이 글의 목적은 디지털 저작권과 프라이버시 사이의 경합적 요인을 분석하고 균형을 위한 대안을 제시하는데 있다. 현재 대부분의 디지털 저작권 보호기술의 핵심은 사용자를 식별할 수 있는 방법에 있는데, 이러한 사용자 식별은 익명성을 기반으로 하는 프라이버시에 대한 침해요인이 되고 있다. 이와 같은 경합적 요인을 해결하기 위해 익명성을 보장하는 디지털 저작권 관리기술들이 많이 제안되었으나, 그 대부분이 부분적인 문제에 대한 프로토콜의 형태로 이루어진 대안으로, 현재의 인터넷 환경, 사용자의 행동양식, 경제적 요인 등과 부합하지 않는 측면이 많아 적용하기 곤란하다. 한편, 디지털 저작권 보호를 위한 여러 기술적 노력들도 사실상 저작권 보호 효과는 미미한 반면, 사용자의 권리와 프라이버시에 대한 침해요인을 증대시키고 있다. 현재의 상황은 디지털 저작권과 프라이버시의 균형을 위한 기술적 해결이 요원한 상태이다. 이러한 상황에서 균형을 위한 대안으로 법률에 의한 조정과 새로운 비즈니스 모델을 통한 디지털 저작권 보호가 효과적임을 주장하고자 한다. 즉, 기술적 완벽성보다는 사용자 편리성에 의한 실질적인 저작권보호와 법률과 사용자 계도를 통한 프라이버시 보호를 제안한다.

디지털 콘텐츠가 넘쳐나는 가운데, 최근 이미지 저작권에 대한 중요성이 대두되고 있다. 블로그 및 SNS에 쉽게 게시물을 업로드가 가능한 점으로 인해, 이미지 저작권의 침해가 광범위하게 이루어지나, 저작권의 소유자는 침해된 자료를 찾기 위해 일일이 검색하고 적발하는 방식을 사용하고 있어 비용이 많이 들며 저작권 침해 속도에 크게 못 미친다. 이러한 문제를 해결하고 궁극적으로 저작권의 권리 보장과 저작권 침해 예방을 위해 본 연구에서는 키워드 검색으로 얻은 게시물에 게재된 이미지를 저작권 침해 적발 방법을 자동화하는 시스템을 제안하고 실험결과를 제시하였다.

Designers need to manage their copyrights. Designers be placed in both situations. The two situations is sometimes the case that infringes their copyrights and infringes the copyrights of others. But most designers do not know what to do to deal with this situation. Designers have to judge a lot of things for themselves. Designers should inform the user that you have infringed my copyright. And they will have to think about the legal proceedings. This paper was written based on the legal process, conducted from 2012 to 2014. Copyright infringement countermeasures for designers through this case were investigated. And to organize a correspondence course was organized personal correspondence, legal action, ruling process. The study of the processes for copyright holders themselves to respond to the piracy situation is needed.

As the Internet is widely used worldwide, digital asset on the internet becomes to be critical to protect from illegal copying and piracy which is an unlawful action that download or upload copyrighted materials from the Internet without having a right to use them from the copyright owners. Such an illegal and unethical behavior are pervading and becoming a big concern in many industries and business sectors over the world. This study examines the effect of the user's perception for piracy regulation and moral obligation on online piracy intention. Therefore, the purpose of this study is to see the different effect of regulation and moral obligation on piracy attitude and intention so as to suggest an effective method of piracy protection and to bring an attention on moral and ethical education for online piracy. The result of this study showed both punishment and moral obligation toward online piracy are significantly associated with users' attitude on piracy, indicating that higher level of punishment severity as well as moral obligation lead to decrease piracy attitude. This research also revealed that the level of users' moral obligation has a stronger relationship with piracy attitude than punishment.

This investigates the major factors that impact digital contents piracy in a college environment, mainly because the violation of the copyright is known to occur most often in college environments. Using a theoretical model based on Theory of Reasoned Action, this study examines the causal relationships among the variables of the digital contents piracy behavior. Major research variables include intention to commit piracy, attitude, social influence, fear of legal consequences, enjoyment, perceived easiness, knowledge level, and facilitating conditions. Survey responses from 335 undergraduate and graduate students indicate that the attitude and social influence affect the intention to commit piracy, and that social influence, enjoyment and perceived easiness influence the attitude. But, contrary to our expectation, knowledge level has been found to have no impact on the attitude. Perceived easiness, fear of legal consequences and facilitating conditions have all been shown to affect social influence. As a conclusion, the academic and practical implications of these findings are discussed.

웹 콘텐츠의 특성상 분배, 복제 및 조작이 용이하기 때문에 원 정보의 저작권 침해로 인한 재산권 침해 피해가 나날이 증가하고 있어, 막대한 비용이 투자된 웹 콘텐츠의 무단도용을 방지하고 분쟁 발생시 소유권에 대한 분쟁을 해결하기 위한 노력이 계속되고 있다. 본 논문에서는 웹 콘텐츠의 소유권 및 저작권 보호를 위한 오디오 콘텐츠에 대한 워터마크 생성, 삽입 및 검출, 검증 시스템을 설계 및 구현한다. 본 시스템은 저작권 보호에 대한 전문지식이 없는 일반관리자도 용이하게 이용할 수 있는 사용자 인터페이스를 갖추고 있으며, 이러한 디지털 오디오 워터마킹의 적용을 통한 소유권 및 저작권 보호는 궁극적으로 콘텐츠 제작 의뢰자로 하여금 제작 의지를 강화하여 제작 의뢰 건수를 증가시킬 수 있을 것으로 기대되어 문화콘텐츠 등의 디지털 콘텐츠 제작업체의 매출 신장에 도움을 주게될 것이다.

MP3, DVD, P2P 등 디지털 매체기술의 발달은 디지털콘텐츠의 창작과 유통을 급속도로 증가시켰고 일반 공중은 다양한 창작물에 쉽게 접근할 수 있게 됐다. 반면 이러한 기술의 발전은 원본과 거의 차이가 없는 복제물을 쉽고 빠르게 비용을 들이지 않고 재생성하게 하였고, 또한 디지털콘텐츠는 한 번 전송되고 나면 그 침해를 막기가 거의 불가능하기 때문에 저작권자의 이익을 저해하는 사례가 점차로 증가되고 있다. 이에 저작권자들은 자신들이 창작한 저작물을 무단복제로부터 보호하기 위해 암호화기법, 디지털워터마크 등 기술적 조치(technological measures)를 개발해 저작물에 대한 접근을 제한하기 시작했다. 이러한 움직임과 더불어 접근제한시스템에 대한 법적 보호의 필요성이 제기됐고, 저작권자의 허락없이 기술적 보호조치를 무력화하거나 침해하는 행위를 금지하는 입법이 이뤄졌다. 그러나 기술적 보호조치를 보호하게 되면 전통적으로 인정해 온 저작물에 대한 일반인의 접근을 차단하게 되므로 저작권법의 근본적인 입법취지인 과학기술의 발전과 문화증진을 저해하게 될 것이라는 비판도 강력히 맞서고 있다. 이하에서는 기술적보호조치에 관한 사례들을 소개하고 기술적 보호조치의 개념, 관련 법률조항 및 주요 법적 쟁점 등을 중점적으로 살펴보도록 하겠다.

본 연구는 저작권 보호를 위한 홍보를 본 수용자들의 저작권에 관한 인지도와 저작권 침해가 줄어드는 효과가 있는지 알아보는데 목적이 있다. 최근 인터넷의 일상화에 따른 온라인에서의 저작권자와 수용자들 간에 법적 공방이 잦아지고 있고, 디지털 상품의 유통의 경로가 확대되고 있다. 이는 국내 뿐 만아니라 국외에서도 마찬가지로 저작권에 관하여 많은 사회적 이슈가 되고 있다. 이에 따라 저작권 보호를 위한 캠페인과 광고를 각종 매체에서 다양한 형태로 홍보를 하고 있다. 하지만 현실상 수용자들은 저작권 침해를 빈번하게 하고 있으며, 저작권법에 대하여 무지한 상태에서 저작권법 위반으로 고소되는 경우가 생겨나고, 강력해진 법적조치에 따른 반감을 사고 있다. 이에 관하여 저작권 보호를 위한 홍보의 현황을 알아보고, 계획적 행동이론(TPB)에 적용하여 저작권 보호를 위한 홍보가 저작권 보호 의도에 미치는 영향을 알아보고, 홍보 매체에 따른 차이가 있는지 알아본다.

Internet is widely spreading in everyday life and it makes easy to find and share information on the Internet. Many of Internet users are copying and distributing copyrighted materials freely on the Internet without recognizing that it is unethical and illegal behavior. The rate of Internet piracy is constantly increasing even though the regulation and punishment for piracy behavior are to be strict. However, there is a lack of study about the relationship between the punishment and education for intenet piracy on users' attitude and intention toward piracy on the Internet. The purpose of this study is therefore to find out the effect of the level of punishment for internet piracy on users' attitude and intention. This study also examines the moderating effect of piracy education on the relationship between punishment and piracy intention. The study shows that the punishment is directly associated with the attitude but not associated with the piracy intention. The piracy education has a significant effect on the relationship between punishment and intention. The result of this study could bring up the issue of intellectual property protection on the Intenet and suggest an importance of piracy education to educators, managers and internet users.
