Occasionally an owner of public construction work pays financial costs in addition to progress payments. However, the overall scale of financial costs are not known. This research examines, based on a case study, the financial cost incurred in public construction works and the following issues: the overall scale of financial costs, the impact on financial costs on the owner, and the impact of timing on the overall sum of the financial costs. Annually, more than 2.3 trillion KRW are paid as progress payments for public construction work; yet, there is no research data showing the scale of financial costs thus incurred. The purpose of this research is to illustrate the scale of financial costs incurred due to progress payments for public construction works, and to suggest alternatives that would improve relevant regulations.

Recently construction companies' capital condition has been aggravated due to low profit, fierce competition and market contraction. For this reason, the companies rely on public construction projects that protect construction fee by regulations. Despite these regulations, problems regarding progress payment are constantly happening. Also, insufficient analysis on interaction between contractors makes policy making difficult. Thus, in this study, interaction between contractors are quantitatively determined according to delay of application and payment based on current public construction regulations on construction stage. A system dynamics model is used, which analyzes the problems based on an interaction between contractors, and solutions for progress payment application and payment delay are suggested according to the research results.

공사대금에 대한 압류나 가압류가 이루어진 경우 하도급대금 직접 지급 가능 여부와 관련한 논란에 대해 사업부가 가능하다는 판결을 내려 주목된다. 전주지방 법원 제2민사부 (재판장 조현욱 판사)는 "기성금의 청구일자보다 제3 채권자의 압류나 가압류일 자가 앞선다고 하더라도 직접지급합의서가 제3채권자의 압류나 가압류보다 먼저 작성됐다면 발주자는 하도급대금을 수급사업자에게 직접 지급해야 한다"고 판결했다. 3개의 전문건설업체가 전주국도유지건설사무소를 상대로 '하도급대금을 직접 지급해 달라'고 청구한 소송에서 재판부는 "발주자가 하도급대금을 수급사업자에게 직접 지급하기로 발주자,원사업자,수급사업자 간에 합의한 경우에는 '그 합의한 때' 발주자의 원사업자에 대한 대금지급채무는 소멸된다'며 이같이 판결했다. 이번 판결이 하도급거래공정화에 관한 법률 제14조 제 2항에서 규정하고 있는 '발주자의 원사업자에 대한 대금지급채무의 소멸시기'가 '수급사업자가 하도급대금의 직접 지급을 요청한 때'가 아닌 '발주자,원사업자,수급사업자 간에 직불을 합의한 때'임을 분명히 한 것이어서 하도급대금 직불에 미온적이었던 발주기관들의 관행을 개선시키는 계기가 될 것으로 예상된다.

In multiple apartment construction project, BCWS is a critical management factor and has a great influence on the success of the project. Due to the many apartment buildings & facilities which produce numerous activities, there are several problems in making out a time schedule of work as well as production and management of precise BCWS from the allocation of resources. In this study, actual condition survey was executed in terms of the calculation and the management of BCWS. This study propose better solutions for efficient calculation of BCWS through the analysis of the problems and standard schedule & progress curves.

본 연구는 지방국토관리청의 시설공사의 계약 체결과 기성 준공금 지급 업무를 대상으로 발주청 내부시스템과 국가종합전자조달시스템간의 연계를 위한 업무절차 개선방안을 마련하고 관련 기능을 개발함으로서 건설사의 계약 및 기성 업무처리의 효율성을 제고하고자 한다.

Blockchain is a secure technology that enables transactions between parties without risking data corruption. Besides cryptocurrencies, blockchain technology is being widely adopted in various forms by diverse industries. One promising application is construction contracts. Given that construction projects are executed under strict contractual requirements, blockchain technology-based contracts can ensure that contractual requirements are executed among parties to the contract. The objective of this study is to apply blockchain technology to smart construction contracts and determine their potential feasibility in construction management. In this study, a prototype smart construction contract is presented and its applicability is explored. We conclude that smart construction contracts can be effective as a contractual tool to enhance payment flows in the construction process.

한국 및 국제적인 미래사회의 요청에 의하여 공학계대학원교육의 확립은 중요하다고 사료된다. 이를 위하여는 정부와 산업계의 올바른 의사판단이 요구되며 또한 시급히 해결한 문제일 것으로 보인다. 이를 위하여는 다음과 같은 사항들이 고려되어야 한다. 1. 정밀한 평가와 해당대학원의 의지에 의하여 그 대학원의 특성을 결정한다. 2. 우수한 교수진이 확보되어야 하며 또 충분한 지원인력이 뒤따라야 하고 합리적인 보수가 지 급되어야 한다. 3. 공학에서 직업주의(professionalism)가 정립되어야 하고 합리적인 교육목표, 교과과정, 학사운 영이 기획되어야 한다. 4. 학문의 발전을 위하여 박사과정의 확립이 시급하며 계속교육체제가 기성기술자를 위하여 교 부되어야 한다. 5. 실험시설의 완비 및 그 운영비의 확보와 대학원학생들의 연구에의 전념을 위하여 장학금이 지급되어야 한다.

건설산업기본법이 지난 6월 1일 개정되어 시행에 들어갔다. 이 중 대한설비건설협회가 하도급자의 권리 보호와 공생발전을 위해 그동안 국토해양부에 관련제도 개선을 지속적으로 건의한 결과 하도급자 보호를 위한 부당특약 유형 확대 등이 개정되었다. 하도급자 보호조치 강화로는 부당특약 유형 확대, 하도급공사 준공 기성 검사결과 통지 의무화, 선급금 지급기한 신설, 도급계약서 미교부시 과태료 부과 등이 개정되었고 부실 부적격 업체에 대한 제재 강화로는 건설업 등록의 결격사유 강화, 건설업 등록말소 기준 강화 등이 개정되었다. 또 건설업 신고대상 추가, 과징금 상향조정, 과태료 대상 등도 개정되었다.
