Electronic monitoring system was recently introduced as an effective means of controlling certain criminal offenders. Korean society manages ex-convicts only in reliance on the electronic monitoring system, which has a clear limit. For this reason, The reorientation program should be put before anything to subdivide the perpetrators equipped with the electronic monitoring device and separate them from the others from the start, or identify their criminal propensity and heal them.

2019년 2월 러시아 선적의 씨그랜드호가 부산 용호부두에 입항하여 출항하는 과정에서 부산항관제센터에 입출항 신고를 하지 않고 요트와 광안대교와 충돌한 후 사고보고도 하지 않았다. 총톤수 500톤 이상의 선박은 도선사를 승선시켜야 하나 부두앞 공간이 좁은 용호부두이지만 부산항도선구에서 제외되어 있어 도선사도 승선하지 않았다. 현재 VTS에 의한 모니터링 수준의 관제와 출입항법 위반선박에 대한 벌금규정만으로는 사고재발 방지대책으로 부족하므로 해양안전감시시스템을 구축할 필요가 있다.

우리나라도 이제 자율안전감시활동 참여가 우수한 협회에는 'Safety Guard' 마크를 부여하고 포상하는 제도를 계획했다. 이 제도를 제품 자체에 확대 적용해 임의표준을 더욱 활성화하는 것이 요구된다.

출자총액제한제도는 그 순기능.정기능이 논의되는 와중에서도 소기의 임무를 완수하고 정리단계에 들어섰다. 그 대안으로 순환출자금지제도가 유력하게 부각되고 있으나 그 논리적 타당성에도 불구하고 각계각층의 의견 상충으로 확실한 결론에 이르지 못하고 있다. 한편 우리 회사법에 규정된 상호출자금지규정도 대규모기업집단의 상호출자 규율에는 역부족이다 아무쪼록 대기업집단의 소유지배구조가 개선되고 시장감시장치가 효과적으로 작동될 수 있는 새로운 제도의 모색에 온 국민이 지혜를 짜 모아야할 때이다.

공정경쟁문화의 확산을 위한 자율준수프로그램(CP)이 상당한 효과를 거두고 있지만 이는 기업의 자발적인 참여를 전제로 하는 점에서 그 정착에는 한계가 있다고 생각된다. 보다 본격적으로 CP를 뿌리내리게 하기 위해서는 각 기업내에서 CP를 운용하고 관리하는 책임자를 법정할 필요가 있다고 하겠다. 이러한 의미에서 금융권에서 시행되고 있는 「준법감시인」과 유사한 「공정감시인」(fair officer)제도를 도입하는 방안을 제시하고자 한다.

This research examines the effect of outside director system which has been legislated after financial crisis in Korea. Outside director system is based on agency theory which assumes that a manager is selfish and opportunistic in situation where ownership and management of a firm is separated. In this situation, outside director system has an important function to monitor and keep in check a manager. Thus, we examined that outside director system works as a monitoring mechanism in Korea. And we tested that above effect is weakened in family CEO firms where it is different from assumption of agency theory in Korea. According to empirical result with 282 sample firm, it is confirmed that outside director system reduces agency cost. In family CEO firms, however, this agency cost-reducing effect becomes weak. This result suggests that outside director system needs be cautiously managed without focusing on only monitoring function.

IMO는 자율운항선박을 MASS라 명명하고, 이에 대한 운항안전을 위한 논의를 진행하고 있으며, 우리나라도 산·학·연·관 협의회를 통해 자율운상선박 기술개발사업을 진행하고 있다. 그 중 자율운항선박 운용과 연계된 기술기준 및 제도·인프로 구축과 관련한 세부과제로 원격검사 제도의 확대 및 기준마련이 요구되고 있다. 본 연구에서는 원격검사를 위한 선체·기관의 연구사례를 수집 및 현황을 분석하였으며, 기초단계에서의 자율운항선박의 상태감시 데이터가 원격검사의 하나의 방법이 될 수 있음을 고찰하였으며, 선박의 비상기기에 대한 원격검사방법 개발이 필요한 것으로 고려되었다.
