  • 요즘 현대사회는 주거생활을 윤택하게 하기 위해 많은 노력을 기울이고 있다. 특히, 런던협약에 의해 음식물 쓰레기에 대한 대안은 분명히 필요한 부분이다. 런던 협약은 세계 각국의 폐기물 투기로 오염이 심각해짐에 따라 1972년 2월 유럽국가들이 모여 체결한 협약으로, 런던 협약에 가입한 국가는 매년 자국이 해양에 버리고 있는 폐기물 현황을 협약사무국에 보고할 의무가 있고 해양투기 금지를 저준위 방사성 물질을 포함한 모든 방사성 폐기물과 산업폐기물의 해양투기를 금지하기로 결의한 협약이다. 본 논문에서는 태양열 집열판을 이용해 자체적인 전원사용이 가능하도록 하여 음식물처리기 제어를 :LCD를 통한 GUI(Graphic User Interface)시스템으로 접근성이 쉽게 조작하도록 하여 사용자 편의에 중점을 두어 설계하였다.

  • 유럽 국가들이 해양환경 오염의 심각성을 인식하여 1972년 최초로 해양투기를 규제하기 위한 지역협정인 오슬로 협약(Oslo Dumping Convention)을 체결하게 되었다. 이를 모체로 하여 런던에서 범세계적인 규제의 필요성이 제기되어 국제협약인 런던협약(London Convention)이 1972년에 체결되었다. 그 후 1990년대에 들어 런던협약 당사국들은 협약을 보다 근본적으로 개정할 필요가 있다는데 의견을 같이 하게 되었다. 1993년 제1차 개정그룹회의 이후 3년간의 작업 끝에 1996년 11월 7일 IMO 본부에서 열린 특별회의에서 1996년 의정서('96 의정서)가 채택됨으로써 협약의 전면적인 개정작업이 완성되었다. 우리나라는 2009년 1월 22일 가입하였으며 2009년 2월 21일에 발효되었다. 이에 따라서 우리나라는 폐기물 해양배출량을 지속적으로 감축하고자 노력 중이다. 본 논문에서는 폐기물 해양배출의 감축과 관리를 보다 효율적으로 하기 위하여 필요한 기술개발과 시스템 구축, 그리고 정부 및 지방자체단체의 정책수립과 법률개정을 위한 자료를 제공하고자 한다.

A Leg Analysis on the Discharge of Cargo Residue at Sea (화물잔류물의 해양 투입처분(배출) 사안에 대한 법률적 분석)

  • The Consultative Meeting of the Convention on the Prevention of Marine Pollution by Dumping of Wastes and other matter, 1972 (London Convention 1972) has requested to International Maritime Organization (IMO) Marine Environmental Protection Committee to collaborate and help clarify a boundary issue between International Convention for the Prevention of Pollution from Shops, 1973 as modified by the Protocol of 1978 (MARPOL) and the London Convention concerning 'dumping' versus 'discharges' during normal operations of ships in 2004, and subsequently established a Joint London Convention/MEPC Correspondence Group. The Contracting Parties to London Convention expressed their environmental concerns on the broad interpretation of the "cargo-associated wastes" by the States, which could be discharged by ships under MARPOL. Regulatory regimes for the cargo residues appear to vary among states. Some countries require fur ships to discharge their cargo wastes into the port reception facility and IMO also recommends doing so. This paper examines the related current national and international legal texts for the regulation of disposal of wastes from ships in order to analyze the current global concern on the marine pollution associated with waste discharge during operations of ships. In particular, we attempt to evaluate the likely marine environmental consequences arising from the disposal of cargo residue using an hypothetical case for the coal cargo residue among bulk cargos in this paper, since location, magnitude and frequency of the discharge of coal cargo residues into the sea adjacent to Korean Peninsula are not readily available. The cargo residues may be discharged to the sea according to MARPOL 73/78; however, its marine environmental consequences can be significant depending upon the characteristics and amounts of wastes to be discharged. Also the public tolerance of the environmental consequences would be widely different among nations. Multilateral environmental agreements, in general, more strictly apply their rules if there are other options to disposal at sea, i.e. port reception facility in this case. Therefore, port reception facilities for the wastes generated by ships are recommended to be further constructed in major national ports in order to reduce the risk of environmental damages during the operations of ships.

A Study on the Role of United Nations Regional Group System for the London Protocol (런던의정서에서 유엔 지역그룹체제의 역할에 관한 연구)

  • At the Intergovernmental Meeting held in 1972, the London Convention was adopted to prevent marine pollution from dumping of wastes and other matter. After that, at the special meeting held at the Headquarters of the International Maritime Organization in 1996, the London Convention was revised to consider advances in technology of treatment and disposal of wastes and to reflect changes in understanding of marine environment and then the London Protocol was concluded. The London Protocol states more concrete management system for ocean dumping than the London Convention and also provides that the Meeting of Contracting Parties shall establish those procedures and mechanisms necessary to assess and promote compliance with the Protocol. With the London Protocol in force since 24 March 2006, the Meeting of Contracting Parties adopted the 'Compliance Procedures and Mechanisms (CPM) pursuant to Article 11 of the 1996 Protocol to the London Convention 1972' and established the Compliance Group in 2007. According to the CPM, members of the Compliance Group shall be nominated by Contracting Parties, based on equitable and balanced geographic representation of the five Regional Groups of the United Nations, and elected by the Meeting of Contracting Parties. In 2009, the Republic of Korea nominated a member of the Compliance Group to be subsequently elected by the Meeting of Contracting Parties with the approval of other states in Asia Group. Through the United Nations Regional Group System based on geographical identity or political affinity, Contracting Parties to the London Protocol are expected to form a voting bloc or to exchange information in meetings on the London Protocol. In this sense, it is noteworthy that the London Protocol introduced marine environmental management system for comprehensive prohibition of ocean dumping with exception of the so-called 'reverse-list' which had been earlier adopted by the 'Convention for the Protection of the Marine Environment of the North-East Atlantic, 1992 (OSPAR)' whose contracting parties belonged to Western European and Other States Group. In recent years, the jurisdiction of London Protocol has been extended to protect and preserve the marine environment from all sources of pollution. This will make the United Nations Regional Group System play more important roles in the activities associated with the London Protocol. For this reason, this article has considered characteristics of the United Nations Regional Group System and has analyzed influences of this Regional Group System in meetings on the London Protocol. This could provide preliminary information for the Republic of Korea to give due consideration to the United Nations Regional Group System on the activities associated with the London Protocol.

  • 경제성장과 산업도시의 발달로 인해 물의 사용량이 증가함에 따라 하수처리장의 수와 규모가 커지고 있어 하수처리장에서 발생하는 하수슬러지의 양도 지속적으로 증가하고 있다. 런던협약 '96의정서 발효에 따라, 하수슬러지의 해양배출기준이 대폭 강화 되었으며 또한 2012년부터는 하수슬러지의 해양 투기가 전면 금지될 것이므로, 해양투기 등으로 처리되고 있는 하수슬러지를 에너지자원으로 활용하여 고유가 및 기후변화에 적극 대응하고, 런던협약 등에 따른 해양투기 금지('2012)에 대처하기 위해 하수슬러지의 처리 및 재이용 방법에 대한 최근의 연구동향을 고찰해 보았다.

The Present State of Domestic Acceptance of Various International Conventions for the Prevention of Marine Pollution (해양오염방지를 위한 각종 국제협약의 국내 수용 현황)

  • Domestic laws such as Korea Marine Pollution Prevention Law (KMPPL) which has been mae and amended according to the conclusions and amendments of various international conventions for the prevention a marine pollution such as MARPOL 73/78 were reviewed and compared with the major contents of the relevant international conventions. Alternative measures for legislating new laws or amending existing laws such as KMPPL for the acceptance of major contents of existing international conventions were proposed. Annex VI of MARPOL 73/78 into which the regulations for the prevention of air pollution from ship have been adopted has been recently accepted in KMPPL which should be applied to ships which are the moving sources of air pollution at sea rather tlnn in Korea Air Environment Conservation Law which should be applied to automobiles and industrial installations in land. The major contents of LC 72/95 have been accepted in KMPPL However, a few of substances requiring special care in Annex II of 72LC, a few of items in characteristics and composition for the matter in relation to criteria governing the issue of permits for the dumping of matter at sea in Annex III of 72LC, and a few of items in wastes or other matter that may be considered for dumping in Annex I of 96 Protocol have not been accepted in KMPPL yet. The major contents of OPRC 90 have been accepted in KMPPL. However, oil pollution emergency plans for sea ports and oil handling facilities, and national contingency plan for preparedness and response have not been accepted in KMPPL yet. The waste oil related articles if Basel Convention, which shall regulate and prohibit transboundary movement of hazardous waste, should be accepted in KMPPL in order to prevent the transfer if scrap-purpose tanker ships containing oil/water mixtures and chemicals remained on beard from advanced countries to developing and/or underdeveloped countries. International Convention for the Control if Harmful Anti-Fouling Systems on the Ships should be accepted in KMPPL rather tlnn in Korea Noxious Chemicals Management Law. International Convention for Ship's Ballast Water/Sediment Management should be accepted in KMPPL or by a new law in order to prevent domestic marine ecosystem and costal environment from the invasion of harmful exotic species through the discharge of ship's ballast water.

[ $CO_2$ ] Sequestration in Geological Structures in the Maritime Area: A Preliminary Review (이산화탄소 해저 지질 구조 격리: 기술 현황과 제도 예비검토)

  • Anthropogenic emissions of greenhouse gases, particularly carbon dioxide($CO_2$) which arises mainly as wastes from the fossil fuel burning processes, are causing global warming. The effects of global warming become increasingly felt all over the world including sea level rise and extreme weather. The more direct consequences of the elevated atmospheric $CO_2$ on the ocean is the acidification of the surface ocean which brings a far reaching adverse impact on the life at sea and probably on the whole ecosystem of the planet. Improvement in energy efficiency and use of alternative energy sources are being made to reduce $CO_2$ emissions. However, a rapid transition to alternatives seems unachievable within a few decades due to the constraints on the associated technology and socio-economic factors in the world, since fossil fuels make up approximately 85% of the world's commercial energy demands. It has now been recognized that capture and geological sequestration of $CO_2$ could significantly reduce its emissions from fossil fuel utilization and therefore provides the means to rapidly achieve large reductions in $CO_2$ emissions(excerpts from London Convention, LC/SG 28, 2005). In Korea, well-developed sedimentary basins are spread over the vast continental shelf and slope regions, whereas, the land is densely populated and limited in area. Consequently, the offshore area is preferred to the land for the sites for geological sequestration. The utilization of the offshore area, however, may be subject to international agreements including London Convention. In this paper, the recent trends in technologies and regulations for $CO_2$ capture and geological sequestration are described to encourage its applications in Korea.

  • 과거 해양이 무한한 정화능력을 가진 장소로 오판하여 산업사회 이후로 육상의 폐기물을 해양에 투기하였으나, 현재에는 모두 그 그러한 행위가 우리의 해양환경을 위협하는 오염원이라는 것에 대해서 아무도 이의를 제기하지 않는다. 국제적으로 해양투기를 금지하고, 또 필리핀, 일본, 우리나라를 제외하고는 공식적으로 모든 나라가 해양투기를 금지하고 있다. 일본은 2007년부터 전면금지, 필리핀은 개발도상국임을 고려할 때 우리나라의 해양투기는 심각하게 고려해야할 문제인 것이다. 다행히 국가와 국민 모두가 해양투기의 심각성을 알고 이에 대처하기 위하여 제도적, 사회적, 문화적으로 다각도로 노력하고 있는 것은 알고 있지만, 이 문제는 국가가 주도적으로 나서서 해결해 나가야 하는 것인 만큼 지금보다 더 적극적인 자세로 규제하고, 관련한 문제들을 해결하기 위하여 노력해야 한다.
