  • In this paper the consumer protection regulations of 16 wide area self-governments in Korea are studied. Status of consumer protection policy committees and their general policies for consumer protection of these wide area self-governments are also investigated. The data of consumer protection regulation were collected from the internet web-site of each self-government and the status of consumer protection policy committee and the general policy for consumer protection were obtained by requesting each self-government to report administration information during May through October in 200l. 13 of 16 wide area self-governments except Daegu, Inchon, and Jejudo have own consumer protection regulations. Major parts of these regulations conform the standard regulation of ministry of Government Administration and Home Affairs. Many of the consumer protection policy committees reported that they do not have meetings constantly. Moreover since the price of goods and services is the typical subject of meetings, the committees do not seem to properly play the role of a consumer protection policy authority. Contents of the general policy for consumer protection of many self-governments are simple description of detailed practicing plans according to the general consumer protection policy of the national government. By criticizing the problems aroused during the study of consumer protection policy of self-governments, suggestions are given which will help for the development of consumer policy of wide area self-governments.

  • This paper identifies the direction of change in consumer policy research, where consumer policies are shifting from consumer protection perspectives to consumer responsibility perspectives. In this research, text mining and association-rule techniques were used on the titles and keywords of articles published in "Consumer Policy and Education Review", a major journal for consumer policy studies, from 2005 to 2015 to find major research trends, longitudinal trends, and a research field association rule; these results were visualized so that they could be easily understood. First, 1026 keywords were extracted from 238 papers that had titles and keywords. From these, 73 keywords that appeared 10 times or more were selected as research targets and were analyzed. From the analysis, the longitudinal patterns of the keywords' appearance frequency by year showed steady increasing, increasing, one-time peak, and rapidly increasing then decreasing trends. Finally, the association rule was used to find frequent patterns in the keyword database; this revealed a structure in which groups were formed based on the keyword "consumer". Through this research, the trends and the keywords of papers on consumer policy studies could be understood; thus, this research can be used as fundamental data for predicting trends in articles on consumer policy studies.

The matters of consumer safety, public health and environmental protection are essential parts of making policy for consumer products. Moreover, policy authority should consider all measures based on consumer safety. In the process making regulations, policy authority has to have some methods to prevent errors on treating eligible persons as persons disqualified under uncertainty decision making of public policy. To recognize and ensure fairness on public policy, policy authority needs to establish basic policy making and fundamental concepts. Therefore, we developed conceptual model for consumer products safety, CPSPcon in this paper. The conceptual model is one part of SSM(Soft System Methodology) and can support specific policy target. The CPSPcon model can assist in evaluation of responses to an adapting or considering model.

  • This study reviews trends of Japanese consumer policies, with particular attention to the situations of operating local consumer centers, in an effort to find ways to develop rapidly changing local consumer administration practices in Japan. Budget cut on consumer administration by the Japanese government has resulted in a reduction of consumer centers in Todohuken, while new consumer policy, which seeks greater consumer independence, has encouraged civil consumer groups' participation in consumer administration. In particular, entrustment of consumer centers to civil groups has increasingly stimulated more region-oriented local consumer policies and enhanced the efficiency of consumer administration. To activate local consumer administration, it seems necessary to provide assistance to entrusted civil groups, strengthen business regulations of Todohuken administration, and ensure more effective operation practices of civil consumer groups.

Several policy suggestions could be made as follows to activate the systems and improve the performances of the consumer administration in both Japan and Korea. First, in Japan, consumer center must be efficiently operated while private consumer groups, firms, consumer agencies and other organizations must actively join to actively redress consumers' losses and implement other consumer policies. Second, in Korea, regional consumer policies are weak so that they must learn Japanese well-developed regional consumer administration system by examining their current development, strengths, and weaknesses. Third, working conditions must be urgently improved, increasing the number of consumer counselors who are involved in consumer policies as well as to guarantee minimum level of their payment. On the other hand, the trend of hiring married and old employees being responsible for implementing consumer policies in Japan must be improved. Fourth, divisions of works in consumer policies among consumer groups as well as their specialization in Korea are necessary. Finally, as counseling of consumers through internet were not available in Japan, that type of counseling must introduce and become more popular in the future.

  • This study includes definitions and major issues relating to product safety, and reviews about product safety laws of Korea and of other countries. In addition, this study suggests several ideas for a future governmental policy concerning product safety and the government policies to guide in securing consumers' safety of products. First, we need to set up consumer safety policies and laws dealing with complex consumer safety issues and to integrate existing laws for the safety of products. Second, opening a consumer safety agency and training workers who have relation to the safety policy, as a profession, are necessary. Third, it is required to redefine the product safety guidelines, strengthen the safety policy and to minimize safety regulations by the government directly. Fourth, each product of the safety management policies must be regularly evaluated and given feedback for improving its effectiveness. Fifth, information gathering, disclosing, and having a feedback system related to product safety should be rebuilt for the effective management of unsafe products. In addition, laws and the aims of product safety management being changed to focus on the consumers, control on imported products, collaboration with network and mutual-assistance systems of product safety-related agencies including international organizations and major countries and taking leading roles in the world are essential.

  • The legal relationship between patient and physician is legally equal relationship. But, in times past, patients be compelled to sign an unequal contract, substantially. Because of the imbalance between supply and demand in the health care market. Today, the law of supply and demand in the health care market is running well. And as the cognition of citizens' rights grows, the relationship between patient and physician can also get a lot of changes. Patients have the right to know the information about medical care, and to decide whether or not to get treatment including invasions against their own bodies. In other words, Doctors have an obligation to explain to their patients. If doctors did not provide patients sufficient explanation or information, it violates the right of patients. This is a tort, or a breach of contract. To improve the remedy for violation of patient's right, patient is able to be protected by status as consumer. If patient is a kind of consumer in terms of medical consumption, he/she as consumer can enjoy supplementally the consumer's right. The patient as a consumer can exercise now a consumer's right as a constitutional right. In addition, with respect to consumer's rights, Framework Act on Consumers was enacted. This Act is based on constitutional provisions of Article 124 and the Act can be seen as a law that embodies consumer right because the provision of the constitutional law delegates specific contents. In the health care field, patients need to win recognition the statue of the consumer to hold the sovereignty of the consumer. In particular, if patients are consumers, they may be able to make good use of the quickly and efficiently collective dispute resolution and association lawsuit to rescue their damage, the Alternative Dispute Resolution(ADR) of Framework Act on Consumers.
