This paper examines the extent of China's market liberalization in the construction market seen through the point of view of WTO agreements and Korea-China FTA. Since the environment set by these agreements form the institutional background that Korean firms must work with to successfully access the market, the Korean government must work to reduce Chinese barriers as much as possible through international negotiations on these agreements. The paper sets out three goals for negotiations and the appropriate agreements and fora the government can use to advance these goals.

국토해양부는 정보화를 통한 건설사업의 투명성 및 효율성을 강화하기 위하여 "제3차 건설CALS 기본계획"을 수립하여 현재 건설사업정보화를 추진하고 있다. 그 중 건설인허가시스템은 전국 개별공시지가를 이용하여 지방국토관리청에서 매년 3만여건(2010년 기준)의 도로점용료를 산정하고 부과하는 업무를 지원하고 있다. 개별공시지가는 매년 초 공시하지만 토지소유자의 이의신청 등에 따라 변경되는 특징이 있으며, 이에 따라 도로점용료를 재산정하는 등 대국민 민원행정 신뢰성 하락의 원인이 되고 있다. 본 연구는 건설CALS와 한구토지정보시스템의 개별공시지가 실시간 연계를 통해 도로점용료 산정업무의 신뢰성 제고 및 업무효율성 향상을 도모하고자 한다.

공정거래위원회가 건설기계임대차 분야에 있어서 불평등한 계약관행을 개선하고 공정한 거래질서를 확립하기 위해 최근 "건설기계임대차 표준계약서"를 제정했다. 이에 따라 국토부는 지난 6월 10일 산하 공공기관 관계자 등과 간담회를 갖고 표준약관으로 제정된 건설기계임대차 표준계약서가 공사대장의 작성.비치.관리와 함께 공사현장에서 널리 사용, 정착되어 건설공사의 투명성이 제고될 수 있도록 적극적인 협조를 당부했다. 이번에 제정된 건설기계임대차 표준계약서는 지난 해 대한설비건설협회를 비롯한 4개 단체와 국토해양부가 협의를 거쳐 공정위에 건설기계임대차 표준계약서 표준 약관을 공정위에 심사, 청구한 것을 공정위가 승인한 것이다.

There are many problems such as uncertainty of sequencing and irrational interdependence of processes in work breakdown structure of construction project. This study suggests work structuring for improving work reliability and transparency of processes to solve problems of work breakdown structure. Also, It proposes a process design diagram The goal of improving process design by work structuring is to make work flow more reliable and quick while delivering value to the customer. The process design diagram aims at achieving lean project objectives, such as, reduction in the share of non-value adding activities, increased transparency, process simplification and increased product flexibility.

GS E&C applies TPMS(Total Project Management System) to all construction projects. This system is applied to all overseas projects, it is successfully used not only GS E&C but also subcontractors, vendors and clients. TPMS collects data spontaneously that is used to each participant, improves effectiveness in construction projects and gives transparency to all participants while sharing same information. This paper is aimed to share successful case study focusing on document management system, and how to develop TPMS in the future.

Many construction companies have been trying to extend their businesses to the development projects after IMF. Project financing was introduced to the construction market and has been popular with construction companies which can not furnish funds for project by themselves. But, there are so many problems that project financing has not been activated in the construction field. One of the main factors that disturb activation of project financing is distrust about construction management among participants. This distrust is caused by the lack of speciality, objectivity, clearness about CM. So, to process business successfully, they need specialty and objectivity for the construction management. In this research, I analyzed the role and duty of the main participants about CM in the development project ana suggested an advanced management structure in order to activate project financing in the development projects.

공정거래위원회(위원장 권오승)는 최근 하도급법 위반사업자에 대한 과징금 부과시 과징금 부과여부 결정 및 과징금액 산정을 위한 세부 기준을 마련하고 지난 8월 22일 하도급법 위반사업자에 대한 과징금 부과기준에 관한 고시를 제정한데 이어 지난 8월 30일부터 시행에 들어갔다. 공정위는 과징금 부과를 위해 종전에는 위원회 사무준칙인 지침을 운용하였으나, 이번 고시 제정을 통해 과징금 부과의 예측가능성, 객관성 및 투명성을 제고하였다. 고시에 따르면 원사업자의 위법행위를 신고한 중소 하도급업체에 거래단절 등 불이익을 주는 보복행위를 하거나 하도급대금·어음할인료·지연이자 등을 지급한 후 이를 회수 또는 납품대금에서 공제하는 탈법행위 등 악성 위법행위에 대해서는 과징금을 부과하기로 했다. 또 위반사업자가 하도급거래시장에서 영향력이 큰 대기업자 이거나 과거 위반전력이 많은 경우로서 부당 하도급대금 결정, 부당감액 등 중대하거나 파급효과가 큰 위반행위를 했을 때도 과징금을 부과하기로 했다. 공정위가 하도급법 위반사업자에 대한 과징금 부과여부의 결정기준과 과징금액 산정방식을 보다 구체화하여 시행함으로써, 법위반의 정도에 상응하는 제재로 인하여 법집행의 실효성이 강화되어 재발방지 효과가 클 것으로 기대된다. 아울러 과징금 부과의 객관성과 투명성을 높이는 한편, 예측가능성을 높임에 따라 대기업 등 원사업자의 자율적인 하도급법 준수 의식을 제고하여 법위반을 사전에 방지함으로써 중소기업의 피해를 예방하는데 크게 기여할 것으로 보여진다.
