A Study on GIS DB Building Plan for Maritime Boundary Determination (우리나라 해양경계 획정을 위한 GIS DB 구축 항목선정에 관한 연구)

  • Intense competition for resources has forced many countries pay attention to their eyes to the ocean. Therefore, the disputes and the conflict over the delimitation of the EEZ and continental shelf will be sharpened. Since 1982 Law of the Sea Convention, Korea has opened the talks with Japan and China to discuss the boundary issues as the adjacent water zone is less than 400 miles between Korea and Japan and Korea and China. This study is to review the important rules and techniques for the delimitation of the maritime boundary which have defined in the Law of the Sea Convention and IHO-51 technical guide and to figure out how to build the maritime delimitation GIS DB to negotiate effectively with the neighboring countries. Definition of the base point and baseline will be the utmost important concept to delimit the ocean boundary. The policy makers and the specialists who prepare for the international negotiation meeting between the countries have to be ready to draw the maritime boundary for our best interest under the Law of the Sea Convention. The negotiation strategies and the principles can be made with the concrete and reliable database relevant to maritime boundary issues. So effective and fast strategic decision for negotiation can only be made based on maritime boundary delimitation GIS DB.

The Legal Status of Military Aircraft in the High Seas

  • The main subject of this article focused on the legal status of the military aircraft in the high seas. For this the legal status of the military aircraft, the freedom of overflight, the right of hot pursuit, the right of visit and Air Defense Identification Zone (ADIZ) were dealt. The 1944 Chicago Convention neither explicitly nor implicitly negated the customary norms affecting the legal status of military aircraft as initially codified within the 1919 Paris Convention. So the status of military aircraft was not redefined with the Chicago Convention and remains, as stated in the 1919 Paris Convention, as a norm of customary international law. The analyses on the legal status of the military aircraft in the high seas are found as follows; According to the Article 95 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) warships on the high seas have complete immunity from the jurisdiction of any State other than the flag State. We can suppose that the military aircraft in the high seas have also complete immunity from the jurisdiction of any State other than the flag State. According to the Article 111 (5) of the UNCLOS the right of hot pursuit may be exercised only by warships or military aircraft, or other ships or aircraft clearly marked and identifiable as being on government service and authorized to that effect. We can conclude that the right of hot pursuit may be exercised by military aircraft. According to the Article 110 of the UNCLOS a warship which encounters on the high seas a foreign ship, is not justified in boarding it unless there is reasonable ground for suspecting that: (a) the ship is engaged in piracy, (b) the ship is engaged in the slave trade, (c) the ship is engaged in an unauthorized broadcasting and the flag State of the warship has jurisdiction under article 109, (d) the ship is without nationality, or (e) though flying a foreign flag or refusing to show its flag, the ship is, in reality, of the same nationality as the warship. These provisions apply mutatis mutandis to military aircraft. As for Air Defence Identification Zone (ADIZ) it is established and declared unilaterally by the air force of a state for the national security. However, there are no articles dealing with it in the 1944 Chicago Convention and there are no international standards to recognize or prohibit the establishment of ADIZs. ADIZ is not interpreted as the expansion of territorial airspace.

  • Korea has maritime jurisdiction over an area 4.5 times larger than the nation's inland area, but negotiations with surrounding nations on the maritime boundary delimitation have still not been completed satisfactorily. In particular, maritime boundary delimitation has become an important issue in terms of maritime security and resource exploration. Considering national interests, the delimitation of the maritime boundary is essential. However, no system to help the decision-makers involved in maritime boundary delimitation has yet been systematically constructed. Therefore, the aim of this study was the development of a system to support such decision-making. In this study, considerations related to maritime boundary delimitation were investigated through expert advice and international precedents. Based on these considerations, data were collected from several organizations, and a spatial database was systematically constructed. Finally, MBDSS (maritime boundary delimitation support system) was developed to support maritime boundary delimitation. This GIS-based system provides visual information about the considerations for the maritime boundary delimitation. Thus, it could help decision-makers to choose appropriate boundaries during the negotiation. Furthermore, this system is expected to be utilized as a scientific tool on the delimitation of maritime boundaries.

Legal Issues Relating to Artificial Islands, Installations and Structures in the Exclusive Economic Zone or on the Continental Shelf and Korea's Practice (국제해양법상 인공섬, 시설 및 구조물 제도의 쟁점과 우리나라의 입법태도에 관한 고찰 -배타적 경제수역 및 대륙붕을 중심으로)

  • Artificial islands, installations and structures have been used as a major means for ocean development and management since the early 20th century. The International legal regime to regulate the man-made offshore structures also have evolved and the UN Convention on the Law of the Sea (UNCLOS) acts as a basic international instrument for that purpose. Although the Convention includes more detailed provisions on man-made offshore structures, there are some legal issues regarding jurisdiction of coastal State on the man-made offshore structures in the Exclusive Economic Zone (EEZ) or on the Continental shelf. For this reason, this article begins by reviewing the 1958 Convention on the Continental shelf and the UNCLOS by focusing on the EEZ and the Continental shelf regime governing the man-made offshore structures. It next examines some controversial international legal issues that have emerged from the regulation of man-made offshore structures in the EEZ or on the Continental shelf. This is followed by a review of the Korean domestic laws regulating artificial islands, installations and structures in the EEZ or on the continental shelf. Finally, it closes by summarizing the findings of the above examinations, and suggests some recommendations for future works.

  • 1970년대 중반 세계 주요 연안국(沿岸國)들이 배타적(排他的) 어업수역(漁業水域) 또는 경제수역(經濟水域)의 선포를 통하여 해양관할권(海洋管轄權)을 확대할 때까지 한국은 원양어업(遠洋漁業)의 발전과 어획량 증대에 박차를 가하였다. 그 당시 정부의 주요 정책은 재정 지원을 통하여 원양어선(遠洋漁船)의 선복량을 확충하는 것이었지만, 새로운 해양법질서(海洋法秩序)가 도입된 후로는 원양어업(遠洋漁業)에 대한지원 정책을 재검토하지 않을 수 없게 되었다. 그 당시 한국의 원양어업(遠洋漁業)에 가해진 압박을 타개하기 위하여 연안국(沿岸國)의 규제를 최소화하는 노력과 함께 경제성 있는 대체어장(代替漁場)의 개발에 주력한 결과 성공을 거두었는데, 그것은 바로 수산자원(水産資源) 보유국(保有國)과의 쌍무협정(雙務協定) 체결을 통한 어업의 계속과 더불어 공해어업(公海漁業)으로의 전환이었다. 최근에 한국의 원양어업(遠洋漁業)이 당면하고 있는 현안은 공해어업(公海漁業)에 대한 국제사회(國際社會)의 규제 강화와 더불어 국내 수산물 시장의 개방이라는 내우외환(內憂外患)이 겹친 위기상황(危機狀況)이다. 이러한 난국을 타개함으로써 원양어업(遠洋漁業)의 지속적인 발전을 추구하기 위하여 한국정부(韓國政府)는 새로운 전략을 마련하였는데, 그 구체적인 내용은 다음과 같다. 첫째, 자원을 보유하고 있는 연안국(沿岸國)과의 협력을 강화함과 동시에, 국제수산기구(國際水産機構)에서의 적극적인 활동을 전개하는 것이다. 현재 한국은 14개 연안국(沿岸國)과 쌍무적 어업협정(漁業協定)을 체결하여 기술이전 및 재정 지원을 통한 공동번영(共同繁榮)을 추구하고 있으며, 10개 국제수산기구(國際水産機構)에 가입하여 수산자원(水産資源)의 보존과 해양환경(海洋環境)의 보호에 노력하고 있다. 둘째, 원양어선(遠洋漁船)의 감축과 연근해어업(沿近海漁業) 구조 조정을 통한 합리적인 수산업 체제를 구축해 나갈 것이다. 즉, 원양어업(遠洋漁業)의 양적 팽창보다는 장기적인 안목에서 질적인 수준을 제고함으로써 안정적인 산업으로 내실을 기할 수 있도록 경영의 합리화와 같은 업계 자체의 체질 개선 노력을 지원할 것이다. 셋째, 현대의 해양법질서(海洋法秩序) 하에서 한국원양어업(韓國遠洋漁業)의 활로는 주로 자원보유국(資源保有國)과의 합작사업(合作事業)에서 찾을 수 밖에 없다. 이것이야 말로 연안국(沿岸國)과 원양어업국(遠洋漁業國)에게 공통적으로 이롭다는 사실이 입증된 것이기 때문이다. 따라서, 원양어업(遠洋漁業)을 해외합작사업(海外合作事業)으로 전환하는 데에 있어서 정부가 지원해야 할 부분은 다음 세 가지로 요약된다. 즉, 장래성 있는 사업 분야에 대한 적극적인 재정지원(財政支援), 생산된 수산물의 국내시장반입(國內市場搬入)에 대한 특별한 배려, 그리고 기업의 해외투자의욕(海外投資意慾)을 고취시키는 정책의 수행이다. 수산자원(水産資源)은 그 자체가재생산성(再生産性)을 갖고 있기 때문에 합리적으로 보존관리(保存管理)한다면 영속적인 이용이 가능한데, 이와 같은 이념은 1982년 유엔 해양법협약(海洋法協約)에서도 최선의 과학적 증거로써 "보존(保存)"과 "이용(利用)"의 조화를 유지하는 것으로 구현되어 있다. 따라서, 한국정부(韓國政府)도 그러한 차원의 국제협력(國際協力)에 기꺼이 동참함과 동시에, "투명성(透明性)"과 "책임(責任)"을 이행하는 어업 활동을 보장하기 위한 제도적 개혁을 진행 중이다.

  • 1996년도 UN해양법협약의 발효와 각국의 배타적 경제수역(EEZ) 선포로 연안역에 대한 관심이 국제적으로 고조되고 있는 가운데 우리나라에서도 연안역 관리법(가칭)이 제정되었다. 국토해양부는 연안역 공간이용 효율성 극대화와 부존 해양자원의 치계적인 개발과 보전을 위하여 연안역 관리법을 특별법으로 제정하였으며 1998년 중에 시행령 등 하위법령을 제정해 시행키로 하였다. 이 이후로도 연안역 특별법에 대한 연구는 계속 진행중이며, 현제 연안역은 연안어업, 수산양식장, 모래채취, 염전, 해수욕장, 관광지, 해양시설, 간척, 매립지, 공업단지 등으로 많이 이용되고 있다. 그러나 연안역 안전시설에 대한 상세 설계기준 및 시공에 대해서는 자세히 다루고 있지 않다. 연안역은 관광객이 증가하면서 안전시설과 구난장비의 미비한 실정으로 인해 인적 물적 피해가 빈번히 발생 증가하고 있는 것으로 나타나고 있다. 안전사고의 다발지역을 분석해 보면 관광객으로 인하여 방파제 주변에서의 안전사고가 증가하고 있는 상황이며, 이로 인한 인명피해도 증가하고 있다. 방파제에 대한 안전사고를 막기 위하여 우선적으로 방파제에 대한 안전사고를 해결하고자 인명피해를 막는 구난시설들에 대한 간격 등의 기준을 제시하였다. 다른 지역에 비하여 연안역은 파도에 의하여 사람이 떠내려가는 것을 고려하여 구난시설의 간격을 해안이나 다른 안전시설에 비하여 더 짧게 하였으며, 구난시설이 피해자에게 빠르게 전달되고자 멀리 던진 수 있으며, 구난시설을 잡음과 동시에 숨을 쉴 수 있는 여건이 조성되도록 연구하였다. 안전사고를 효율적으로 방지하기 위하여 인간공학을 접한 안전시설을 연구를 하였다. 인간공학이란, 인간의 행동, 능력, 한계, 특성 등에 관한 정보를 발견하고, 이를 도구, 기계, 시스템, 과업, 직무, 환경의 설계에 응용함으로 인간이 생산적이고 안전하며 쾌적하고 효과적으로 이용할 수 있도록 하는 것이다. 인간공학은 인간이 사용할 수 있도록 설계하는 과정에 있어 인간의 활용성 및 편리성을 증대하는 학문으로 보며, 설계초기 단계에서부터 인간의 요소의 체계적인 고려를 필요로 하게 되었다. 이 논문은 과거에 일어났던 사고사례들을 주시하면서 앞으로의 미래에 똑같은 사고사례가 발생하지 않도록 예방하이 위하여 인간공학과 안전시설을 통하여 연안역의 안전시설의 설치기준에 도움이 되는 자료를 제공하고자 한다.

Recent Discussions on the Naming of the Sea between Korea and Japan and Topics of the Geographical Toponymy (동해 표기의 최근 논의 동향과 지리학적 지명연구의 과제)

  • This study aims to summarize recent discussions on naming the sea between Korea and Japan and to draw some research topics of the geographical toponymy. The International Hydrographic Conference and the United Nations Conference on the Standardization of Geographical Names held in 2012 repeatedly saw clearly different positions of Korea and Japan on the naming of the sea. From the debates, four topics appeared distinctly which deserve receiving continuous interests in the field of geographical toponymy. These include: necessity of dual naming and characteristics of, and perceptions on the object of dual naming; political economic nature of the sea, e.g. semi-enclosed sea, EEZ, and relevant use of names; relationship between the sea containing strong emotional ties and its naming; additional definition of toponymic terminologies to proceed with more objective and logical discussions.

  • The formation and structure of the shelf front in the eastern part of the Yellow Sea are studied on the basis of oceanographic data collected in August, 1982 and February, 1983. This paper also describes the distribution of planktonic organisms of the shelf front. In summer the shelf front is formed in the area ($126^{\circ}02^'E-126^{\circ}05^'E$) ca. 20 miles from the shore at the depths of 15-25 m. in winter, however, no distinct shelf front is formed. Based on the cluster analysis of surface phytoplankton the species composition shaws a discontinuous pattern in the vicinity of the shelf front in summer, 1982. A similar trend is observed in distribution of some copepod species in winter, l983.

  • Korea's seas have the potentials of dispute against China or Japan due to the overlap of the territorial waters and EEZ. In case of marine accidents, the nature of the sea tends to eliminate much of the track, making it another hardship in evidence adoption in case of an international dispute along with the false entries of fishing vessels' journals. Marine Digital Forensics Protects the functions of computers and IT appliance on vessels and extracts evidence of voyage and accidents to resolve international dispute. The digital evidence, if tampered with its integrity, my lead to the rejection to a critical claim or may even fail to make a case. As a solution, this thesis suggests Marine Digital Forensics as a way to extract evidence and prove a claim. This may be utilized as means of scientific investigation on sea as overseas exchange increases and the vessels digitalize, leading to a solution in international disputes that may occur in the future.
