A Study on the Bid MIS in Construction by Object-Oriented Methodology (공공건설 입찰관리 정보시스템에 관한 연구 - 객체지향 방법론에 의한 공사실적관리를 중심으로 -)

  • Traditional bidding process and activities in public construction area has many problems in terms of the clearness and fairness of administration. And, it causes many cost consumption to suppliers. As part of the efforts to solve these problems, some public institutions developed the electronic bidding systems. But these systems have still problems in diverse aspects. Therefore, the purpose of this study is to analyze current bidding systems through literature survey and questionnaire, to compare the result of the analysis with the developed electronic bidding systems and to suggest the improvement for the coming bidding systems.

A Study on the Perception Gaps on the Causes and Improvement Measures of Bid Rigging in the Construction Industry due to the Abolition of Industry Regulations (업역규제 폐지에 따른 입찰담합의 원인과 개선방안에 관한 인식 차이)

  • This study examined the causes and remedies of bid-rigging in the construction industry through a survey of procurement practitioners. The study identified potential problems from the business, construction, and bidding environments, and proposed improvements to the procurement and bidding systems to address these problems. The study found that transparency, fairness, and diversity are important factors in reducing bid-rigging. These factors can be achieved through a variety of measures, such as expanding bidding systems, strengthening fairness standards, and increasing the diversity of participating companies. The study also found that unfair subcontracting regulations are a problem that needs to be addressed. There were differences in the perceptions of the causes of bid-rigging between the general and specialized construction groups. However, there was no difference in the perceptions of improvements to the procurement system between the two groups. This suggests that a consistent solution to bid-rigging can be found. The study's findings are expected to contribute to the resolution and prevention of bid-rigging in the construction industry.

An Empirical Study on the Possibility of Duplicated Sanctions in Bid-rigging on Construction Projects (건설공사 입찰담합의 중복제재 가능성에 관한 실증연구)

  • Bid-rigging is a common issue in public construction projects, and appropriate sanctions are required from the relevant authorities. This study analyzes the need for an optimal enforcement model to prevent bid-rigging by considering both civil and criminal aspects. Recently, there have been overlapping sanctions under the Fair Trade Act, such as fines imposed by the Fair Trade Commission and civil lawsuits filed by the client for damages. The purpose of this study is to evaluate the effectiveness of penalty surcharges and compensation systems for preventing bid-rigging, and to consider the possibility of overlapping sanctions in public construction projects. It was found that overlapping sanctions under the Fair Trade Act can be helpful in improving the system. However, in cases where the state is the plaintiff for damages in a lawsuit, it is necessary to consider the penalty surcharge and sentence, reduce the penalty surcharge for joint acts, refund the surcharge after a final judgment, and consider the damage compensation system when imposing a surcharge. This study contributes to the development of an efficient enforcement model to suppress bid-rigging in public construction projects by analyzing the improvement effects of sanctions and compensation.

  • 전력시장에서의 공정경쟁의 중요성은 새삼 강조의 필요가 없을 만큼 중요한 것이다. 대표적인 전력시장에서의 불공정행위로는 시장지배적 사업자에 의한 시장지배력 행사와 다수 사업자에 의한 부당공동행위, 즉 담합행위를 들 수 있다. 불공정행위의 실제 행위는 시간별 가격과 용량을 입찰하는 과정에서 부당한 이익을 위한 전략적 행위를 행사함으로써 발생한다. 인위적으로 가격을 올리거나 가격이 낮은 발전기의 용량을 축소 입찰함으로써 정상적인 시장가격보다 높은 시장가격이 형성되어 이러한 부당행위의 당사자가 부당을 이익을 얻게 되는 과정이다. 이러한 행위는 상당히 은밀하고 전략적으로 행사되므로 그 적발이 용이하지 않지만 전력시장을 관찰함으로써 징후를 포착하고. 정밀조사를 통하여 부당행위를 적발, 시정하는 지속적인 활동이 필요하다. 본 연구에서는 이러한 부당행위를 적발하기 위한 기본과정으로서 입찰용량의 적정성 판정을 위한 지표개발을 시도하였다. 설비용량과 보수용량을 감안한 입찰가능용량과 실제 입찰한 용량의 상관관계를 분석함으로써 정밀조사 대상이 되는 비정상 입찰행위 식별지표인 용량철회 가능성 감지지표를 개발하였다.

Therefore, the purpose of this study is to analyze current bidding systems through literature survey, Questionnaire, contentment estimation and IDEF method to compare the result of the analysis with the developed electronic bidding systems and to suggest the improvement for the coming bidding systems. According to the survey, under present bidding system big problem is inconvenience of conducting process. Nearly all users of current electronic bidding systems were contented. When public institutions are planning new electronic bidding systems, standardization, security, law and bidding system consolidation must be applied. This study proposes an improved bidding system and described the effects through the improvements.

But these systems have still problems in diverse aspects. Therefore, the purpose of this study is to analyze current bidding systems through literature survey, case study and process mapping methodology, to compare the result of the analysis with the developed electronic bidding systems and to suggest the improvement for the coming bidding systems. As results of this study, key processes and classified contract types about public construction bidding were identified. These can be applied by means of guidelines when public institutions are planning new electronic bidding systems. The composition of unified driving organization, the database development for information share and the standardization of national level for the new electronic bidding systems were also suggested.
