적문제점과 개선방안)

  • Issues have arisen over the monopoly of housing sales guarantees by the Housing and Urban Guarantee Corporation. If the Ministry of Land, Infrastructure and Transport appoints an additional guarantee institution, there is concern that the property protection between the two parties is insufficient due to excessive competition and the weakening of urban regeneration resources. It argues that housing supply policies for stabilization of the housing market can be smoothly implemented through monopoly projects. This is judged to be an abuse of market dominant position under the Fair Trade Act, and excessive restrictions on pre-sale guarantee requirements may cause delays in business and infringement of property rights of members. First, the establishment of a designation system for market dominant operators of the Fair Trade Commission enables new entry of private guarantee institutions. Second, it is necessary to improve regulations under Article 63 of the Fair Trade Act (consultation on the establishment of laws restricting competition, etc.). Third, through the establishment of the 「Rules on Housing Supply」 under Article 15 (2), the Minister of Land, Infrastructure and Transport can additionally designate a guarantee institution, thereby guaranteeing the right to select a pre-sale guarantee for the business entity. In addition, it is expected that at least one of a number of guarantee insurance companies can be designated to improve the efficiency of the distribution of social benefits, thereby lowering the volatility of housing prices.   • Result from Amendment of Apartment Houses Decree Customer Service, Recently, the starting point of Defects Liability changed "Criteria of Completion date" to "Delivery date to Divided property". Through the Law amended, There are some inconsistency between "Claim for repairing defects" and "Period of security deposit for repairing defects claim". If someone bought a house after Completion date, Purchasing period of "Claim to security deposit for repairing defects" lapsed without renewal. This research is to identify problems and solutions for improving the system.

  • 국토해양부는 지난 6월 17일 정부과천청사에서 제6차 건설산업 공생발전위원회를 개최하고 건설산업기본법을 위반한 건설업체에 대해 보다 명확한 기준으로 재제처분이 이뤄지도록 '건설업체 행정제재 합리화방안'을 제시했다. 또한 공제조합 보증금 개선방안도 제시됐다. 건설업체가 부도 파산 워크아웃 등으로 계약이행이나 하도급대금 지급에 어려움을 겪는 경우 하도급대금지급 보증금을 15일 내 지급 완료토록 개정키로 한 것이다. 이러한 개선은 대한설비건설협회가 건설산업 공생발전위원회를 통해 하도급대금 지급보증제도 개선을 촉구한 결과이다.

  • 국가를 당사자로하는 계약에 관한 법률 시행령∙시행규칙 및 회계예규가 일부 개정되었다. 이번에 개정된 주요 내용은 입찰참가자격 사전심사 대상의 확대 및 의무화, 최저가낙찰제 대상공사의 확대, 건설재해 및 제재처분 사항 관련 신인도 평가제도 개선(본지 법령과 고시① 참조), 공사의 현장설명제의 보완, 계약이행보증방법의 변경제도 도입, 부정당업자의 입찰참가자격 제한 범위 확대, 입찰방법 심의기구의 일원화 등이다. 본지는 국가계약법 시행령∙시행규칙 및 회계예규의 주요 개정 내용을 게재한다.

A Study on the Reform Model of Legal Deposit System in Korea (한국의 납본제도 개선모형에 관한 연구)

  • In digital environment the hallmark of the national libraries is its responsibility or function of acquiring and preserving the county´s off-line and on-line publications in term of legal deposit. But the legal deposit system based on print materials in Korea predates the digital age and requires a new legal framework. It would be a tragedy if national library was not to archive the nation´s intellectual and cultural heritage because of limitation of legal deposit system. The purpose of this paper is to analyze form of the current deposit system and to suggest a reform model for legal deposit legislation with priority given to legal scheme and elements(terms, the depositor, the depository, object of deposit, number of copies, time of deposit, compensation and fine, right of migration and free access, etc.).
