  • The right of hot pursuit is an exception to the general rule that a ship on the high seas is subject to the jurisdiction of the state whose flag she flies. The right of hot pursuit is provided in the United Nations Convention on the Law of the Sea. This paper discusses the requirements for the right of hot pursuit. The use of force should be avoided during hot pursuit. When force is unavoidable, it should not be used beyond what is reasomable and necessary in the circumstances.

  • IMO has established International Convention for the Control and Management of Ships' Ballast Water and Sediment 2004 in February 2004 in order to prevent transfer of aquatic organisms through ballast water. According to the Convention, Each countries are preparing ratification and legislation process and encouraging the development of treatment system to satisfy the performance standard in the Convention. This Electro-$Cleen^{TM}$ treatment system was granted IMO basic approval in March 2006, and final approval in October 2008. The Type Approval Certificate was issued in December 2008 by the Government of Republic of Korea. This paper considers the matter of principle mechanism, overview of the system, installation on shipboard and shipboard test results for the Electro-$Cleen^{TM}$. Shipboard tests with the 8300 GT M/V Yokohama and 27,000 DWT M/V Greenwing have already been conducted. These tests confirmed that the Electro-$Cleen^{TM}$ system satisfies all of the IMO standards and is suitable for installation in new and existing ships.

  • United Nations Environment Program adopted a global binding agreement to regulate the production and distribution for the persistent organic pollutants (POPs) in May 22, 2001. The agreement took its effectuation with the ratification of 59 countries from the approval of 151 countries in May 17, 2004. After the approval on the binding agreement in October 4, 2001, South Korea performed systematic investigation for the ready of ratification on the convention with country-specific exemption for some chemical substances. Case study with documentary examination and fact-finding survey found some potential problem for 5 chemical substances such as chlordane, dichloro diphenyl trichloroethane (DDT), hexachlorobenzenes (HCB), heptachlor, polychlorinated biphenyls (PCBs). However, subsequent investigation with more detailed degree showed the possibility for the ratification with no country-specific exemption.

  • UNCLOS recognizes the right of innocent passage in the ocean but grants jurisdiction and governance to the state of the flag the vessel flies. However, by granting the right to determine vessel's nationality to each country in UNCLOS and by practically consenting inconsistency with the ownership and the state of flag has made the keeping of maritime order quite difficult. Especially, acknowledging the exclusive rights of the flag state on criminal jurisdiction hinders the owner state from exercising its rights and exposes the problem of not taking into account the opinion of the affected state party. This study addresses these issues and examines international regulations on vessels and flag states, mainly UNCLOS, and provides case studies on how criminal jurisdiction is determined when accidents occur at sea. Furthermore, it takes a deeper look into the mutual assistance system in criminal matters and proposes some alternatives on how to overcome these issues.

한·중·일의 산업별 이산화탄소 배출구조와 배출요인 비교 분석 - 동북아지역 국제환경협력을 위한 모색 -

  • 이 논문에서는 이산화탄소 배출 감축을 위한 국제적 협력이 구체화 될 경우 동아시아에서 잠재적 상호 협력 대상국이 될 수 있는 한국, 중국, 일본을 대상으로 그리고 논의의 주요한 시기적 기점이 되는 1990년에 대해 이산화탄소 배출량을 추정하고 삼국간의 배출량의 차이를 산업별로 비교하고 그 차이를 발생시키는 요인에 대해 분석을 시도하고 있다. 여기서 중국은 지구온난화 가스 배출에 있어서도 세계에서 주요한 비중을 차지하고 있다는 점에서 그리고 한국은 새로운 OECD 회원국이 된 대표적인 신흥공업국으로서 지구 온난화 가스 감축을 위한 국제적 압력의 대상이 되고 있다는 점에서, 그리고 일본은 동아시아에서 환경문제에서도 유일한 선진국으로서 국제적 협력관계에서 지원국의 입장에 서게 될 것이라는 점에서 각각 중요한 의의가 있다. 한편 1990년은 1992년의 지구온난화 협약에서 논의의 기준연도이기도 하지만 한국과 일본에서 산업연관분석 통계가 이용 가능한 최근의 연도이기도 하다. 그러나 중국의 경우 이용 가능한 1987년도 산업연관분석 통계자료가 사용되었으며, 삼국에 대해 각각 에너지 및 이산화탄소 배출 원단위 통계 등을 이용하여 이산화탄소 배출량의 추정 및 배출 요인의 비교 분석이 이루어 졌다.

Review on the Regional Cooperative Activities for Marine Environmental Conservation in Northeast Asia: with Special Reference to the Northwest Pacific Action Plan (NOWPAP) (동북아시아 해양환경보전을 위한 국제협력활동의 현황과 발전방향: 북서태평양보전실천계획(NOWPAP)을 중심으로)

  • The geography, circulation pattern, and ecology show that the semi-closed seas of Northwest Pacific be managed as one complete system. Ongoing multilateral cooperative efforts relevant to marine environmental protection in the Northwest Pacific area, include the Working Group for the Western Pacific (WESTPAC) established under the auspices of WNESCO's Intergovernmental Oceanographic Commissions, the UNDP/GEF Programme on Prevention and Management of Marine Pollution in East Asian Seas (PEMSEA), the North Pacific Marine Science Organization(PICES), and the United Nations Environment Programme(WNEP)'s Northwest Pacific Action Plan(NOWPAP). The present report firstly describes the current situations on the existing regional cooperative regimes for marine environmental conservation in the Northwest Pacific region, with a special respect to the Northwest Pacific Action Plan(NOWPAP) which was adopted in 1994 by Japan, People's Republic of China, Republic of Korea and Russian Federation. Then, problems of the existing regimes are also discussed, together with the suggestion of the possible solutions, focusing on NOWPAP. Suggestions include: 1) the Northeast Asian countries should understand the importance of legally-binding regional convention, and should build up any legally-binding instrument which can function as a big umbrella for real regional cooperation without prejudice to the rights of the States, 2) At present stage, it will be possible to make a regional convention flexible without prejudice to the sovereign right of the States or territorial issues; 3) taking into account that the region often faces many generic political problems that often inhibit the effective collective actions on environmental issues, the leadership from UNEP or other international organizations is required; 4) strong institutional and financial framework should be made, and 5) multilateral efforts to respond to the new marine environmental threats should be taken at the regional level in order to protect the coastal and marine environments in the Northwest Pacific.

  • Ground, sea and air mobility, such as vehicles, ships, and airplanes, are generally operated by people. Based on the innovative development of autonomous decision-making systems and artificial intelligence (AI) following the recent fourth industrial revolution, research and development on maritime autonomous surface ships (MASS) is been actively performed around the world. Before the realization of the commercialization of MASS in international maritime transport, it is urgent to clarify the characteristics of this ship and its international legal status. This paper aims to analyze the concern of whether a ship without crew members will eventually be operated as a fully unmanned ship or can be recognized as a ship under international law as the number of crew members is gradually reduced owing to the development stage of autonomous ships. Consequently, based on the United Nations Convention on the Law of the Sea (UNCLOS) and the regulations of the International Maritime Organization (IMO), it was found that MASS has the same international legal status as general ships. In addition this paper presents the working principles of enacting and revising the IMO Conventions and international legal measures necessary for the safe operation of MASS.

  • 스톡홀름협약은 잔류성유기오염물질(POPs)의 위해로부터 국민의 건강과 환경을 보호하고자 동 물질의 저감 또는 근절을 목적으로 2004. 5. 17에 발효된 국제협약이다. 현재 150 여개국이 서명, 120개국이 비준하였으며 우리나라는 2001. 10. 4 서명하였다. 이 협약의 주요 의무사항은 의도적으로 생산되는 POPs 제품의 생산,사용 금지 또는 제한하고 비의도적으로 생산되는 POPs 배출저감 또는 근절(대상물질 : 다이옥신, 퓨란, HCB, PCBs)이다.

  • 최근에 지속적 발전(sustainable development)은 환경정책 분석뿐만 아니라 현대 환경, 생태 경제학에 있어서 중요한 개념이 되어왔으며, 이 개념은 어업에 있어서 특히 중요한 국제적 이슈(issue)가 되고 있다. 어업은 갱생자연 자원에 입각한 산업으로서 지속적 발전의 길로 가야만 한다. 이것은 1982년 UN해양법 협약(UNCLOS), 1995년 UN경계왕래성 어족과 고도회유성 어족에 관한 집행협약 (UNIA), FAO의 책임있는 어업(the Code of Conduct fer Responsible Fisheries)을 위 한 국제규범과 일련의 기술지침서에서 구체적으로 표현함으로써 국제적 합의가 이루어 지게 되었다. 지속적 발전의 개념에 대한 심층적인 이해는 어업 관리자가 어업정책의 수립과 평가에 대한 새로운 요소와 기준을 설정함에 있어서 중요한 의미를 부여한다. 이것은 특히, 어업관리자(정부와 단체 그리고 어업자)가 어업관리 목표 어종 및 비관리목표 어종과 어종의 생태, 그리고 환경을 포함한 어업 자원의 직접 사용 가치와 비사용 가치(즉, 내재 가치 )등에 관련된 제문제를 다루는 것을 그 내용으로 한다. 따라서, 이 논문은 국제사회에서 지속적 발전과 관련된 지식의 현 주소와 어업관리에 있어서 갖는 함축적 의미와 주로 관계된다. 이 논문은 지속적 발진에 대한 개념의 기원과 형성과정, 개념 구조를 상세히 고찰함으로써 어업의 지속적 발전을 위한 어업관리정책 수립을 위한 방향설정에 기여하게 될 것이다. 또 이 논문에서는 지속적 발전의 개념하에서 어업의 지속성과 지속적 발전이 어업관리에 어떠한 의미를 갖는지 고찰한다. 그 하나로 이 논문에서는 FAO에서 최근에 제시한 해양어업의 지속적 발전지표를 어떻게 설정하는지에 대한 가이드라인을 분석 고찰 하였다. 이 FAO의 지속적발전지표는 지속적 발전의 평가체계의 구성요소와 어업에 대한 지속적 평가체계[sustainable development reference system(SDRS)]를 수립하는데 있어서 필요한 관련 절차에 관해 특별한 의미를 부여해 줄 것으로 생각한다. 마지막으로 본 논문에서 는 SDRS가 지역어업 협력체계 구축에 있어 서 어떠한 역할을 할 것인가를 강조함으로써 결론을 내리고 있다.
